The contractor started it by placing the mechanic's lien. He bit off more than he could chew, and suffered with an honest review. Not everyone is a pushover who will bend over and take the lien, smart people retaliate.

Do u really wanna say that the defendant is smart? He is only the henchman for his wife. And she is probably not exactly stupid, but for that extremely nasty, absolutely to be pitied and dissatisfied with the world and herself. But when it comes down to it, she is just cowardly. She and he are pitiable. Who wants to be or to live like that? Do such people have real friends? I don’t think so. And now they haven’t friends and no more flowers 🌸 😂😂

i completely agree, at first the concept of yelp and personal ratings and reviews was a really effective and cool tool for small business and just everyday normal people. now, with the ability to buy fake likes/reviews and to be able to use it against someone has made it a really almost detrimental aspect of social media. i remember in my early 20's as a young server, i got a bad yelp review insulting my looks and the way i walked, and it broke my heart.

I am not gonna lie, when I worked at a construction company, it was satisfying to put liens on homes. It wasn't many but these home owners that got liened deserved it. It was literally the last thing to do after we try to be reasonable. They would hold a 10,000 dollar check for a 50 dollar repair. We would tell them that we cannot honor our warranty unless we are fully paid and they would get angry. We needed to pay our employees with that check. Also that check was usually insurance money. By law, they can not keep that money. They are so confident when they don't pay us and then they come crawling back when they can't sell their house. They always paid with interest in the end.

And you'd be reversed on appeal for not following the law. Judge Milian got this right. Regardless of how crappy you feel defendant's actions were...they were legal and as a judge you can't follow your emotions. Judges have to follow the law. Plaintiff wasn't due attorneys fees as he didn't follow the process to effectuate the lien correctly and it wasn't the defendant's fault that he didn't do so. It also wasn't the defendant's fault that Plaintiff's address changed and wasn't updated to do be served. Also, defendant didn't lie in the yelp review. The Plaintiff DID turn it into a legal battle by filing a lien that had to be adjudicated in court.
