Sometimes that stuff only comes out years later, and it was "beyond reasonable doubt" at the time. You can give a man back his freedom after 5 years, but you can't give him back his life.

A Texas inmate requested a very large last meal. I believe the maximum budget the state allocated at the time was $150 to honor a reasonable last meal request. He spent every penny of it on an absurd amount of food from various locations. When they brought him all of his food he refused to take a single bite in a final act of protest. The execution was carried out as scheduled, all the food was thrown away, and the next day the governor of Texas signed an executive order ending the last meal program effective immediately. Since then, death row inmates in Texas have gotten whatever was being served in the cafeteria that day as their last meal.

Not only are hollow-points less likely to exit a body, but with 45 caliber hollow-points it’s practically impossible given how much they expand and transfer energy. What an awesome legal system we have here in the states, btw. The court is set on executing a person with no solid, reliable evidence.

There are two many factors to say it "can't" exit the body, however when it does, it's taking chunks with it. There would be a difference in a .45 hollow point and .30 ball (00 buck shot) both by damage done and by wound tract or tracts.

@@boldCactuslad why I have impression that you are police officer who shot his mate? With solid case, without tampering, it would be life sentence, not death penalty. With tampered evidences and unreliable witnesses, he shouldn't be convicted - innocent until PROVEN guilty, not innocent unless LOOK guilty. As someone said, we don't have proof that evidences are tempered, but if he didn't shoot, there is no other explanation, at least, shells are removed from crime scene and police officers lied. That leaves case without trustworthy evidences nor trustworthy witnesses. Even if he is guilty, it cannot be proved, thanks to cops, and he should be free. Also, it really matters how the victim died because felony murder rule has really strict requirements to be eligible for death penalty. Accidentally shot by police with instant death would be eligible only if criminal tricked police to shoot (e.g. put mask on hostage). If he was still alive and criminal prevented giving medical care, that would also be eligible for death penalty, but this case is not eligible for death penalty.

@@ronrozen2105 Yeah the judge pisses me off the most. I've seen these judges, they lose their empathy because the empirical experience from their job tells them everyone's a liar and criminal. But the thing is if you don't have enough life experience/brain cells to look past and beyond stereotypes then in my opinion a seat in jail would suit you better than a seat in court. If you don't have enough empathy to think through a case where someones' life is at stake then you're more subhuman than the people you're charging with maximum sentences. Something I wanted to say...the reason we were trying for life w/o parole was because we saw it as the best-case scenario. See, up until about 7 years prior, Tennessee didn't execute anyone for almost 40 years. But Republicans were starting to gain ground in Tennessee (even though Workman was executed under Phil Bredesen, a Democrat and to date the last Democrat to win statewide office), and they were running on a "tough on crime" platform. The remaining Democrats in Tennessee (except Rep. Steve Cohen, currently the only Democrat left in the Federal government from Tennessee) folded under pressure to be "tough on crime" too. They gained nothing from doing that. Since 2000, 13 people have been executed in Tennessee, with 49 currently on the states death row. And because our current governor, Bill Lee, seems set to execute more than any of his predecessors, it's not gonna end. They've even brought back the electric chair in case the drugs used for lethal injection become unavailable.

As a former police officer, and Marine Corps veteran, I've seen the damage a 45 round does. I carried a .45 as a Marine MP. IF it exits, the exit wound is at least three times the size of entry. Hollow points even more so. What a sad tale of injustice. Wasn't it Thomas Jefferson who said "better to spare 100 guilty men, than to convict one innocent man"? To be more precise, felony murder has death penalty, but only for worst cases which meet strict criteria (like actively tricking police to shoot hostage, active prevention of medical help). Also, if he didn't shoot, evidences are tampered with and witnesses are unreliable. That should lead to dropping charges. If his side of story is true, I don't think it would fall under felony murder. And without trustworthy evidences and witnesses, we cannot disprove his story.

You’ve clearly never been in a prison setting. Let me assure you prisoners are -not- living lavishly off of the taxpayers’ dime. That aside…you can’t walk an execution back. Innocent people have, in fact, been put to death only to find out later they were wrongfully convicted. Lastly, assuming the convicted is truly guilty of their crimes, you need to keep in mind two things. 1) due to the appeals process, it costs MORE to process an execution than life w/o parole. 2) life w/o the possibility of parole is a far more harsh sentence. Every single day for the rest of their lives in horrible conditions knowing they’ll never see the sunrise as a free person.

