Trespass for Dummies, Part 2 - With Ryan Rampage

Part 2 in our series, Trespass for Dummies, sees Ryan Rampage living up his name as he commits trespass and aggravated trespass, ignores data protection and frankly makes Ace Audits look law-abiding. He is an auditor, though, so it’s OK. After all, who cares about the law when you can just make it up?

Remember. Sec 9 of the 36 PO Act also defines a ‘Private Place’ as: “Private premises” means premises to which the public have access (whether on payment or otherwise) only by permission of the owner, occupier, or lessee of the premises; This is directly above the selective and misused definition of ‘Public Place’ Issue is that when 33 is spouted with such apparent confidence the person to whom it is addressed is ambushed as it is fairly obscure legislation. This unfortunately includes Police Officers. It would be good if they tried it on someone with prior knowledge who could come straight back at them. Would ruin the interaction for them.

One of the things that gets me is when frauditors use the excuse when trespassing at Government establishments such as Police Stations, Job Centers, Fire Stations, etc, is the fact that they use the excuse that they have the right to be there because tax payers money is being used. So, using the same argument, if they are getting their rent paid by the state, anyone would have the right to enter their home

The security guard showed remarkable restraint in dealing with Rampage's gang of objectionable bullies. In light of all the provocation it's hardly surprising that the guard gave him a bit of a shove. I wonder if Rampage will watch your review of his video and maybe take on board your advice. I also hope the security guard gets deserved praise from his bosses. thanks for once again highlighting the actions of these despicable idiots.

CRYan is my favourite frauditor. He is such a self assured complete and utter bubble of spunk. My favourites are when you all but hear his arse drop on camera. The best is some silly footage he put on pre audit days when he rode his bike into some guy fixing his car. He absolutely shat himself. Once you've heard that you can pick it out in his other videos. CRYan is easily capable of holding down a job stacking shelves and he'd make a damn sight more doing that than his absolutely pitiful social media non earnings. Oh this is the Wren uniform one, he was so full of shit on this

Trespassing with the purpose of forcing a security response, is interupting the company and is aggravated trespass. 'Auditing' = aggravated trespass by its very nature

just watched an Absolute Audits video and he was arrested for filming inside a police station. eventually he was given a section 35 public dispersal notice because he was causing distress and alarm to people, driven to the out skirts of town and dropped off. i dont know how long the notice will be in effect. this is the same law used against tommy robinson recently in london. (?) the police already have the tools to use against these auditors but refuse to get their hands dirty......this will only encourage the auditors to keep coming back.

Section 35 won't be usable against auditors generally because the power requires local authorisation. I agree the police have ample powers to deal with this behaviour - they can use aggravated trespass (if the auditor is on private property and refuses to leave), and section 5 public order (especially relevant if the auditor is masked). They can also make use of section 50 powers to take names and addresses and arrest and remove an auditor for breach of the peace.

Something I forgot to mention in the video and really should have done is that Ryan Rampage carries Farb-Gel round with him. I strongly suspect he and maybe one or two of the others threatened the security staff with that but maybe not in a way that would be obvious to the viewer and this may explain why no moves were made to physically remove them. Another thing I noticed is that one of the auditors in the video - the blond one with the rucksack and holding the gimbal - bears a striking resemblance to Marty Blagborough in appearance and mannerisms. I think that may be his younger brother.

Top marks for you to take the time to go through that video and analyse it. The question I would have is since when has a member for the public had a legal right to test out the security of a private company? Only such a thing could be done legally at the request of their management and a contract arranged. Given the fact that they procured clothing with the company logo on it and lied to security in an attempt to access the site , for me would be a deliberate attempt to disrupt the company, way beyond any basic trespass to land in error. Since they appear to have left site after that and re-entered for a second round, they may then be pushing the boundaries of harassment. Given that the security guard seemed to be outnumbered most of the time, I don't think it would have been wise for him to warn about the use of force to remove them. The alarm siren appears to have had a good effect though, hopefully they remember the use of that and other companies pick up on it as well. I noticed that DJ Audits was a naughty boy in yesterday's video and had to take it down and put a different one up. DJE Media looks to have had a few complaints and had to do some re-uploads as well.

You may well be on to something about the testing security thing and harassment. I do mention civil harassment of the company early on and maybe I should have covered that more. I would say that possibly the 'security test' with the uniforms could arguably fall under 'journalistic activity'. There would have to be a public interest, though. Security is the private interest of that company, but since it is a limited company and the security staff are SIA-licensed or working under the umbrella of an SIA authorisation, possible you could argue for a public interest as well on that basis - but it's stretching things. When I first watched the video, I thought like you that the security guard had been left alone and I was going to go in heavy on the company and criticise them for treating him like that, but then I noticed that he did have back-up ready. There is a part of the video where you see them hanging around - it's the bit where he returns to the reception building and you can see more security staff in the background. He is also head of security - he mentions that at some point - and I think he was 'stepping up to the plate' after the first incident. I'm not entirely sure why they were not physically removed. The whole thing was handled very well in the end, but I am aware that Ryan Rampage carries Farb-Gel and I think that automatically makes him dangerous, especially as he is not very bright and may use it unlawfully, and I don't accept it is harmless. I suspect that he (and others amongst the group) may have threatened security with the Farb-Gel, perhaps in a way that would not be obvious to viewers.

As you’ve said auditors generally use language to suit their own purposes. For instance, refusing to leave because the police are on their way doesn’t mean they’re law-abiding. They could wait somewhere where the police could see them but away from the area of confrontation. That’d hardly get them views though would it?

Section 33 was updated in 1972 to include the uniformed IRA. I would say they are agravated trespassing having left, then returned. My grandson runs a supermarket and doesnt employ security staff, he gets more instore staff for his money, but the instore staff are trained in removing undesireables and do so without any comebacks. Wheres the drone then? I thought it was Kevin Waterhouse at Auditing Yorkshire who came up with Section 33 as a get out of jail card for trespassers?

Data protection applies to individuals (sole traders, associations, partnerships) to the same extent as companies or other bodies corporate. Note however that the full rigours of data protection apply only where personal data is being processed for payment or for some other organised purpose, such as the running of a social club or unincorporated charity.

KZbinrs don't fall within that provision, therefore data protection applies to them, regardless of legal formation (whether individual or body corporate).
