He’s too proud to take a settlement. He wants the whole shebang regardless if he is entitled to it or not and stood his ground foolishly. Now when he needs a new pair of glasses for reading which was brought up to him multiple times via his own testimony and the judge’s comments and recommendation, he is going to be out a lot more than $240. Ridiculous didn’t even begin the cover this

It's extraordinary the plaintiff has so much pride that he can't accept he WAS wrong even if it's in his interest to do so. He didn't even need to apologise, but just to accept what the defendant, the surgeon and the judge recommended. Breathlessly dumb.

Okay, so let me get this right. The plaintiff chose the defendant’s eyewear shop because it was a better choice cost wise. The judge gives the plaintiff an option of, 1. no refund, or 2. a new pair of reading glasses at no additional charge. The plaintiff says, “No!” So, this plaintiff who was most concerned about cost ends up giving away $240.00 to the defendant, but still has to buy a pair of reading glasses. Which means he’ll get them elsewhere since he was too stubborn and/or not smart enough to take the judge’s second option. Clearly, the plaintiff is not very good at math.

The plaintiff is so stubborn…up to a point where I personally suspect the beginning of a mild dementia (not sure how old he is). Sad, his life isn‘t going to be easy.

For some people it’s more important to be right in their own mind. Refusing means he can continue to feel right about the situation that he got ripped off. Rather than take the glasses (whether he needs them nor not) and admit he was wrong

I thought it was ridiculous and stupid for the Judge to push the defendant repeatedly to agree to put up with the plaintiff's BS ever again. Especially after the plaintiff reigned on their agreement reached and sued him.

He doesn't get it cause he's seeing it through a different lense....his age...he's saying the shop referred him to the optometrist who performed his surgery....therefore he figures they shoul have known his vision would not be the same afterwards....thats their line of business....however what he fails to understand people do not operate the same like yrs ago....where they probably would have told him to wait on the glasses cause his vision would change... Bottom line though...lesson learned...he should have taken the new glases😢

I’m am an optician and I will tell you, judge smiling or not I would stood my ground about not servicing this man. What will happen is you will make the glasses and this guy will come by every time the wind blows too hard, every time he drops his glasses and he’s going to complain about this pair of glasses to you for the rest of your life. You will never make a single cent out of him And he will drain the life out of you. I would partner with that doctor and dismiss this guy as a patient legally. Keeping excellent records of course.

The thing I don’t understand is they took his money for an order that wouldn’t work after he goes to the cataract place they sent him to. They should have recommended he wait to order until after the appointment bc it would be a different prescription.

he was seen EXCEPTIONALLY quickly, so quick the shop probably thought he'll need the glasses in the meantime. Just because he was sorted out quickly he thinks he can take a dump all over consumer law. He can't, which is why he lost. He was one of the most ridiculous plaintiffs I've seen on here, and that's saying something

I agree! That was poor practice. But the judge made it seem like he told them he would skip the cataract option and just go for the glasses, then afterwards decided it was better. I would say the first place was skamming him giving him glasses and telling him the cataract surgery would be super expensive, and the new place found a way he could get it cheap enough to afford. He seems too proud to say that it was about money. He even seemed to struggle when he was saying this dudes place was small amount cheaper and he was duped into paying more anyway.

There was no guarantee that the plaintiff would follow through with cataract surgery. The defendant may make a suggestion, but he has no control over what the plaintiff does. In the meantime, he has a job to do. The onus was on the plaintiff to wait to order glasses.

before the doctor recommended a surgeon for him, he already knew he needed cataract surgery but was scared. they cannot read his mind to know that he will finally go through with the surgery. all they know is that a man who KNEW he had cataract surgery but was too scared to get it in the past, ordered glasses to help him see. He could've seen the new doctor and still been too scared to have the surgery and would consequently still carry on living his life wearing glasses. Basically, if you order glasses, do it BEFORE you get corrective lenses.

Patients still need to see before and after the surgery takes place. We allow them to do a prescription change within a specific time frame for free.

Plain and simple, the plaintiff ordered and paid for his script (glasses). After he orders his glasses, he then decides to have eye surgery. He goes ahead and has eye surgery. After the eye surgery, his eyesight is all better, so he doesn't need the glasses he originally ordered, but since they're a prescription especially created for him, he can't just expect to return them to the defendant to get his money back... ... so naturally, he loses. Fairly. It has NOTHING to do with his race, as Adrian would wrongly have y'all believe. 🙄

Although I don’t agree with the plaintiff, legally speaking wouldn’t he be entitled to get 70-50% of his money back based on the store policy which says that a person will lose their 30-50% deposit if they change their mind/cancel? The judge is the one who pointed that out, so why wouldn’t she have a curtain number 3 or just stick to the store policy?

You know that's a good point. 🤔 And to answer inspyr9, verbal contracts can't override a written contract. I'm honestly kinda surprised by this outcome. Unless I'm missing something LEGALLY. P.S. I'm still glad the plaintiff left with nothing.

@@cynthiavaldez7127 the plaintiff and defendant both agreed to a new contract. i will not sue if you do the work. the plaintiff sued and breached the new contract. the judge was just trying to get a fair resolution and the plaintiff is just too stubborn

I understood it that he paid $240 for the lenses and frames, then all the squabble so the shop offers a credit and to put new lenses for 2nd prescription in his existing frames. So he should get a refund for the frames or if there was never going to be frames then he should get refund for above and beyond the 50% of the full price for which he paid 90% of.

I agree. Policy says deposit up to 50%. He should have got a refund for the amount he paid over the 50%

It's sad. I think the defendant really wanted to help the plaintiff. He wasn't happy to have "won". Sad all the way around. Wish them both the best.

The question is when did he cancel? If it was cancelled the next day and it wasn’t a one day shop then you know they haven’t been made yet. BUT it was 5 days later so no go.
