Story 1: I think once the cameras are in, OP will be shocked to see how many friends-of-neighbors, friends of those friends, and kids of all of them, hop the fence all the time.

@@wplains Probably, yeah. The only reason OP wasn't on the hook paying for the injuries of the woman and kid was because they happened in the house, not the pool. Breaking and entering into your actual house isn't covered under attractive nuisance laws.

Oh yeah, also need insurance on the pool, my best friend has it on her pond because if anyone trespasses on the property and drowns in her pond she's liable. It's freaking ridiculous honestly.

New pool rule. No one talks about the pool outside the circle. No one invites new neighbours except you. Get liable waivers signed. You’ve basically opened it up to the public you’re eventually going to get into trouble.

That’s not technically correct. OP can have her trespassed, and any others who don’t follow her rules. First things first: it’s *her* property and it doesn’t matter if she opened it up to her neighbours, she did so with rules and expectations that her neighbours can attest to. ETA: the child didn’t hurt himself in the pool, he hurt himself in the locked home that his mother broke and entered into. She can’t be held liable for it because they committed a crime in the first place being in and on OPs property

@@phoenixsky6124 yeah but this woman wasn’t invited. She was a friend of someone who was, but her and her child were not invited nor welcome. She broke into OPs home by smashing a window. She has no legal recourse here.

The nerve of some people, to just help their self to a stranger's pool and do it in the pool. And the mother and her kids breaking into the yard to use the pool and then breaking into the house. Crazy people. The choosing beggars cousin and aunt, nobody wants freeloaders in their apartment.

They should've been made to pay for draining and refilling the pool, at least. That is so gross. I wouldn't want to go anywhere *near* that pool after that.

It sucks that some places make it so difficult to have a pool that you may as well not have one. Unless you have the EXACT type of fence and cameras, they can sue you and win for "nuisance" laws.

Story 1 : it’s the very reason why I’m gonna let people think I’m selfish when I don’t share my private pool. I’m just gonna avoid the drama altogether, OP was lucky no one died….Glass and Pool just too many Final Destination scenarios waiting to happen.

I would want to know who told these strangers that anyone could use the pool? And when OP would be away? I would close down the pool since someone in the neighborhood is encouraging strangers to violate OP's rules. Pool ownership in the US at least is a huge liability, because every entitled idiot thinks they have a right to someone else's pool and property and usually ends badly for the pools owners.

@@LaineyBug2020 In my 74 years I've heard many versions of private pools and presumptuous neighbors/strangers. Very very few have not been disastrous. As mentioned, pools are legally "attractive nuisances", and the owner is responsible for everything that happens, as well as having to maintain exorbitant insurance. I always wanted a fish and lily pond, but no, same problems.

That’s why I loved the pool we had as kids. Behind a gigantic 20 foot wood fence (honestly idk how this fence was even built lol) so no one could see it. Miss that pool.

@@fatimakhatun5788 As long as OP has followed city laws and ordinances when it comes to keeping your pool safe, and follow any guidelines his insurance has about such things, that most likely no, OP would not be liable. That wouldn't stop someone from trying to sue should they break it and get hurt. But bringing a lawsuit is different from winning one.

Story 2: No way should that entitled cousin and her friend be allowed to set a foot in that apartment. Even if the aunt did pay, it's not fair on OP's roommates.

There’s one key requirement of Attractive Nuisance Laws that absolves him of responsibility in this circumstance: “The property owner failed to exercise reasonable care to eliminate the danger or protect the children” He had a locked gate with a fence and a locked house. He exercised reasonable care to protect children from running into his pool who weren’t supposed to be there. It also only applies to trespassing children. All three adults are still trespassers regardless as they are expected to know the dangers and weren’t invited.

Story 2: Since the cousin and aunt are harassing the OP and the aunt is threatening the OP it might be a good idea for the OP to file an order of protection against both the aunt and cousin.

Story 1: OP is such an amazing person for letting people use his pool like that, and it's amazing how the community came together and it became a tradition. People like OP, along with his great and respectful neighbors really make the world for a better place. It's a shame that some people decide to take advantage of such wonderful people.

For the apartment story: in all the apartments I've ever lived in, there is a cap on how many people can be in the apartment, usually two per room. So, if there are already 6 people living in this 3 bedroom apartment, isn't it already at capacity? She could get in trouble with the landlord for even having her cousin and her friend there.

