Today I am speaking with retired Master Sergeant John Keene, who is the NFA specialist for the Morphy's. Specifically, we are discussing the terminology and categories of legal machine guns in the United States. From the very common misconception of a "Class III License" (which does not exist), to the variety of terms like pre-May, post-May, pre-86, post-86, transferrable, defat, deactivated, and so forth - what do they all mean? Who can buy a machine gun, and what is the legal process for doing so? It's a complicated topic, and hopefully this discussion will make things clearer!

In my country we have something called "logopedia". The fact there is no dedicaded word for this in english is a good indicator showing what Anglosphere is thinking about this... Btw. you sholud try to watch the interview (on forgotten weapons channel) with the guy from this museum in Leed's. I think hat guy had all speech defects you can get... Topic was interesting, but it was just unwatchable!

How about figuring out why (a very small amount) of children feel their only option is to kill other kids. Ban guns= next generation learns how to build bombs= nothing is fixed.

@@caffeinatedinsanity2324: there were many triggers that should have started the process to stop Cruz. However, from the president at the time, to the governor of the state, to the County administration officials, to the county educational management. to the school, to the sheriff to the actual deputy could have, would have stopped his actions. However, in some peoples view such as those named above laws don't apply to them. In fact, if you're not informed (as many in the US and almost everybody in the world that relies on CNN and the establishment media) there are multiple court actions against many of those above. Additionally, from the president to the governor, to the sheriff, they have either term limited, been thrown out of office or removed by state actions. However, the left will never admit they made a mistake, because in a real sense, the actions of Cruz were not a failure of the system, or at least THEIR system, it was a success, if only those 2nd Amendment would just shut up.

The kid was reported to the local police multiple times as making threats, they did nothing. The FBI was notified at least twice that he was threatening to shoot up a school, they did nothing. On the day it happened he got out of a car and was seen on camera walking toward the school, Another school employee saw him and did nothing but report that he was walking toward the school. An on duty sheriff was at the school and did nothing. What could have stopped him? Arming the teachers could have as he would have been faced with knowing that they were armed, that alone has stopped many crimes. Having resource officers who actually do their job could have.

The full-auto legislation prevents the number one purpose of the 2nd amendment, which is for the purposes of a militia. And no, the national guard is NOT a militia.

Harry King restricting a law abiding citizen of guns wont save a school. The types of gun a good person owns makes no difference. A bad person cant have them either way. Good people wont do bad things no matter how scary their gun is. School shootings are illegal. You think making more things illegal will stop them? If you do then you should seek immediate help. The columbine shooting was carried out with a tec-9. A gun that was mentioned by name in a gun ban at the time. Making something double illegal wont stop criminals from doing it.

@Josh Jones the burden of proof lies with the accuser if you demand evidence without providing an opposing source your argument is invalid, cite any sources that state that countries with strict gun regulation have less domestic and international terrorist incidents. Heres the problem, none exist. Places with strict gun regulations are the targets of terrorists and criminals because the citizens cannot defend their homeland.

Today I Learned the ATF still sometimes approves Form 1 MGs for non-SOTs... Still ridiculous you have to pay another $200 to reactivate an already registered and transferred MG, just because it was deactivated at some point.

Had a buddy who used to work on the police force with me back in the late 70's. Long after he pulled the pin he called me, and knowing I would pass the farm he now lived on, asked me to stop by when I passed through. So it was, one afternoon in the early fall of 1980, I drove down the old cowpath of a road through a pasture, through a couple of gates to the mobile home that he had set up on the few acres he had purchased from an old farmer. My wife was a friend of his from our mutual time on the PD, so they went to the kitchen for coffee, while we took our coffee back to his "gun room" he always had one of those as he was really into guns. Well he showed me the ar-15 auto sears that he built on a small milling machine he had purchased for just that purpose, and we went out back to fire some full auto AR's, then he opened a rifle hard case he had brought along out, and pulled out an old WWII German machine gun in 8mm Kurtz. He had built up loads, and purchased the loading dies for the caliber, so we could fire off a few rounds each keeping some cow pies airborne for a bit, it was great fun. I asked where he had found the machine gun, he said he got it off the reservation, as his land was deeded land on the Cheyenne River Sioux Reservation. You see, the Sioux are a warring tribe, always have been, always will be. To that means, most of the young men do their 3 years in the military. Back in WWII this was still the case, and the reservation is the home to probably more illegal machine guns then any other area of the USA. Well it was back in the 80's and I have yet to hear of a crack down by the BATF. Sadly all his guns were lost in a terrible fire that swept through his mobile home a couple of years later, he has since given up on survival-ism and the gun trade, and now makes his living as a black smith. A man of many talents.

