She invited them to come and talk some more about the case. That constitutes a knowingly and intelligently waiving of her rights. Once that happens, they can begin interrogation again. She can then shut it down again, but she didn't. Anyways, if you want an authoritative source - Miranda v. Arizona 1966 "If the interrogation continues without the presence of an attorney and a statement is taken, a heavy burden rests on the government to demonstrate that the defendant knowingly and intelligently waived his privilege against self-incrimination and his right to retained or appointed counsel." "An express statement that the individual is willing to make a statement and does not want an attorney, followed closely by a statement, could constitute a waiver." Which is, *exactly* the situation that occurred here. Further supported by Edwards v. Arizona 1981 "In concluding that the fruits of the interrogation initiated by the police on January 20 could not be used against Edwards, we do not hold or imply that Edwards was powerless to countermand his election or that the authorities could in no event use any incriminating statements made by Edwards prior to his having access to counsel. Had Edwards initiated the meeting on January 20, nothing in the Fifth and Fourteenth Amendments would prohibit the police from merely listening to his voluntary, volunteered statements and using them against him at the trial." In short, once you tell the police that you want to keep your mouth shut, you have to actually... You know... Keep your mouth shut.

@@lexijones8019 not necessarily true. Once she invokes her right to counsel, authorities may not question her any further. If they continue to question/interrogate after that, then yes, it is inadmissible. However, just as one can invoke their 5th Amendment rights, they can also retract them and choose to talk after all. I'd argue that is what happens here. Tucker initiated further dialogue with the investigators and gave her account of the events. Their questions were mostly clarifying the information she was freely giving. There is also another situation where one can invoke their rights yet still incriminate themselves, in where a suspect makes a spontaneous statement that was not prompted by interrogation. For example, while in custody a suspect says "they got what they deserved" or "I'd kill them again if I could" and the statement just came out of the blue (hence being considered spontaneous) and was not influenced at all by the questioning of Law Enforcement, the information can still be used against the suspect. With all that said, defense attorneys can always bring these situations to light in an attempt to suppress the evidence. This occurs in an official suppression hearing in front of a judge and they can decide whether or not the information will be admissible during the trial or not. Courts have ruled both ways regarding these situations, and the judge has complete autonomy over the decision. So, with all that said, you aren't wrong, there are just circumstances where things are different and the courts ultimately decide on how to proceed.

I’ve heard in that video “This isn’t a will!” So I’m guessing the brother called the notary and told the sister it was o my for a will just to trick the grandmother to sign the property over to him. The daughter probably thought “Hey I only took out loans in the amount of maybe $30 grand or so, I still have another $10 grand left if this property is valued at $80 grand, and he’s trying to jip me out of my share and screw us over. He’s a dirty drug addict, a loser, a fall from grace and no one would ever miss him or worry about him…(not sure if he ever had kids of his own so she likely expected him to just “vanish” or not wake up cuz of the drugs.” For some author and her daughter, I’m willing to bet the mom already maxed out her share and the brother let it slide for as long as he could. If they dug deep enough, I’d be willing to guess that the property or the loans on the property started to creep into the brothers entitled amount and that’s when he decided to take action. The mother felt cheated even though she got her loans. She likely didn’t care to acknowledge that the loans she got, were lowering the property which reflected on the brother. It doesn’t matter if he blew it on drugs or not. You can take your money and do whatever with, he had no say, while he could do his. It would be sad to sell a family members home that they raised money to own for themselves only for a relative to blow it all on drugs. I get that. But also, some people you can tell them til your blue in the face that they are touching your inheritance and they just don’t care. They don’t like you feeling like a victim when they have to be it. It just perplexes them. They can’t function without being the victim. Money changes people. I’ve seen it with my mother. When my parents were separated, my mom would still go to family court and talk about my dads stupid things from old jobs he wasn’t working for anymore.. I think a 401k or something..I was young like 13.. she just kept going on and in about that money.. and eventually when they sold the house, they paid off the bank loans and went there separate ways, mom blew through all her money. Some people arnt good with money. We should have money management courses in school. Have you heard. Chase banking has credit cards for students under 18. Not typically credit but I mean debit cards adults parents can monitor transactions and transfer money into their accounts. It’s incredible. Parents can have their kids learn about managing money and expenses. It would be a useful hobby. I’m still horrible with balancing my checkbook. It’s basic math😅

She and her mother were a signature or 2 away from losing the rights to any MORE of their parent's property after their deaths, and Mom had already taken out loans on THEIR property,for more than what her half of everything would've been worth..So those 2 would've not gotten any more money off the parents THAT is why she shot her uncle.. When you shoot someone & you have that much motive plus a video that proves the man was not threatening anyone's life at all, then a,15 year minimum sentence should've been her sentence if not more.