Most of them they also have a background check, and proof of income. Around here you have to make 3x the rent.( some want 4x) If I was that girl, I'd tell aunt, a year of rent, est share of all bills, groceries, cleaning, hygiene, etc paid in advance. At least 6,000 in cover money, since they don't work. To cover all stuff of others that is used, eaten, stole, etc, and that not one of the 6 is going to drive them around, run errands etc. Plus it would have to be all 6 agreeing to it. So first off, a interview, bring proof of income, copy of background, references from places they rent from in past. A credit history. Etc. I'd f**k with them for being so intitled, and rude.

It’s so sad that no good deed goes unpunished. The neighborhood could easily share OP’s pool so long as everyone has basic decency OR basic common sense. Who in their right mind would continue doing ‘it’ on someone else’s property when caught? They literally forced a criminal record on themselves. And the second incident: Do THEY provide an easy accessible bathroom and med kit for trespassers? And in both cases: Even public pools have some registration and rules to follow.

Story 3 reminded me of a horror house I went to about 5 years ago. Quick personal info; I have Multiple Sclerosis and have walked with a cane for 13 years at the time of this story. I'm a little jumpy and reactive so when a guy ran into the room with a running chainsaw, I almost broke out my mad cane-fu skills to protect myself and my friends. Thankfully I stopped myself but if anyone actually touched me at that moment, they would have been on the ground with a bruise forming.

When I was a little kid (around 6ys old) my Nan took my sister and me to Benidorm. The hotel pool was freezing and always packed. My older cousin (she came with her parents on the same holiday), well she told us there was a heated pool around the back. The heated pool belonged to another hotel. It was great, it had a small kids pool, slides and it was warm. So we went round the corner and played there while the grownups sunbathed. I had no inkling we were doing anything wrong. Well on the second to last day of my holiday I was playing tag with my sister and running round the pool. Someone had left a broken glass where I was running and without going into gross and gory details, it was brutal. I have a vivid memory of the whole pool turning bright red. (I know it couldn't have happened of course, but that's how 6yo me remembered it) A nice couple scooped me up screaming and took me in a taxi to the hospital which was some miles away. My sis and cousin had ran back to our hotel to find our Nan. I almost lost a big toe and the rest of my foot was bad as well. Lots of stitches. My Nan had to pay out for another taxi to the hospital, she also paid the kind couple back their taxi fare. And the worst thing was that she had to pay for everything as the insurance wouldn't pay up because we were only covered for the hotel we were staying in. All in all, a very expensive holiday. And my Nan was just worried and not remotely angry. And a little weird footnote to anyone still reading. My Nan owned a cafe in Blackpool. The couple that helped me were from Glasgow. And they recognised my Nan because they'd been to Blackpool and visited her cafe a couple of years previous.

Story 1: Yikes, that's a lawsuit waiting to happen. OP is nicer than me, however, he's lucky some poor kid didn't drown. Verbal agreement with a handful of neighbors or not, if someone gets injured on your property, you're liable. He's very, very lucky both incidents where the cops had to be called, he was out of town and there was proof the people had broken in, but even in that case, sometimes stupid lawsuits succeed. I remember when I worked at a department store. Some thief smashed in the front glass windows, then the glass jewelry cases. Cut his leg on the broken glass window as he was letting himself out, and sued the store for it. SMH.

Out of curiosity do you know if the thief won? I have heard that basically anybody can sue, but alot of times with the crazy cases with sueing people don't actually win. Like the pool owner wouldn't be liable for a person breaking in and using the pool without permission and slipping and falling but would be liable if he rigged booby traps around the pool and someone got hurt.

In Australia it is Law that you have a fence around your pool that fits all legal requirements for height, cannot be climbed, metal, special childproof gate…even if your property has a ten foot fence, your pool still has to have a Legal Childproof Pool Fence. It’s a really good thing.

You actually did a good job with city pronouncements. When I moved to Glasgow I mentioned I was looking at Govan. I pronounced it “Go-vahn” and my Airbnb hosts laughed out loud and told me “it’s ‘Goven’ like ‘oven.’ I’ve never heard it sound so posh!”