Bror Kriger I’m definitely torn about these ludicrous licensing conditions. I don’t want douche bags and criminals to get machine guns for obvious reasons. This stupid process slows of prevents this. However a couple good ol’boys on the farm having some laughs should still be able to buy a machine gun and have some giggles and blow up pumpkins and soda cans. In any case the government is obviously incompetent and a gun advocacy business should be established for these things with a modest fee associated with such transactions to my mind. For me they shouldn’t be easily available, but I’m a dirty pig in the middle between both sides of this issue. It is to my mind a shame people who want machine guns must have $10,000 or more just to enter the full auto game.

Also, I am not the least interested in select fire guns as I had a butt load in the army and never found any legitimate use other then fun and giggles other then mounted guns. That being said, assuming no crime is suspected, go nuts for all I care and shoot away all your money, I may join you occasionally because it’s fun.

The militia of the day were the people. No one issued out weapons to the volunteers that were called up to fight for the independence of the country. The military arsenals alone were not able to protect the country from Indians, foreign entities, or false claims on territory or trade rights. The second amendment is there to keep the people of this country armed.

Correction Needed. 01 (dealer) SOT's require a love letter for ANY post sample gun. Only manufacturers (07) and importers (08) can buy out of business NFA posts' without CLEO letter. 27 CFR 479.105

When you reactivate a dewat do you have to engrave your trust name etc into the receiver? On the new form does it transfer with you or your trust as the manufacturer?

Here in Spain you can buy any deactivated firearm if, you're an adult; that means that you must be at least 18yo. The ARs use to have three holes on the downside of the barrel near the chamber or straight into the chamber sometimes and have a welded, filed or removed firing ping, but you don't need any license or anything; just send or show a copy of your ID to the dealer and that's all.

Would be interesting to hear what’s involved in becoming registered as an FFL SOT dealer or manufacturer. I assume if it was easy, everyone would be doing it. As always, a pleasure listening to Mr Keene.

Matt Hayward a lot of people have tried and gotten into various amounts of Trouble trying to get FFL SOTs for the purpose of just acquiring pre and post sample MGs. Aside from paying taxes on these licenses every year the ATF expects you to actually be “in business”. Storefront. Advertising. Sales. Almost like getting a liquor license. You also run into local zoning business laws (you can’t just run it out your garage). Now some FFLs are grandfathered in as home businesses (kitchen top FFLs)

I know if FL , you must have a store front/ active legit business of sale. I stoped reading after that as I do not live in a place that I would feel comfortable owning a gun store.

So how does it work if you have two private citizens who want to transfer a gun in the same state, do you have to use a dealer since once the paper work comes through the original owner now has a machine gun registered to someone else, or is there an exemption for that?

Ian, I have a question. An individual that I know has access to a transferable vet bring back MP 40 that the legal heir does not want anything to do with, And the heir refuses to assist with the transference of tax stamp registration. Are there any options to legally transfer the tax stamp on this gun without the assistance of the legal heir?

Master Sargent Keene, You keep saying it would require a master level class to understand. Why don’t you and morphy auction house make one and put it on the web? Break it down to manageable classes. For example, I’m interested in buying that batch of JC Higgens shotguns and and twenty twos. I’m tired of going to my ffl dealer to the paperwork every freaking time. I think there’s a collector’s ffl but I don’t know what to do (not that the atf would do anything to make that process more difficult or maybe we do need 12,000 plus pages of regulation to define what is a lever action gun and what isn’t. Just a question, do anyone out know what makes up a lever action?) I’d, as cheap as I am, to fork over a little cash for that info.

The real shame of all this is the WWII bring back trophy MGs that didnt get registered in the amnisty. There are still a bunch out there that can NEVER be legally owned. Ive heard (years ago) of an MG34 on anti aircraft mount with all accessories in an old ladies attic. Her husband never registered it. Another was an STG44 that hung behind a bar in up state NY for years. One day it was gone. The old man passed and the son took it down and turned it in. It was never registered. Lots of vets did NOT eant government in their business even nack then

Unfortunately in MA you need a state machinegun license which is just a cash grab. They make you basically go through the pistol permit process twice, in addition you need 2 separate alarms 1 for the house and a second on the room/vault that the firearm is stored in.