My sister survived a couple of rapes and I always find it interesting that the people who are against getting proof for SA also fail to understand that when a guy gets investigated for rape or sexual assault, the cops look into him for other stuff too because it's just sitting there. If my sister had gone to the cops about her first rape, the second wouldn't have happened. But not just her own tapes. This guy has a history of raping women. How many other women got raped because she didn't take it to the cops? She was a junkie at the time, but now, she regrets this very much. People who get upset about requiring women to prove sexual assault invariably don't really care about the other victims. That is pretty sad. In reality, this "believe all women" Schtick is more about giving women the power to use the long arm of the law at their beck and call with impunity, not actually about protecting vulnerable women.

Tbf, inheritance is not deserved through actions, it's simply the wishes of a person who dies for how to settle their affairs. Whether or not his sister helped out is not material to the will of inheritance. The fact that she accrued debt against the inheritance, then probably had her daughter murder her brother to steal his half is crazy. Not half as crazy as the fact that she got away with it. There's little justice here.

There you have someone who paid no attention to her parents but still was getting 50% of the inheritance, and then you have Shane who was a very active part of his parents life and their well being and was essentially being set up to look like this violent monster and slaughtered so the evil lady and her daughter could get money. Absolute disgrace that Tucker only got 6 years. If you take into account time served, she probably would only have to have done about 1-2 years of that sentence

Caretakers receive rarely the credit for the grueling work they do. It’s not about getting paid it’s done by a family member (and nurses during self health care breaks) out of empathy and love. The only true payment for such a misunderstood sacrifice is the joy you receive by making your loved one comfortable. It’s the ultimate gift you can give to a vulnerable and sick human being. I wish there was more support for those of us that do it but there isn’t. Caretakers must remember to take time for themselves so they are not overwhelmed.

Thank you for mentioning the correct way to say Aisling, listening to people murder such a beautiful name was making me mad. I kept screaming at my screen, "If you were That Chapter, you’d get it bloody right! It’s Gaelic! You can’t just sound it out. KZbin make’s videos on how to pronounce names!!” There are people who named their daughters Aisling and Niamh who tried to tell me they’re pronounce Aceling and Nim. With total seriousness. I told them, to never go to Ireland and say their names out loud; as well as "YOU’RE DOING IT WRONG!”

How could he rest in peace? He was murdered by people who were extorting his mother, who were borrowing against his inheritance and killed him for his inheritance. And the person who came up with the whole plan, Aisling's mother escaped with no charges and Aisling got a slap on the wrist (she'll serve half that time before parole, at most) And she's going to get that inheritance. She will not only not be punished for murder, she will get rewarded with what she wanted from the murder.

When I watch these true crime stories, I am amazed at the wild swings in terms of sentencing for murder, 1 state the same charge is 20 years another state it’s 5 years. Incredible

Sure they feared him, after taking care of things for years, watching his mom get manipulated by his sister and niece, and watching his inheritance treated like an atm, he was pissed. He was trying to save what was left by way of the grant deed, but they were so very much against that, you can hear the attitude in his sisters voice. She knew she could get more money from the whole deal the way things were. After all the loans ,lowering the value, mom passes away, Sister gets away with all the loan money and half of whats left of value. If he wasn't killed, my guess is that they would have constantly tried to get him out of the whole estate/ inheritance another way.

Based off the home video and the interviews, if she didn’t murder him then she or her mother or even both would’ve murdered him eventually; the moment realization hits that they would either lose the inheritance or their plan of making him miserable, making things miserable for him, wasn’t working they would’ve went straight to murder. Their interviews are creepy as hell; 6 years and they get to keep what he was murder over is a joke.

