For me, one of the key evidence was the brain scan which showed brain abnormalities years before the accident. His medical records also stated that he was undergoing treatment for anxiety/ depression for years prior to that accident. A professional doubted if he even sustained any form of concussion at all, no major brain damage, no new minor brain damage, no symptoms of concussion, key factors went against it as well, as he was drinking heavily after the incident, something a concussed person struggles with a lot, he got "worse over time" which is not indicative of brain damage either
