Great talk on the legal aspects of using influencers in marketing your product. I feel like the situation has improved somewhat from 2018, but there is definitely still ignorance and shadiness going on. Thank you for providing a simple and clear guide for doing it right.

When your presentation is about "legal loopholes" I think something's fundamentally wrong with your marketing team. The rundown on disclosure expectations is useful but the interest in finding loopholes is just inherently shady. Long story short, if you have to find sneaky ways to violate the spirit of consumer protection law without violating their explicit wording, you're probably doing something unethical.

Loopholes aren't bad. Loopholes are like writing off expenses. If loopholes are inherently unethical, then the law must be inherently benevolent.

I can't help but wonder if you actually watched the talk. It's not actually about loopholes, in my opinion. Instead, it's giving helpful advice on how to *not* accidentally deceive your users and it's offering clear alternatives that make sure your users know exactly what's going on, at all times. Take the example of prompting users to rate your app. The presenter is laying out clearly that prompting the user for a star rating inside the app, and only redirecting the 5-star responses to the app store while silently dismissing the lower-star ratings, is bad and the presenter offers alternative options that are in your best interest but are not messing with your users. I haven't found anything unethical in this talk but of course your mileage may vary. Its title is probably not ideal.

@@moertel2237 I agree that the content is less questionable than the name does suggest, but I believe "ok, what's the closest we can get to not disclosing so that most of our customers literally won't notice, without breaking the law?" isn't particularly ethical either.
