Ikr? Like, she's bitching and moaning about not having water, but she won't let the landlord *fix it?????* What, does she want the structure to collapse underneath her? Does she want a black mold infestation all over her possessions? Better yet, what's she even hiding in there? She oughta be doing something bad in there.

Hey Mike, I am a retired Police Sergeant/FTO/Academy Instructor. When a warrant is issued by the court, it comes to us to enter in the database of wanted persons. (Dispatchers many times do this) the State Highway Patrol is responsible for overseeing the use and issuance of policies and procedures of the official police database and it's use. When it is entered into the database, it is assigned a Pick Up Radius (PUR) based on those guidelines which include the seriousness of the crime. However, it is at the discretion of the entering police agency to increase a pick up radius above what standard guidelines are. Also, there is essentially a checkbox to have it entered into NCIC (National Crime Information Center) database which is nationwide, also assuming it meets the guidelines, some crimes are automatically entered into NCIC without the person entering it having to do anything. That is how it works in our state at least. I hope this helps!

I agree Mike, I think Judge Simpson does tend to favor the tenants a little more than I would. I feel bad for the landlord in the first case. As for the second guy, why do you think he wants a jury trial? Does he think he can get a jury to sympathize with him? I don't think he heard or realizes it won't be a jury trial. I may have to come back and check on that date to see what happens. Thanks!

For extradition: Basically it depends on the Prosecutor in the home State. There may be blanket policies for various offense levels but I think generally it's by discretion. Since the requesting state is responsible to escort and transport the fugitive, they generally need to make an affirmative statement of the intent to extradite. I'm in Canada but when we extradite to the U.S. it's only when there's a specific request. If a person is arrested here and it's discovered they have a warrant at home, that prosecutor is asked if they want extradition and it only proceeds if they say yes. (Perspective from my time as a police officer, never been a lawyer.)

Law Talk With Mike: Just watched the video with the extradition thing, if you didn't know there is a Private Service that runs buses around the states and all they do is pickup Prisoners and deliver them to the Police that want them. its like con air with buses, For example they could pick up 1 prison fron NY and deliver them to CA, (but that is a long ride).

Hi Mike and all my Law Nerds. Happy fourth of July, we miss you all! 🇬🇧✌️🇺🇸. On the subject of “Ask” versus “Aks”, I would just like to venture that Ax was correct pronunciation around 1300 years ago and probably earlier, and moved into the developing English language from proto-Germanic root languages, which arrived with successive north European invaders to the English mainland. The word then was was something like aksian. Also, Chaucer, Caxton, and the Coverdale Bible (the first in English) use "ax". It persists to this day and is neither right nor wrong.

Thank you! I notice Mike didn't give you a like on your comment. As a member of the group from whom we hear these complaints; imo, my tribe is too sensitive about dialects. I'll leave it at that. Mike wouldn't even say the word! 😆
@kirajlerner
@kirajlerner 2 жыл бұрын
Yes, and thank you, I'm glad you brought this up. In addition to the above, Mike and others, and more directly: The pronunciation of "ask" as "aks" is part of AAVE (African-American Vernacular English) aka Black English, a dialect with its own consistent grammar, spelling and pronunciation, as studied by sociolinguists for many decades. See the many works of linguist John McWhorter for explanations--his "Talking Back, Talking Black" is a fantastic and educational book on this subject. I disagree with him on a lot these days, but wouldn't dream of arguing against his expertise in language usage. Depending on the circumstances/listeners, many AAVE users may choose to "code switch" to use the more standard or "proper" (bad word, but I can't think of a good synonym at 3:30AM!) English, which is an impressive adaptive skill. Many immigrants or first generation members do similar things. For example, some Jews (I'm one) may use different phrasing and Yiddish terms in some circumstances (e.g., family dinners) than we would in others (e.g., workplace). The judge is using this more colloquial speech to Black men; he may or may not speak more formally in different situations or to different people, I don't know. But at any rate, kvetching (Yiddish!) about his so-called mispronunciation is rather unfair. English is a beautiful, fluid language and is changing, branching and forking out to new dialects all the time because it's so influenced by multiple cultures and ethnicities. Changes come even faster than ever now because of the internet. It's one of the joys of the language.

Common sense tells me that this tenant is dragging her feet purposely knowing that her lease was coming to an end and the landlord wants her out for very good reasons. Come on she offered her a week stay in a hotel at her expense and she didn't take it, why? She has an Attorney and should have started the eviction process already. The owner could be sued by the downstairs owners or occupants. It's just a guess but bet, the tenant caused the problem.

He’s in this day’s stream. In a lot of the video you see him with the orange background with what looks like surfboards painted on the wall. Simpson knows him and they have a really nice talk about how he got straight due to Simpson’s help. Very sweet interaction after you see him waving his arms and reacting to people making the judge unhappy.

@lawtalkwithmike I love your content! Just found your channel! Is it possible to have the comments not block the zoom screens. Sometimes it covers who is speaking and other times it covers just the amazing reaction faces of those involved in the case 😂😂😂

Aks/ax is a dialect not a mispronunciation. It has a centuries-long history in English usage.

People will always try and find fault with dialects used by certain Americans while finding other dialects charming. Languages evolve and change and branch. The judge's particular dialect is as valid as the mayonnaise-based dialects of Chicago and surrounding areas.

@@LawTalkWithMike No it isn't. It only sounds wrong to your ears because they are attached to a closed mind. :-) Just kidding. I also find it distracting, but then I reminded myself that "Aluminum" sounds wrong to British ears "Aluminium" sounds wrong to ours. Apparently People Have Been Saying “Ax” Instead of “Ask” for 1,200 Years.

Tolkien put it the mouths of hobbits. It's been common in (mostly rustic) English dialects since the 15th century at least. I get how it grates, but it's just like all kinds of dialect weirdness. My New England ear grates when I hear Oregonians say 'INshurnce', and the grotesque crime they commit against the good name of Glustah is almost physically painful.

I learned my lesson wearing a nice shirt with PJ bottoms while in zoom court. I had to get up and I thought I turned my camera off... until I came back into the room. Lucky it wasn't a packed court..and thankful they weren't horrible bottoms or shorts lol

When I finally had a chance to go to college (in my mid 30s), I had to take 2 law classes to get my business management, I only passed because I spent so much time in the courts (even though mine was civil not corporate law). All the Latin words and my only knowing half English/French was brutal. Cutos to all that take law as a career

Hi Prairie Rider, auto correct must have changed "kudos" to "cutos", only saying since Mike was pointing out he wanted someone to correct the judge. I remember taking business law to get my management degree, too. Very interesting, but the book was 4 inches thick with the thinest paper I'd ever seen, and so much reading and analysis every week!
