Lawrance may be guilty of an unsafe merge, but he is not at fault for the collision. Yes, the merge angered the van driver, but that does not give you grounds to retaliate and crash into the car that has offended you. The van driver is wholly responsible for the collision.

I don't know the rules in the US, but in Europe to legally use the zipper merge parallel driving needs to be fulfilled, which in this case wasn't (although it's a bit questionable…). That would mean the submitter cut the van driver off and was technically at fault for the initial maneuver. However, what the van driver did afterwards was without a discussion inappropriate and dangerous behaviour.

He hardly "cut off" the van; there was a good amount of space, and traffic was heavy. If you can't accept that heavy traffic means closer merges, then you should park your car and take the bus. Having a temper-tantrum and using your vehicle to assault somebody is road-rage, and should be punished with jail time.

@@ShinyMooTank You seem confused. A lane ending is not a requirement for a merge. If you don't want to exit, you are allowed to merge. It is true that a vehicle already in a lane has right of way - just because you need to merge doesn't give you right of way to do so. You, as the person trying to enter another lane, are obligated to make sure there is sufficient room to enter that lane without causing an accident or interfering with traffic that is already in that lane. All that being said, Lawrence clearly had room to enter the lane. There was more than a car's length of free space and while the van behind him did use the brakes, it's also pretty evident the van was speeding up to try to stop the merge, so Lawrence wasn't interfering with traffic either. But this is all secondary. Even if Lawrence had violated traffic laws by merging, it doesn't give the van permission to ram his vehicle. The moment the other vehicle drove over a solid line and then proceeded to turn into the Tesla, the van driver was 100% at fault for the resulting accident.

Actually there are only around 9 states where changing lanes in an intersection is mentioned and in four of the nine (CA, TX, NJ, and NY) it's legal with the remaining stating it's illegal (includes FL and OH). Like most states Virginia and Minnesota have no mention of this being illegal. That not saying it's ever a good idea since "unsafe lane changes" are illegal everywhere.

To add a correction to Video 11, that vehicle that was hit by the BMW was not a Scion, it was a Nissan Cube. They're both pretty "boxy" cars so they are hard to tell the difference between them but the rounded window corners on the Cube give that away.

1:01 - I had the same thing happen to me. A left turn is a “zero priority” maneuver. To make a left turn you are basically saying that nothing will go wrong when you make the left turn. If anything does go wrong, you are at fault, even if another car that you hit (or hits you) is running a red light. A left turn has to yield to ALL oncoming traffic legal or illegal.

The whole loose shopping cart problem still baffles me. Where I live and ever since I can remember shops use a system where you need to use a coin or a chip that cost a couple bucks to unlock your cart, and when you're done shopping, if you want your coin/chip back you need to return the cart and lock it in place. No more loose shopping carts.

It's a very common system across Europe, yes, and it is very effective at incentivizing people to return their shopping carts, but I remember when an Aldi (they're a German-based supermarket chain, for the yanks in the crowd who don't yet know where it's from) first moved into the town I grew up near, and when I found out that they did that, I was like "WHAT!?!?!?" Like, it came as an absolute complete shock to me that a business would even DO that. Charge customers to use the shopping carts. Outrageous!! 😤 Of course, I didn't hear the second half of that, where you get your quarter back for returning the shopping cart, until years later...

And I've seen shopping carts with brakes, where you had to push the bar slightly down to unlock them. It's a little more expensive solution, but solvers the problem for good. It was in Austria like 30 years ago, I don't know if they are still in use. Another solution I saw in Sweden is to give a little stamp for each returned cart, which you can collect and exchange for a little money. It's a bit convoluted, but this way you don't need a coin to use the cart, and children are happy to collect them afterwards for the money.

Part of the difference is caused by people stealing shopping carts, hence the need to put a deposit coin in them that is released when properly stacked. In the UK for instance, supermarkets are usually in town and close to where people live, especially social housing areas, so they would simply steal the cart to take their shopping home. In the USA you usually have to drive to the supermarket hence no need to steal the cart.

The question that I have about those cart corral is why there isn't a small bump at the exit to prevent them from going wild. Just about every shopping center in my city has something to stop them from leaving the corral. It really does not take much, and considering all of the insurance claims that they are likely getting, it definitely would save them money.

That's good, safe practice, but not what's legally required. The yellow timing has to account for somebody rolling around in a vintage car on drum brakes -- that guy has to brake early. The Tesla driver doesn't have to brake as early to get into the intersection during the yellow.