Story1 1) It is a huge insurance liability issue, I'm surprised he has gone 17+ Years with only 2 incidents. 2) Sanitary issues the sweat and oils actually decrease the pH level of the pool, acidic level.. You spend more money on chemicals to neutralize it. I know a few friends who openly admit to peeing in public pools, saying the Chlorine will clean it. I don't ever want to be in the same pool with them.

We had our neighborhood HOA pool closed for this reason. They weren’t called Karens back then, but they had too many issues so they said due to adults not being adults the pool is closing. ruined neighbor bondings. People suck

This is why I would never get a pool without a mechanical shutter. Call it ugly, call me selfish or paranoid, I don’t care. That pool stays closed unless I’m standing right there.

My god. It's incredibly lucky that nothing else happened. Nobody comes over to swim unless I personally invite them. At minimum, the neighbours should contribute to a hefty insurance policy.

Unfortunately, OP is legally responsible for any injuries that occur on their own property. OP should press charges against the intruding Neighbor, though, because breaking and entering is not just rude, it's a crime, and the mother needs to be held accountable. It sucks, I know, but that's how it is.

The insurance company would probably be legally required to refuse to pay and if the burglar neighbor sued in court the court would likewise be forced to rule against the burglar since there are laws that prohibit profiting from criminal activity which means that a payout in court or by the insurance would be illegal.

Story 1: I don't think OP's neighbors and friends are as trustworthy as they think. These entitled people ( sex couple/dumb mom) are getting the impression from somewhere that it's ok to climb this particular fence, break into this particular house, destroy this property, and use this particular pool. Unless they go around to other random houses and do this on a daily basis, which is just as messed up.

OP in story 1 is dumb. I know OP means well but she's too trusting of her neighbours. Like come on the neighbours and their friends must hop the fence more than OP knows. OP thinks there are a couple instances it went wrong but OP only knows about them because they got caught. OP also thinks it's a good idea to announce to everyone that she's gone for 4 days and then gets surprised that a couple break in into the backyard and know she's gone for 4 days. Also OP hears from the police that the new neighbour heard that they could come over at any time from a another neighbour and OP still let's everything go on. OP finally has cameras now but still how naive can you be?

Also, little tip--most haunts do use real chainsaws, they just take off the chain. Same sound and mechanism, but totally harmless. And yes, we did get hit a lot. Worth it.

Glad someone mentioned the chainsaw. I volunteered at a haunted attraction called Hangman’s for 2 years in high school. Before I started volunteering, I went through their strobe maze and accidentally bunched an actor in the stomach. She was so nice about it, she kind of guided us out and asked me if I was ok, l’m like ‘ I just decked you, are you ok?!’

@@catking1059 Haha, honestly, I was never offended when I got hit, because it's an involuntary reaction. Just means we did our job well. ;) There are some cases where, if you know for a fact your reaction will be explosive or violent, you really shouldn't be in a haunted house, but most of the time it's just that sudden fight or flight reflex rearing its head.

In my youth, I moved to a ski town to work/ski with some friends. We rented a 4 bedroom house. The # of tenants every month fluctuated from 8-15. One bathroom.

I didn’t have a pool but lived across the street from a school. Well, my dog kept getting out of the yard while I was at work and I couldn’t figure out how she was getting out. A neighbor told me that several neighbor kids were using my fenced yard as a shortcut and were letting my dog out. I put locks on my gates and came home to my dog being out. Both of my gates were broken. I nailed the back gate closed with big spike nails and replaced the front gate and lock. I took the next Monday off to watch and sure enough in the morning three teens were pulling and kicking my back gate. I walked out and yelled at them and they ran away. I went over to the school and told the principal what was happening and my house and car were egged a few nights later. I called the cops and it stopped.

