Mickey Mousing Around

The plaintiff rented an apartment from the defendant and claims it was infested with mice. She says the defendant didn’t do anything about it, so she moved out. She’s suing for cost of the security deposit and pain and suffering. The defendant argues she just wanted a reason to move because the apartment was next to a bar, and he doesn’t think he owes her anything.

I lived next door to a bar and maybe a quarter of a mile from a bar district for 2 years. The only time I ever had a problem with the noise was when the city decided to do a music festival like Beale Street and closed the road down and let everyone walk around and drink. Wasn’t anything special about the apartment building I lived in. I’m a very light sleeper too. I needed an apartment and the rent was in my price range and a couple miles from my job. I’ve had worse problems where I grew up. It was rural and the neighbors liked fireworks and loud bass.

@@traceyjackson4470 I was right on board with the plaintiff at the beginning of the trial. And I agree that the defendant's arrogant and rude attitude helped in wanting the plaintiff to get some justice. The problem for me as the trial went on was that she really didn't have evidence of what she was saying. And, something about the way she was trying to use her emotions to sway the judge. After that, in spite of the defendant's really distasteful attitude, her lack of evidence made me think she was not telling the truth. It must be difficult to decide a case when you initially feel more sympathetic with one side but have to rule on the preponderance of the evidence.

I grew up in New York and lived by an elevated train station. Guess what you learn to drown out the noise or you will never sleep! From what I can see in the pictures that looks like a busy street and you will hear foot traffic as well. Plus she's only paying $1250 a month in NYC, that sounds about right I know 100 people lined up to take that apartment. As far as the mice are concerned, once again it's New York, and there are 9 rats for every person. You do the math, and she complaining about one mouse. When I moved to the west coast and slept over at my girlfriend's home, I could not sleep, I kept freaking out because it was so quiet!

When the people on the street are asked how many mice would it take for you to be able to break a lease and leave a property I say you have to give the landlord a chance to rectify the situation, if he/she doesn't Rectify it and you have proof that its an infestation that might be grounds to break your lease, but if it's just one or two no that doesn't give you the right to break your lease.
