Hey, I'm Ben, rather than tell you my life story but you probably don't care and that's just fine. I'll just say that I left corporate America 3.5 years ago to start a recruiting agency, I made $100,000 in my first six months, scaled my business up and now I teach others how to start recruiting agencies and do the same!

Start that business now.I wasnt financial free as a nurse until my 40’s and I’m still in my 40’s, bought my second house already, earn on a monthly through passive income and got 4 out of 5 goals, just hope it encourages someone that it doesn’t matter if you don’t have any of them right now, you can start TODAY regardless your age INVEST and change your future! @@eadad4371 Generally, investing requires higher knowledge. For this reason, It's important to have a solid support structure (financial consultant) to guide you through especially in asset picking. @Ben Nader Have you seen this situation: The recruiter is commissioned on a permanent placement but if a relocation package is necessary then it is deducted from the recruiter's fee/commission.

Jeremy, thanks for the question, first things first, I do not generally play in the space of retained recruiting where commission is given up front and things like relocation or such are deducted or even where relocation is deducted in general, as I usually am not relocating people. HOWEVER, with that said, I have absolutely seen/heard of this type of thing in higher echelon search spaces like high tech, or legal etc. As a recruiter, from the business stand point, I would ALWAYS push back on this and never accept that their moving costs be deducted from commission. My work recruiting a high level candidate has nothing to do with them moving, and that is separate from my service. That's a company's burden IF they want to take that new person on. Period. I'm pretty stiff on drawing hard lines. That my two cents. I believe most recruiters that know what they're talking about would agree on it as well. You get every penny of that commission, no deductions.

The contract states that your client will have a minimum of three weeks. I think it’s meant to say a maximum of three weeks?

the company I'm working for paid double time for a Monday holiday worked. we then ended up working through to saturday of that week. The company paid us strait time for sat. and did not use the 8hrs worked on the holiday toward figuring overtime for that saturday. This seems wrong to me. I'm in Indiana. shouldn't those 8 hours count toward the weekly hours toward overtime for the week? they didnt count those 8 hours in figuring ot for sat.

It's all based on what's in the contract, but yes you're right, technically those hours SHOULD go for OT buttttt, contract supersedes.

Hi. Thanks for the video. I am wondering will any clients want to sign this kind of contract? The candidate ownership clause doesn't sound right to me.. If this contract is signed, the recruiting agency can just spam the messages on LinkedIn and I am sure there are some potential candidates would reply, without committing to work with this particular agency. The reality is they might be talking to five different recruiters at the same time, and deciding which one to choose. Or maybe few weeks later they think it is not worth of hassle to work with any recruiters, and just apply themselves. In any case if they got job offers from the clients, without signing any legal paper work that prove they are working with you, do you still hold the ownership of these candidates? If so, it seems like a huge disadvantage on the client side..

Would that just be a contingency placed in the contract or would that need a different contract? Where would i place the contingency in the above contract? QQ - some industry like the medical industry have more restrictions. Is having general liability and worker's comp insurance as the recruiting firm (temp workers) specific to certain industries?

I have a few questions...Is there a way to negotiate pay in the client contract for the new hire? (On top of the 10% commission) Also do I give the client a new contract with each new hire? (as well with new hire name included) One last question, Can the new hire be re recruited after the 1 year is up?

Anything can happen and yes you can negotiate plenty, that's kind of the point, figure out the best terms for you!

@ben Nader first off Thank you!! When you do contract hires do they send the employee check to you and then you do payroll? Or do they just send you a different check or do you invoice? This part is really confusing to me.

Correct, at the end of the month they send me a huge check to cover what I'm going to pay my employees and then the rest is my profit etc, minus taxes I pay on that profit.

But remember in contract hiring you have to pay your employees throughout that month, so you have to have the money for that up front, during that time, until you're reimbursed once you invoice the client at the end of the month.

I have a quick question. You said, that there should be a clause in case the candidate quits the job after a certain period of time. What if, they are fired or suspended after a certain period of time? Does the same clause apply or is the agency Responsible at all?

I've employed W2 for staffing contracts, I've employed 1099's for my recruiting business itself (internally) and so on and so forth, just keep it all straight and make sure your books are straight.

My math is correct. We don't go by 160x12. If you google it, there are holidays, various months with varying days and holidays etc, and the overall industry standard is to run everything on 2,080 hours per year. Trust me - I lost about $8k my first year in business billing by the equation you have above lol :)

Hi Ben thanks for this video its very helpful!!! I also just joined your facebook group as well!! I do have 1 question, as stated in your contract for direct hire you give the client 3 weeks to determine whether or not they're going to hire the candidate. How does the pay work within those 3 weeks? do you bill the client for the candidate as you would if the candidate was a temporary worker until the client tells you they'll like to full on hire? or is the 3 weeks just a trial run?....do you charge a flat rate for the 3 weeks that's worked and just hope that the candidate works those 3 weeks and get hired plus work the 2 weeks to actually be paid for that candidate?....if that makes sense

Hi Ben, great video! I have a question on the contract template. In the third paragraph, the first sentence where it states agency is required to present a minimum of one candidate……..Can you help me understand why exactly this language is in there? Thanks in advance!

It's what I would consider arbitrary language, and you can technically remove it if you'd like, however, basically it just means that for the two parties to begin engaging one another, the agency must actually give the client 1 candidate, just to engage, they aren't BOUND by law or anything to get them a candidate, it just sort of means "the contract starts once signed and this will be the first step" type of thing, you can remove it, it's really arbitrary.

I don't know exactly what you're asking but I generally am speaking only about the USA market here and how contracts work in recruiting here in the USA. The visa related issues around work and immigration is a whole other deal.

You need an LLC and a business license in your state for tax reporting purposes etc.

I spent 17 years as a software developer and I'm in the baby steps of now using that experience and starting my own IT Staffing agency. Right now, I want to focus on direct hiring. Do you have any examples of contracts that allow staffing agencies to stay on in a retainer fashion for X couple of months to find direct hires for them and get paid only if the agency successfully fills positions the client sends them during that time?

Is there a contract where you get a percent of what the employees you hire make every month?

That's called temporary staffing where you bill the company 25/hour and you pay your employee 15/hour and collect the $10 in the middle and after paying all your taxes you get the profit, it's not an easy setup but that's how that works.