In many states a lawsuit would be thrown out of court, had the woman sued you can't collect damages due as a result of a criminal act of trespassing

1. It doesn't mean everyone can, but this is why insurance companies hate pools. If it doesn't have various restrictions, they won't cover these situations. Thing is "I don't mind if anyone uses the pool" is the blanket admittance to everyone. She's worried about glass trinkets, not someone drowning. She told them she didn't need to be home for use. She announced to the entire neighborhood she would be gone for 4 days which explains how the couple knew she would be gone. She's stunned they knew what she announced as a public announcement. She made it a public pool. The only coverage she has in the last is the b&e was the house. It wasn't the pool. But she did have permission to be in the yard because the pool is open to the neighborhood without her being there. And the neighbors are telling everyone it's an open pool. She didn't shut it down because her insurance didn't need to pay out for the pool. If it had, OP'd be lucky to not have her insurance canceled for her public pool. OP will end up losing the home. 2. It's called subletting, so a landlord. Shouldn't have said that if her mom paid then yes because that was confirmation of a room. The stupidity of offering knowing the roommates said no. They should be considering getting rid of OP too because that offer can be accepted and then screwed because no one else wants them there. Those offers show a complete disregard of all the roommates. This creates drama with the roommates, and they need to be done with OP as soon as the lease is up. 3. As if every theater isn't the same. You buy tickets based on diagrams online. Now I wonder how often they get punched because getting grabbed involves throwing a punch for fight or flight for some of us. Haunted houses don't scare, but one worker almost copped a feel with next to no vision and knowing he couldn't see was all that saved his arm. It was in my grip before he could fully reach. I have my hands in pockets so if I make a fist I don't worry people. 4. By that age, she's lucky she didn't have a kid like me who had family with strokes so would have spoken up at how inappropriate it was. I silenced 2 6th grade teachers that were gossiping about me with the intend to bully me at the same time with the lovely lesson my mom taught me from a young age "you can disagree with adults so long as it is done respectfully". It also didn't hurt my mom had been a homeroom parent pretty much every year, so they all knew school was in control while I was there, but should they go out of line hell would descend upon the school. I ended with if I heard them again, I would let Mom know what was happening because their false accusations were regarding something that would get me kicked out. I wasn't playing games with that. OP's sub-teacher likely set off a kid with the same type of parent that didn't wait until the next day to descend.

Pool lady is lucky she has not been on the wrong end of a Law Suit during all these years. Allowing it makes her responsible, despite her rules. Not for the people who break in to use the pool, but the ones she has her “Contract” with. Do not let neighbours use your pool….EVER, unless you are there too.

S1: I grew up in the 90's, and had 2 neighbors who had pools. Every kid on my street knew how to get into the backyards easily, but NONE of us would ever have used the pools without permission from the homeowners, and certainly never would have used the pools when no one was home. That story is bananas.

Story 1: When I was growing up, we had a pool. We also had extra high privacy fences, and keyed gates. NO ONE was allowed in the pool without one of my parents there. Ever. I'm just going to assume people can now understand why.

Once someone has been living with you for a fairly short amount of time, paying rent or not, you can’t just kick them out. You have to go through the whole, horrible Eviction process.

Story 1 OP she broke the law by jumping the fence and braking into your house. Build a taller fence to go around you whole house and pool. That way it will be hard to get in their in the first place. Good luck OP.

Back in late 2020, I heard loud banging then glass shattering at my back door. A guy broke the backdoor window trying to break in. His eyes were wide when he was suddenly staring into the barrel of my .357 revolver. He rabbited. Being elderly and handicapped, I couldn't chase him. He's lucky he didn't get in. He'd have been hauled out in a body bag. Here in Florida, defending myself with deadly force is lawful, if I am in fear for my life. I still keep my gun within reach, always.

Story 2: I get why the cousin wants to live there with them. That place sounds amazing, but seriously? They want OP to pay for TWO PEOPLE. It isn't fair? I think it is fair because OP HAS A FUCKING JOB. I wouldn't let her move in at all. You don't move out of your secure place to love when you don't have a job. That's just irresponsible. You get a job first, save and then move out. There are way too many people in the place as it is and OP doesn't get to unilaterally bring in people without roommates approval. She shouldn't even offer to let them come. Also, family doesn't mean they get to take advantage of you. Edit after update: Aunts just sick of her. She says "family would do it." But mom is family and is not willing to do it so why should OP? OP has a shiny spine and a petty jaw and I love it.

OH OH LIMITS OF FEAR IS AMAZING, one of the rules my family has is: "don't be in the middle, you will get pushed" and I have to say, the bar at the end is amazing, especially when the scare actors are on break and having a pint. I remember going through and panic saying Hi to one of them, then a few minutes after when we were in the pub he came through for a break and we ended up having a really nice talk about how they do all the affects