Sounds to me that there is more than enough probable cause here to not only save this man's life, but he should have walked out of that prison on a freaking red carpet! This is just shameful...worse than that even.... and the fact that all he wanted was a lousy pizza delivered to a homeless shelter and they couldn't even do that, says a lot about our prison and justice systems. Shame on them. Even if he did kill someone, it's just a pizza! And it's charity for Christ's sake! Let the man do one good deed! It's really nice that the community honored his last wish and a lot of people were fed that day because of this man. It is nice that something good came out of all of this. It also bothers me about them doing an autopsy. That's not right either. It's against this man's beliefs and religion. It's HIS body, he already even had a court order, they executed him! It's not like it's a mystery as to how he died! There's no ongoing investigation into his death! He wasn't contagious! So what's the point of cutting him open like a fish anyway?!? All senseless and just b.s. reasons get more money from the tax payers. Too bad they didn't spend the tax payers money on the pizzas, something they would have probably preferred their money being used for. I know, I'd rather have my tax dollars being spent to feed the living, than spent cutting open someone the state probably wrongly executed, violating his religious beliefs and vacating a previous court order ruling in his favor. Sadly ironic thing is, if the witness fully recanted and this was still in Kentucky as implied, the prosecutor COULDN'T HAVE charged him with Perjury. 1982 trial and 1999 publically recounting. Kentucky law doesn't list Perjury in its general statute of limitations list, but it DOES have a catchall "not listed 10 years". Federally, it's 5 years for perjury. He could have said he railed a line of angel dusted cocaine that night and lied cause God told him to with full knowledge it was a crime, and there was nothing the prosecutor could do about it anymore. Let alone the public outcry if they tried anyway. But the courtroom isn't the place to learn your rights, and they're under no obligation to tell you them there.

This is the most asinine thing I hear time and time again. We all know the justice system is flawed. Countless people have been commuted after 15, 20 years on death row, and still happens. As long as we know that the justice system doesn't get it right 100% of the time, we need to get rid of irreversible punishments like death. Just coming up with the most subjective exceptions like "those that truly deserve it" would change nothing. We're already supposed to be sentencing "those that truly deserve it", but it doesn't work like that.

It would have never happened if Workman didn't rob the store and shoot at the police. Workman was still responsible either way, so his execution was well deserved. So, no, execution was not deserved. Second, if he didn't shoot, that means evidences are tempered with AND police officers lied to court (they witnessed that he is only shooter, which is impossible if someone else shot police officer and absence of shells means crime scene is tampered; also, lack of ballistic report means that police disregarded procedure which could collect evidence in favor of defendant). With only other witness retracting his testimony, that means there is no reliable evidences and no reliable witnesses. Innocent until proven guilty means he is innocent if there is no evidences nor witnesses. We can discuss our opinion that he is guilty, but without evidences, sorry, but innocent until proven guilty is legal foundation in whole west world. There should be zero tolerance on evidence tampering. It's better to let murderer free than to imprison or execute innocent person. We can have strong opinion that someone is guilty, but if we based that opinion on tempered evidences, that opinion is worthless. Also, police will tamper with evidences as long as court accepts it. Only way to stop tampering is courts having zero tolerance for it.

It's true, but also, if he didn't shot, that means evidences are tempered with and police officers lied to court. He should be pronounced not guilty because of lack of trustworthy evidences and witnesses. Without evidences or witnesses, court should have no reason not to believe in his version of story in which he couldn't be held accountable for death that occurred after his surrender. In normal justice system, he would be thankful for police officers which basically destroyed case against him.

Of course we don't know the story of the "witness" because he did claim that someone threatened him if he backed out. Or allegedly. That could indicate that he got way over his head and if that "witness" was found to be lying in that case, his "testimony" would be overturned for other cases and this might lead to some trouble with criminals that probably would want him in the ground or would put his family into the ground. After all, he used the reward money to pay for a drug addiction. That might mean having to make connections with shady folks... Of course the "witness" could be lying out of his butt about the threats but there is a possibility that he couldn't just withdraw or take the "L" for lying because it might lead to more people dying. Namely those close to him.

I guess he'd probably use his power to get into a rich fancy prison for politicians or be put under house arrest like most dictators do. Pol Pot was worse than hitler and was never convicted. Idi Amin was exiled and lived a nice life in Saudi Arabia. Pinochet of Chile was put on house arrest in the UK. Dictators deserve the death penalty because its obvious they were in control and if not sentenced to death, they'll use their power to get off scott free. I was a crime reporter for a number of years, and figure I've attended between four- and five-hundred murder scenes. There were nights I stood over murdered women and/or kids and prayed (despite being an atheist) for someone to pay horribly for this crime. I had to be restrained once during a perp walk from throttling a guy who'd murdered a one-year-old. But I am more rational now. Until we create a perfect criminal justice system, our lust for institutional revenge in this country has to stop. My overwhelming feeling watching the second tower fall outside my window was a return of that "somebody must pay in spades for this" rage. And once again, I didn't much care who paid as long as they suffered. It took me a couple of months to snap out of it that time. I hope I never lose my ability to think like a rational creature again. I think much of the country, after 9/11 wanted to rain death on some benighted country on the other side the globe, and we weren't picky about which ones. And it went on for 20 years.

Murdering someone during the commission of a seperate felony such a robbery usually has that result, no matter who it is. I just don't see why he should be spared when his crimes were deliberate and premeditated. He chose to rob the place. He chose not to surrender to the police when they arrived. He chose to shoot at them. He had every chance in the world to avoid a situation where someone died, but he kept doing everything he could to ensure it would happen.