To be fair, it's easy to judge a crash on a screen after it happened... at the moment, you don't have time to react or think as well. What might seem like ages in the video could seem like nothing to an unsuspected driver. Watching this video about crashes you are looking to see how it's going to happen. While driving you're not. Especially if commuting. All in all, you can't always judge quickly if it's better to let the original accident happen or not.

I think it's like 40 percent of traffic crashes automatically blame Daniele for it, because he didn't strike Grandpa right in the face when he was committing three illegal activities. Wrong Way, Failure to Yield the Right of Way, and Public Endangerment. If you don't strike Grandpa in the face and you evade and almost kill the pedestrian on the sidewalk, Daniele gets the full blame for that if the cops don't use the Teslacam Footage in court showing Grandpa committing the three crimes.

I am still flabbergasted by how many of these accidents are so easily preventable. Even if it is the other driver's fault, driving without tunnel vision and having some awareness of your surroundings would make is so easy to avoid many of these collisions. In drivers courses this is taught of course, "stop if you can" however the law needs a much more rigid definition. The rigid definition is your front bumper must be in the intersection (in AZ that means past the curb of the intersecting road, as an example, it is not the crosswalk) before the light turns red, otherwise you are considered running a red light. She was more than half way through the intersection before the light changed. Side note: this is why the person turning left needs to wait, as they have already entered the intersection and therefore will not be running a red light after waiting for the oncoming traffic to have a full red and stop.

Actually no, it means the light is about to turn red. That doesn't mean stop, it means you need to use your judgment whether you should stop or not. (Did it just turn yellow, do you have to brake hard to stop, then don't. If it's been yellow for a while then stop.)

$12,000 was my guess actually, multiple panels hit, dents and scratches too deep to repair so they have to be pulled and replaced with new ones, some of them probably have to be cut off and new ones welded in even so it is a non-trivial amount of labor. And it would be about the same even if it hadn't happened to a Tesla, pretty much any vehicle less than 5 years old would cost about that much to fix as much damage even though it is all cosmetic.

Also the guy with the brakes locking up. I mean....What the actual bleep....I have owned no car in the last 20 years that did not have atleast ABS brakes. First car with ABS brakes were a mid 1990s car and since then they have just added new features like traction control and ESP. That car was probably also on leaf springs and all drum brakes and an engine with a carburettor.

Regarding trailer changing lanes in an intersection, That depends on local laws, where i live, it is illegal to change lanes in intersection so this would be an easy case.

It's illegal in most states, usually with a 100ft rule, and in states where it is not illegal, it depends on whether you had a broken or solid lane line before the intersection. In this video the lines were solid going into the intersection so you are to assume the solid lane line carries through the intersection and you are not allowed to change lanes.

I would think that the rules in Germany is the same as in my neighboring coutry. You are not allowed to cross the line unless you can do it without being in someones way. Here they teach new students taking driving lessons to treat the white line as a "Unconditional yield". The traffic in the lane always have the right of way, and you are not allowed to change lanes if it impedes other drivers. Only change lanes when it is safe to do so. That being said, the truck should not overtake at all, they are all allowed to do the same speed so when they do overtake it is usually only 1-2 kph faster than the truck they overtake, as the trucks are electronically limited.

Daniele should watch a season or two of Canada's Worst Driver. Daniele would learn about tunnel vision and that you should never drive towards the spot where the bad driver is going. Always keep going in the direction you were initially or drive towards the area where the bad driver is leaving (or left). Canada's Worst Driver has a challenge featuring a wall in front, and a random object that will pop out in one of two lanes that run parallel on either side of the wall. The contestants have a split second to make a choice of where to go. The goal of the show is to learn how to drive properly and not be the last person remaining at the end of the season.

The fact that the driver chose to evade directly towards a pedestrian shows their lack of awareness of their surroundings. In that case, they should have either gone to the left or hit the other car to spare the pedestrian injury, as the pedestrian is completely vulnerable.

@@fergusontea No one is able to make a split second decision like that, unless you go trough some sort of specialized training, she was already mentally prepared to turn right a bit further ahead and was paying attention to the road, not the sidewalk, as anyone should; she got jump-scarred by the oncoming car, veered, and then saw the pedestrian.

The only thing I can think about with #17, is because of road design and infrastructure an innocent pedestrian almost died. I would say the person at fault here is the person that designed this murder-machine of a stroad. Yes, the elderly woman shouldn't have U-turned, yes, swerving is natural, but build roads properly and this won't happen - or at least not as freqently.

