@Bill: I respectfully disagree with you. They wanted the fence wood to be of high quality (Redwood lumber is available in 30 different grades, I read). They wanted to be clear on the costs of *all* materials. They wanted the fence ground posts to be installed to withstand the test of time (photos w/workers showed they weren't). They wanted a no BS job to take place (the gap in the fencing looks retarded, imho). In closing: The defendants are quality people who like quality things and are persnickety and there's nothing wrong with that; it just means that *they* don't choose to settle for what 99% of the population will settle for.

@@pchelloo @pchelloo that where you are dead wrong my friend. The defendants know that plaintiff have a deadline and they try dragging their heels over that deadline in order to avoid paying. Probably thinking the plaintiff would not sue or would lose in court. If it is as you said the evidence submit of the multiple of revision by the initial contractor would show that defendants request a,b,c item to be done and the revision weren't including those a,b and c item. Instead as the judge say each time the revision are done defendants want more things done and moreover the itemized list doesn't come up until later revision are done. The initial contractor are sick of it and bailed. So with critical thinking we can all deduce as the judge did, that the defendants just want to avoid paying and will never be satisfied.

Since the defendants were being so picky and already scared off a contractor, the plaintiff should have said to the defendants to "take the lead" and get the fence done by "X" date, when his tenants move in. And if it was not completed by "x" date, the plaintiff would just do as he saw fit. The plaintiff was more than patient with them.

I was thinking he deserved half of the cost but then i put myself in the neighbours' shoes and realize that it's already bad enough for the law to force me to pay for something if i dont really want or need it. What if no one has pets and they didnt need a fence? In this case they will not benefit any from the fence that the neighbor wants for his own reasons. So one-third of the cost was a fair ruling since there is already a law in their State.

And the judge said it herself of you wanted everything broken down on the proposal, why not say it from the beginning, why wait until the 3rd proposal? But then the judge doesn't give him his half? Wtf? I feel for the plaintiff, even the contractor walked away.

My former boss, the Code Enforcement Chief for our community, decided to install a cinder block wall on the property line between him and the neighbor. A durable wall replacing a flimsy fence is a property improvement and increases the value of both properties, so it would benefit him and the neighbor. He spoke with the neighbor about splitting the cost, but the neighbor refused even though they knew it would be a huge benefit to them. So he dropped it and paid for the entire wall. When he had the installation done, he told the mason to not smooth out the mortar or in any way improve the appearance on the neighbor’s side, to not trespass on their property for any reason since they weren’t paying for the wall and therefore he had no right to trespass. So my bosses’ side of the wall was beautifully installed and smooth, a huge property value benefit. But the neighbor’s side looked like a sloppy cake that a child tried to frost: mortar passing out the bricks and dripping down the wall. It actually *decreased* their property value instead of increasing it! 🤣 They were PISSED and there wasn’t a damn thing they could do about it!

I have seen brick walls put up between houses in California. They are lucky this was just a fence and not a Wall. It was awful that they couldn't agree on the fence and now it has been done.

I hope someone else mentions that the alternating panels are referred to as a 'Good Neighbour Fence' and this design is meant to give both sdes an equal aesthetic view. The fact that she's whinging over the space between the panels gives a clue as to how patient the plaintiff really is. IMO

Defendants are neighbors from hell. They delayed the fence building for SEVEN MONTHS, even after being aware that plaintiff needed it done so he could have tenants move in. Really, the problem wasn't how picky they are (which is bad enough; who but an insane person wants a breakdown of the cost of NAILS for God's sake??!!??), but the fact that they couldn't get their act together to let the contractor know what they needed all at once. Continuing to change the terms over and over and over with more and more and more demands for months on end would frustrate anyone. No wonder he decided he didn't want to work with them; I wouldn't have wanted to work with these miserable people either. They have some kind of mental problem, and I feel sorry for anyone who lives near them.

She is absolutely horrible with being fair. The plaintiff was beyond fair and reasonable and she forced him to pay so much out of the 50/50 split because.... they are unreasonable? I really have noticed she is so biased in a lot of these cases.

The contractor made the right call to back out of that one. People like this don't realize that proposals take time to put together and so does each revision and will treat you like they already hired you whilst taking your time to make multiple revisions to proposals and you don't even have the job yet. Asking for the cost of nails is absolute bs. These are the type of people that end up hiring non licensed, non bonded and uninsured people to work on their properties all the while complaining about your prices and comparing your legitimate tax paying business to the local handy person.

I had a nasty pair of drunks next door and wanted a fence. We lived on a lake and due to the forest on the other side of them. Their only view of the water was towards my property. They basically told me to f*ck off. So I had a 8 foot high privacy fence built from the road to the high water line. $8k later they had no view of the lake. Originally I had a 4 foot high chain link fence in mind. There was no by-law standards for fences at the time. I later sold the house and found out a year later the new owner was happy for the fence because the drunks were such a holes. "Good fences make for good neibours."

FYI Sakrete in the post isn't that big of a deal..Sakrete make multiple kinds including no mix just add water..I've been in the construction trade for over 25 years and for a basic wood fence using a non mix just add water Sakrete is absolutely fine to use..I'd be more concerned about using treated lumber..

If they live in an Open Graze County in California- they aren't responsible for half, but they did agree to the project. In Open Graze Counties I can run cattle through your property to feed if it's not fenced.

Wow, these defendants are horrible customers. When I give estimates to my customers, I give a total cost of the job. I would never price every single piece of material out for the customer. Cost of nails, and such, I wouldn’t be surprised if they asked how many nails would be used in this fence, how many were in the case and subtracting money for each nail that was left in the case and not needed. They will never find contractors that are willing to work with them if they keep playing games like that. Every time the defendant wanted a revision, the contractor should charge that party specifically for their wasted time.