The Machine Gun License is a may-issue card which individual licensing authority impose additional requirements for. Although, many do issue them to C&R FFLs so not impossible.

There were two, annoying, ads on it in the UK. In the UK, you even get ads on China Uncensored occasionally, mostly from Japanese companies and tourist boards. For some reason, the ads with Forgotten Weapons are usually to do with computer games, which I stopped playing in about 1983. If you are seriously interested in firearms, there are few things more maddening than game adverts, which may be why KZbin does it.

I am a former FFL 07/02 and I would like to extrapolate on John's explanation on relinquishing post samples. When an FFL/SOT decides to surrender their license, the BATF gives a window of time that post samples MG's need to either be sold, destroyed or otherwise transferred. If you decide to transfer/ sell them to another FFL/SOT, THEY MUST BE AN SOT CLASS 2. IF they are not (such as Class 3), they must still obtain a letter of demonstration. NFA items are a rather convoluted system with many strange caveats.

@@Andyhoots The law latter does not apply if the transferee is am FFL 07/02 or an FFL 08/01, FFL 11/01. Class 3 SOT's must still obtain a Law Letter, thus there is no point in Class 03's pursuing "No Law Letter" Dealer Samples as obtaining and approving such a letter is not an expeditious process. Say for example an FFL 07/02 constructs a select fire UZI. They file a Form 2 and the ATF approves the manufacture of a Post Sample that is tied to the personal registry of that licensee. If said licensee wants to sell or transfer it to another FFL 07/02 ( outside of the scope of business closure) then the receiving FFL 07/02 must obtain a law letter with their Form 3 (Tax Exempt Transfer).

@@slan thanks for the info. I recently spoke with an 07/02 who has been an sot for only 2 years. He said he bought a registered post sample from another 07/02 who built the post sample. without a law letter of any sort. The 07/02 he purchased from was renewing his sot. (When I mentioned if he had a law letter he said he had no clue what a law letter was). I was wondering how this was possible. Because from all my reading. It wasn’t possible to acquire without in that instance.

These unconstitutional laws should never have existed and all put in law illegally. The shadiest one has to be the Hughes Amendment. Small correction, if an FFL/SOT is giving up his licenses and thus his post-86 machine guns they can only sell them to manufacturers or importers without a law letter. An FFL/SOT dealer still needs to get a law letter.

I have seen on Gunbroker a STEN Mk V listed as Post 86 Dealer Sample with the requirement for a LE Demo Letter to Transfer. It would be highly questionable for a law enforcement organization to sign a demo letter for a STEN. Why would a WWII STEN be a Post 86 Dealer Sample?

A licensed manufacturer can make a full auto Sten, but they can only transfer it to someone with a demo letter. They would make it (presumably) because Sten parts kits are cheap and they wanted to have it to shoot.

Yes, sort of. Any machine gun that exists has to be on the registry, there is a separate section for deactivated weapons.

It would be transferable only if it was already on the registry *before* being deactivated, usually. Machine guns have to be on the registry to be sold to civilians, though C & R has different exceptions. There is another video on the buying or finding a machine gun.

Ian/John, what is the deal with modern imports where the entirety of the gun is old enough to qualify for c&r? Not just machine guns, but like older select fire battle rifles neutered for civilian consumption? It’s kinda goofy that things like hk91 and clones, even though the receivers are relatively new and made in US bc of import, but are functionally identical to the rifle as made in 1964. All these laws are ridiculous as firearms have not really gotten any more complex since 1970.

There’s literally nothing stopping anyone who knows anything about firearms mechanics from making machine guns except the law, same with Short barreled rifles, shotguns, etc. you can make an AK Or AR a machine gun (according to what the ATF says at least) with a Wire coat hanger. And in an AR-15s case by drilling a 1/8th hole in a certain spot, yes just a small hole will land you with a felony charge. Rifles are rarely used in crimes in general anyways and I would feel safer if everyone had a Machine gun and was equally armed with body armor. And then I doubt anyone would dare try to break in to someone’s home