I have three half siblings, and my biological father (didnt grow up with him or them) inherited a million. two of the three are already vying for this money and hes not dead. They try to turn the family on me. sure I wouldnt mind some cash but I have no cares for this at all. Kinda sick to watch. Heck our dad is still alive anyway. Its nuts.

It's certainly naive to assert this as their closing chapter, presuming no further twists and turns in their tale. In my experience, particularly with such eccentric characters, there's always more beneath the surface. Not 'more' in the sense of positivity necessarily, but rather in terms of intrigue and entertainment.

Exactly, I pointed that out in commments earlier, cause I've been in situations where I WAS actually afraid of some people ( 1 person at a time but a few different situations) and NO you don't go close to the door when actually in fear for your life because you know bullets can go through wood and metal....and you certainly don't fling the door wide open and start screaming at the one you're afraid of IF you're REALLY afrid of someone who has truly been aggressive with you in the past....when you WERE perfectly safe inside a locked house and 2 rooms awy in the kitchen right before you saw the person (that you claim you were so afraid of) walking to the fron door ...in a non aggressive way with NO weapon in his hands....They lied so much .... Oh AND WHO is the moron who thought that recording would exonerate her? That lawyer should NEVER practice law ever again, right? Lol.

I say, always believe the third sibling. He testified that Shane was peaceful and kind. I believe that Shane was infuriated, but he had a right to be! That horrendous Kelly was bleeding his inheritance dry with her greed. This was a set up, an ambush. Greedy Kelly manipulated her bizarre, unstable daughter into murdering the man standing in the way of her getting everything she wanted. This is so similar to something that my family went through (minus the murder part 😅). My mother, brother, and I were caretakers for my grandmother after my grandfather died, but my uncle manipulated my grandmother (who I believe was in the beginning stages of Alzheimer’s) into signing over her power of attorney to him. We were all kicked out of her home and then my uncle put my grandmother into a rest home. My mother (the eldest and previously the executor of the will) got exactly zero dollars of her inheritance and lives in a slummy apartment while my uncle lives in my grandmother’s house. Crazy what people will do for money, even to their own family.

Ugh. So glad my sisters and I aren’t like that. My mothers sisters kids are like that. After she died, all three of her children, on separate occasions, tried to have my uncle sign everything over to them behind their siblings back. I still think my cousin that ended up with the lions share forged his signature. Their mother was like that too. My mom and her sister were night and day. My moms will has remained the same, only updated when my dad died. Everything is split evenly between my sisters and I and my brothers children get the share that would have gone to him. Sadly, he is no longer with us. Should I or one of my sisters pass before my mom, our share would go to our kids. Not like she has a huge estate or anything. I honestly have everything I want already. I’m a simple woman. She gave me the quilt her aunt made her already. That’s really all I wanted.

Sounds like he was taking care of your grandmother more than anyone else until she got to the point he couldn’t do it. It’s best for her to be with people who can care for her - she couldn’t have stayed in that house alone and tbh it sounds like your family just wants to take the property and sell it for themselves.

Real interesting case. I think she got off lightly and definitely the mother had an overwhelming control/effect over her daughter to the extent I believe Tucker thought she could do anything and her mother would look after her..... oh dear, a hard way to grow up and learn about life and sad it ended in a death. RIP Dude.

Interesting that the detective was Tony Young. I’m pretty sure he is the Stepfather to Kyron Horman who disappeared from Portland OR in 2008ish. The stepmom is who everyone suspects.

The mother clearly had her little part in this and should be doing time as well-however, the daughter only getting 6 years as the gunman is a joke. Greed at its core. That was her fricken uncle. Family means nothing to these sick people. The fact the mother stood over her brother as he lay dying and said “just die already”, is disgusting. Gross, talentless hacks who value money over blood.

Thanks for posting this interesting case. Six years seems like a very light sentence for the crime under these circumstances, and I'm surprised the prosecution didn't try to negotiate a longer sentence or charge her with second degree murder. With credit for good behaviour, she should be out of prison in only a few more years, with enough time left in her acting career to make a sequel to "From the Dark".

I mean someone said the uncle wanted to kill them. But idk. It seems like the mom convinced her daughter to kill her brother. That’s legit how I see it. Her mom clearly made her think her uncle was evil and needed to be killed. The mom needs to be looked at more.
