Thanks for quoting the Reuters article. They did a good job of pointing out the court claims. What should have been immediate was the chap 11. But it was delayed, basically because of the complexity of the filing. Just my guess. The operatic drama of the courtroom where they take opposite sides of the barbershop with too much shaving cream while they all soak under hot towels will be straight out of bugs bunny. It looks like they tried to navigate a restructuring by themselves, though they would ultimately have to rely on the courts. Business by court proceeding is going to be intolerable, especially if they get their chap. 11 filing tossed out by the court, because the creditors fundamentally disagree and won’t budge. Could be a year until the insolvency question comes up, because of all the claims and counterclaims. My guess would be the insolvency will probably be given the green light if not at the end of this fiscal year, the ens of next fiscal year, whereupon it’ll take a year for that one to get sorted. 🤔 Are you absolutely certain you don’t want to run the company, Adam?

I think what's more likely behind the delay was a struggle over the remaining assets between the noteholder(s) and the Fiskers. Obviously we know who ultimately won that battle as the Fiskers have been MIA for awhile now. But you can be sure that Henrik and Geeta were taking post-it pads and boxes of sharpies home at every opportunity!

Fisker is under administration by the court process. That means they don’t just arbitrarily wind up the company as they have debtor in possession. It will be up to the creditors to argue their case before the judge in bankruptcy court. If they don’t come to an agreement, which can be mandated by the judge, then the company is wound up.

I drove 1900 miles from Reno to Victoria Canada and then to a Orcas Island, WA 2 weeks ago and had no issues with the car. Charge station issues but the car was wonderful. Not sure how many more wonderful trips I’ll be seeing in the future though.

@@rmorales1029 I'm glad you had a trouble free trip, my experience with the Ocean Ultra was not trouble free. The key fob never worked properly, there were constant error messages even with software release 2 parts 1, 2 & 3. The cruise control would kick off if the vehicle hit a rough spot in the road which would cause regen to kick in and the regen would cycle on and off when decelerating if the road was rough. It's a shame that the vehicle had so many software issues as I liked it when it worked.

I wonder if the last software update if they are going to disable features so that the vehicles provide just basic functionality that does not rely on their servers (be able to drive, no telematics, no cloud access, no server based functions, no remote access, no app access, run everything locally, etc) and then discontinue all future updates.

It is interesting that prices of the Ocean have become stable at between $26-30k. That's interesting. I would be in at $17-19k. Even if it became a parts car to support others I think that price makes it a potential purchase. But it would be a weekend and local driver where I can get it towed home under AAA. And, at that price assuming I can get one at that price, I would just insure it for liability. I'm a pretty careful driver but that does not mean that others are not careless. So, I'd have to try to consider my luck and if it's a wreck I lost $17k with perhaps an Ocean I can part out and recover a respectable amount. No idea how to attempt to sell the battery which might make it profitable. I can't see that one buyer targeting these as LYFT or UBER vehicles. The lock outs, etc. makes them a risk and I'm not sure how legal it would be for a Lyft or Uber vehicle to have a cracked windshield and still be able to be used in a lyft or uber business vehicle. Maybe they have the in to sell the batteries at a profit.

The only thing I can think of with the Uber/Lyft plan is their idea is to just run them into the ground as a fleet vehicle, and then 'scrap' them once they're unserviceable. Strip the unserviceable ones to support the rest until they're all unusable, then just scrap the lot. A baffling plan, but that's the only one I an think of, there's little else that would make sense.

It’s actually a little comforting to know that one buyer is going to buy all the remaining vehicles, which sounds like they are going to operate these vehicles or lease them out. With that, these vehicles have to be serviced with aftermarket parts

I think they will lease part and use part to support those that are leased. It’s bad news for owners, really. It makes the Onwer base the current owners only, and makes supporting them potentially less profitable, as American Lease will likely take care of everything in-house. Just my opinion.

@@Aslash304 I suppose they will contract with someone else to reproduce some parts or send a team to reverse engineer the internal workings. Perhaps they plan to buy some of the copyright and patent rights to the vehicle's Intellectual property to maintain them themselves or custom make parts. A big company could potentially afford to go that route, and if they have the IP rights, they could send an engineer to unbrick, develop a new ROM or software update that works with their own servers, or similar, and a for a fleet of rideshare vehicles it could prove cost effective on a whole fleet and add the functions they want and need.

Here’s some thoughts/ questions around software. If a leasing company is willing to buy 4300 cars, what do they know that we don’t? They must have a plan to keep these cars on the road for years. Are they somehow gaining the access to write code? Will they offer software as a service to Fisker customers? Can any smart coding person do the work legally? I would think random programming is probably not allowed by the DOT and all the various safety codes the car/ all cars go through to be deemed street legal?