7:54 Nope. Oliver is wrong in assuming he's at fault. The recommended speed means nothing and there are cars that do well over 160 miles per hour regularly. It's entirely the trucks fault and must be dealt with as such. (Court mandated safety lessons for the truck driver). Simply because it's pretty rare for such a thing to happen.

@@spacemanmat Absolutely not. Drivers must learn that right turn on red is not obligatory because they have ZERO right of way. The mainline has the green and must be allowed access to all lanes to safely clear the intersection. The same applies when accessing a road without signal control or private driveway. It is the approach with the stop control that must determine when it is safe to access the road.

I think the SUV just misjudged her turn. She MUST yield the right away to traffic. Their fault no doubt. The trailer had signaled, so she should see that, and not attempted. The trailer was fully in the lane when the impact occurred. What it looks like to me, is SUV driver was going to try to slip in behind the trailer, but was likely watching traffic instead of her turn, and she tried to make her turn a few seconds too early.

@@bently4854yes but the truckes insurance would still cover 75% of the damage while your own insurance would cover the rest (if you are vollkasko insured). The insurance might not cover the full 25% if your speed was way over 130kph and is considered not appropriate for the traffic situation. Oliver definitely screwed himself no matter what, i don't know why you would not even try to file an insurance claim. The truck definitely caused the crash, no debate about that. It's perfectly legal in many places all over the US. Local municipalities and individual states set the rules regarding changing lanes in intersections. Nevertheless, right on red is permitted, not required. That SUV should have waited for a longer break in both the middle lane and right lane before pulling into the road, or just waited until their light turned green.

#7 I would absolutely say they were both at fault, but if we are saying who is fully at fault, it would definitely be the work truck. First off, the SUV made a completely legal maneuver by making a right on red when the lane was clear, there was no one in the lane, so they were allowed to do so. Second off, it is illegal to make a lane change inside, or within 100 feet of an intersection to avoid incidents like this. While that isn’t a law in every state, and I don’t believe it is in Virginia, the law in Virginia states that you may only change lanes in an intersection “While it is *Safe* to do so.” The SUV can be clearly seen to have been making the right on red before the work truck started to move over, so therefore it was not safe for the work truck to change lanes, especially because of the fact that he had plenty of time to see the SUV was turning and back out of the move. The SUV of course saw their lane was clear and started to turn while watching for traffic in the same lane. I highly doubt the SUV expected the truck to change lanes in the intersection since it is so far frowned upon, making it so they weren’t looking for the work truck or expecting them to be there, so they didn’t have time to react to the move. Therefore I would give the work truck more of the blame, if not all of the blame.

Most likely Daniele was told he would have been facing a prison sentence if the pedestrian had been hit, although the mysterious "they" is not defined, although I suspect it's the police.

#8 the pickup truck driver that locked his wheels and skidded into the barrier; ignoring that "ABS" light has consequences. If their ABS system wasn't showing a warning and they were using all OEM equipment, then they (or the NHTSA) may be able to sue the vehicle manufacturer for a defective ABS system because a proper functioning one would never have allowed that to happen.

#20 took place in California. People commenting on yellow light rules need to understand they vary from state to state, and they may of course be different in other countries too. California does not require stopping for a yellow when it is safe to do so, although it is still advised in their driver handbook.

Number 20, the first clip, if you pause at 0:20, the moment the light turned yellow, it looks like she had tons of time to safely stop. So much, in fact, that I would argue it was not legal to run that one. Even with the second camera at 0:22, she appears to have enough time and space to safely stop. The second one looks like less but still enough. This looks like one of those really too hard to call yellow light situations. But if the law cleared her I guess she's good. 🙂

Exactly, reckless driving. It's legal to cross when the lights are yellow but from reading the USA traffic rules it states the yellow lights are "a sign that the red signal is about to appear. When you see the yellow light, you should stop, if you can do so safely. If you can't stop, proceed with caution, looking out for other vehicles that may enter the intersection."

If you watch the very last camera angle at the end of #20, you'll see that the light turns red a solid 2-3 seconds after the impact. While I agree she had time to stop, in many states you are not under any obligation to stop when a light turns yellow. In many states, you can freely enter an intersection under a yellow light. Had she not been hit, she would have cleared the intersection before it turned red. So while she could have stopped, she obviously knew the light well enough to know she could make it through the intersection before it turned red, and she was likely legally allowed to do so.