My opinion is that someone who owns 4300 of them will ask for access to the FAST tool and get it. They will have the buying power to contact the providers of all the services they need and sign up for them independently. And, after that, they can keep a small fleet on the road, and use the rest of the fleet for parts. They can even sell the batteries of damaged or scrapped vehicles because they are operating at scale. It’s a nice plan if the price is right.

I'm mostly worried about software . . . fixing functionality that breaks (which is very pervasive), completing functionality that was promised, and maintaining an over-the-air update capability. Hardware can be copied and fabricated. But software requires very special tools, expertise. Also the ownership rights to that software.

Although your stocks may be technically "worthless," they have value equal to what someone wants to pay for it. You just have to convince a potential buyer that they're getting a good deal. Car dealers do it all the time, e.g. "nitrogen".

As a former FOE owner I have lost about 40k. My trade in gave me 29k. I bought a leftover 23 Volvo C 40 which was discounted 15k. I got another 1000 off. The C40 sticker was 62k. In the face of the problems with software and no support from Fisker, I couldn't hold on. The C40 Twin Recharge has been a gem compared to the Fisker. The Fisker had better range and a California mode roof. Otherwise it was a scam. There is nothing left for the owners. Good luck with your Ocean. I sincerely hope for a miracle.

This fisker fiasco reminds me of the last few yrs and months of Blackberry. The difference being that unlike fisker they were the most sought after and reliable phones on the market at 1 point...but in their final days they just couldn't compete with the innovations taking place with android and ios and their app developers jumping ship to Android and ios... Anyhow, getting back to fisker... I'm curious why their isn't a class action lawsuit against Magna? After all they were the ones who built the Ocean, Henrik just designed it...if nothing else, fisker Inc. Should be the ones suing them for not living up to their high standards of car manufacturing... Has Henrik come out to address the current situation? For a guy who was initially very vocal about the ocean and everything after he's been pretty quiet lately. I'm curious to know what will happen to the other vehicles he introduced like the pear and the pickup truck... obviously, they won't be mass produced now but can he sell the design to an existing manufacturer like Chevy or toyota? Even though fisker Inc. is shutting down, could Henrik try again under a new name? His name is tainted now, so anything with fisker branding would not sell well, or at all. As for the selling of the remaining ocean fleet I doubt any company would want to inherit the headache of practically non existing parts, labor, and customer services...in the end, I would be interested to see who in fact would take it on though.😄

American Lease is going to buy them. For Uber drivers in NYC. Magna wanted to offer a full car with 100% Magna parts. Henrik decided to go super cheap with a bunch of important components, like the door handles and the key fob, etc. so the problems are 100% on Fisker.

Nothing takes more punishment than NYC taxis. The idea that they are going to buy a big fleet of these cars for use as Ubers is as dumb as everything else in this saga. No spare parts for servicing so even a typical NYC fender bender would write the car off. Let alone actual wear and tear. If the world was a fair place Fisker would be forced to put aside some number of those new vehicles for parts. Car manufacturers also would be expected to fund the full term of the warranty from the vehicle sale.

We've been making payments since February. With chase fisker finance. Should we stop those payments since obviously we cannot receive services or future parts by a new manufacturer? We don't mind giving up the car not taking our loss. Not worried about a credit hit. Our credit was immaculate, no personal or business debt, simply just three years left on my home mortgage. Please help us on what to do next. The car is beautiful but the unknowns are too big, we don't feel comfortable to keep making payments

I can’t tell you what to do with your finances. In the event that the repossession takes place as normal, you would first have the car taken. Then you would be sued by Chase for the difference between what you owe and what the car is sold for. If you refuse to pay, then your assets get attached.

Fisker is being traded in an over the counter exchange. They have already been delisted from the NYSE. As long as there’s a company, there will be trading.

American lease Gonna offer about 10-15 k per car. Original Shareholders who didnt get out were or are totally whacked. Penny stock Gamblers have had to buy or sell shares over the counter since delisting 4 or so months ago. Note holders are wacked . Machinery and other forms of production will sell for 10 cents to the doller , so 40 /50 mill at best. Doubt if mr and mrs fisker 80 odd million net worth will be effected. Fisker getting another cent on loan , very much doubt it .

I’m worried NIO is next. Not much more money to lose they are already 96% down from ATH. Rule #1 don’t buy EV stocks. Rule #2 stay well away from China stocks. I can’t think of any Chinese stocks that returned a profit to investors.

Are you going to replace the printed circuit board that makes the water pump stop working and bricks the car? That’s a recall now. It is my opinion that you do more research before you buy a ticking time bomb.