3:36 I’m from Italy, and most of the roads that are for industrial use in the outer part of the city (judging by the company name on the wall that Daniele hit) don’t have any clear road markings on the asphalt itself due to them wearing out over time and not being repainted, so it might actually have been a double way road… BUT 45mph, which is approximately 80kmph is above the usual speed limit of those areas, which is 60kmph (about 35mph), sometimes going as low as 30kmph (about 20mph). So at least for me, he was in the wrong either way

To solve the shopping cart wandering problem they just should do what our lot do in the UK, have a auto brake on the cart which as you let go of the cart bar it auto locks the brake then when you hold the brake band under the carts pulling bar with your closed hand the brake let's go! And also we have a chain system that holds all the un-used carts together in the cart area, you have to undo the chain by pushing in a £1 coin to unlock the chain section your cart handle has from the next cart and you get the coin back when you push the cart back to the cart area and clip back in the chain in the handle. two ways to stop the cart escaping.

2:30. I have to say something about that. I am a San Franciscan and that is not a merge. It is a cut-off. That is US101 to US-80 East Downtown area. Decades ago that lane to seventh street are pretty empty as you are not supposed to take that lane and cut off someone rushing to bay bridge. Now that lane is becoming heavily congested because people driving like this cammer. Jesus.

8:56 If you are in the furthest right lane turning right, you turn into the furthest right lane. If you are in the furthest left lane turning left, you turn into the furthest left lane. It doesnt matter if there is 1 turning lane or 2, you never cross multiple lanes of travel at once. You are required to wait and look again before moving into the second lane even if you are coming from a 1 lane 1 way to a 6 lane bi-way you always turn into the closest lane. If you are in the second turn lane you turn into the second closest lane and for gods sake give the first lane some room especally if theres a semi (semi's are always supposed to turn from the second lane but sometimes that just doesnt work out.) Dont be a dumbass, turn into the same lane you turn out of aka the closest lane. You might be turning right on red when the traffic across from you has a green left arrow. Also if a line is solid do not cross it, double solid yellow and you want to turn left out of a parking lot? turn the fuck right like you're supposed to. The only time's you are ever allowed to cross a solid line is to get onto or off of the shoulder or if it has a dotted line next to it such as a shared left turn lane. This is a law so the government doesnt have to spend millions of dollars putting a no left turn sign at every entrance and exit. Those signs are not cheap.

It's normally not legal to turn into other lanes, if you turn from the closest right lane, you have to proceed into the closest to right lane. Hence why the Nissan Cube that was hit by the BMW was also in the wrong.

3:37 - Daniele shouldn't have swerved. The police are correct - if he had hit the woman, he'd be looking at a prison sentence, since it's his maneuver that caused it. If he had hit the other guy, the damage to the Tesla would probably be less severe and the question who's at fault would have been pretty clear. This is why you don't swerve - if you hit something, it's your fault. If you don't swerve and collide with someone doing something stupid/illegal, it's probably their fault.

Easy to judge from a screen. At the moment you have zero time to think clearly and humans default to whatever thought comes first. We're no machines to start thinking about all of our options and evaluate them in half a second.

#7 - I learned in drivers Ed that it's actually illegal to change lanes while under a red light, in GA anyway. So the truck with the trailer would be fully at fault.

10:33 The truck driver is mostly liable since they illigaly merged in a intersection. however it depends on the state they are in and if there hast to be 100% at fault in order to befound liable like earlier in the video in the parkinglot.

0:42 since this happened in california, I would like to answer. BOTH OF YOU. The RAV4 failed to yield but obviously your speed was unsafe for the traffic conditions, you could have easily stopped at the light or reduced your speed since the RAV4 was already in the process of turning. 70/30 split, with more of the fault on the Toyota.

I was just rear ended a few days ago. Came to a gradual stop in highway traffic and a Volvo hit me at 30 MPH. Driver says by the time he looked up it was too late to react. Damage looks similar to the GMC rear end damage and will probably result in a repair cost similar to the $12k. What sucks is I just a week ago got the final payment from the insurance company for the last rear end collision repair (another distracted driver). So in the first 5 months of having my first new car in 2 decades I have two rear end collisions.

10:50 is a hard one (and is likely dependent on the state) but I would argue that the truck with the trailer is primarily responsible. Some states have laws which dictate that you should not change lanes in an intersection (specifically due to this). The truck should have waited until they cleared the intersection to change lanes. Additionally the truck failed to properly indicate. You should indicate no less than 5 seconds before making a lane change.
