Not at all, they're guilty of discretion. And your attitude and demeanour will often determine that, if you're a giant ass, if you get out of your vehicle and walk up on police then yeah, you should get a ticket.

back in the 80s a criminals favorite place was a business without a CCTV once the business got one criminals generally would look for the camera and then leave. If they where stupid they'd come back an hour later with face coverage and have forgot to change their clothing. caused an easy match. If smart they'd just shuffle along.

I saw one case where the police actually told an ex-girlfriend of someone's that USED to live in his house, that she could kick down his door and go in and get her stuff that she left. She did just that, then the police FOLLOWED her INTO HIS HOUSE and then tased him when he got out of the shower and told them to get the hell out of his house. MAGICALLY, 3 out of 4 of the body cameras had a malfunction. Do you know how low the probability would be for that to happen?????? The fact that police even thought it was REMOTELY okay to do any of this is shocking.

Power corrupts and they have a financial incentive to give out tickets and run IDs. Even if the officer is lying, the court will assume the officer just made a mistake and not blatantly lie, and the officer will lose nothing as he's getting paid to go to court. The person stopped will have loss time and money defending themselves in court.

Yep had a friend say to a cop who jumped in front of him “OMG I could have killed you!” That was taken as a threat. My friend was doing 70mph (60 zone) and that same cop was killed by a speeder he jumped in front of a year or two later. But he wasn’t the only one who jumped out into traffic. Guess it made them feel tough?

That is why I like how Colorado amended qi, it still isn't perfect though. Officers are required to intervene and report; intervention is slightly based on how bad the situation is. Failure to do so makes any officer involved guilty of a misdemeanor at the minimum.

This is why my kid didn’t become a cop. The teacher in one of her classes told her the blue line was real and thick. If she didn’t back up another cop, even if that cop was blatantly lying, that all of her colleagues would treat her like shit and the higher ups would bully her out. She finished school and got her B. A. in criminology but didn’t go on to the academy. At first I was disappointed and thought the only way to change a f@cked up system was from the inside but with time I’ve seen that she made the right decision. I think the current climate of recording all police interactions is going to make a bigger impact than a lone good cop here and there who doesn’t last long or could get hurt or killed trying to change the system.

He's repeatedly said "I wasnt going to write him a ticket" proving nearly the entire interaction is retaliatory. I guarantee you a judge watching this would drop those charges in a second merely due to the admission that he's angry and retaliating against a civilian.

Officer Sanjay making the "neck cut" motion with his hand close to the beginning of the traffic stop should have told Officer DeDouche that he was in the wrong, but he pushed forward regardless. Dude is a menace and needs to be fired and blacklisted.

Thank goodness Officer Sanjay was there - the initial officer has some serious problems with anger management. He admitted on camera that he was changing to a ticket from a warning merely because he got mad at the driver. He has a massive ego issue and lack of understanding of and respect for civil rights. I’m sure that Officer makes a lot of P.O.P. tickets and arrests.

Cops are allowed to change their mind on whether they give you a warning or a ticket for literally any reason. It’s stupid, but that’s how it is. There is no law or policy requiring officers to stick to their own initial plans about what to do about a traffic violation. It would very difficult to even enforce something like that

A friend of mine got pulled over in Nashville for going 20 over. He has a dashcam and told the officer that his dashcam would show that he wasn't speeding and offered to show it to him. The officer refused. My friend took the footage to court and the judge not only dismissed the ticket, but admonished the officer for not taking my friend up on his offer. He added this to his discussion with the officer: If someone has a dashcam, you have no right to the footage w/o a subpoena.

Meh, that's a very old-fashioned mindset. Cops who are still afraid of cameras and witnesses are either old, or trained by old cops. Modern cops know the whole system is corrupt, so cameras and witnesses mean nothing anymore. Did cameras and witnesses help George Floyd or Bryce Masters or literally ANY of the people we've seen in all of these VIDEOS? 🤨

Unfortunately, video footage doesn't make them 100% accountable because there's still Qualified Immunity. And even if that didn't exist (which it shouldn't), it's the taxpayers who usually foot the bill, not the cop. For cops to really be accountable, they should take out personal professional liability insurance the same as other professions do, and if they exhibit a pattern of behaviour that makes them uninsurable, then they also become unemployable.

My problem with this is the officer knows the primary officer is wrong, and still allowed him to continue with his unlawful demands. If he can tell them they are wrong privately, why can't he tell while it is occuring to prevent further issues?

Unfortunately I think that is where I disagree with the conclusion on this video. While I do no agree with the behavior, because he made the statement “I’m your worst nightmare.” without being explicit that he was referring to a legal and civil lawsuit response, a court would likely rule that gave officer DeBoard the suspicion needed to for the frisk. And that is probably why the cop said he took it as a threat. They’ve been trained to say everything is a threat, that way they have legal cover if things out of hand. Again, I don’t agree with them doing it. Just saying that is how I see it playing out in court. Same with the reason for the stop. Even if his dashcam proves he didn’t cross the lines, it doesn’t prove whether the cop thought it looked like he did and will probably be ruled a valid stop in court. It’s all shady as hell, but just enough fuzzy gray area that you know the courts will side with the cop.

That is how they gaslight to defend their actions. The same way they say that a person asserting their rights is being a “problem” or has “mental issues”. I’ve seen videos of police threatening to have people put on a 72 hour involuntary hold just because he refused to answer questions. Everything cops do is a manipulation to either get you to give up your rights or to protect their own ass.

I have OFTEN said, there should be a MINIMUM IQ requirement in order to become a police officer and ACTUAL EDUCATION acquired (criminal justice, police academy, something more than on the job training) and then PAY THEM MORE. Pay for this level of intelligence and education. In our stupid little small towns (that spit out a lot of stupid people) you can become a deputy and start patroling the roads immediately without going to school for certification up to, I believe, a year. They don't know the law, they lack common sense and they've been known to have arrest records themselves! MINIMUM IQ REQUIREMENT--at least then we would know a total idiot with a gun and power hasn't pulled us over!

I live near this town and know many officers in that town. It's the external transfers I've heard that do this stuff. I showed my friend who's in the PD this video and he said "yeah, a lot of people do not like that guy in the department."

I'd guess that more than 90% of officers believe that they can frisk anyone they have detained. In all the videos I have seen, no officer has acknowledged that they need a reasonable belief that the person is armed and dangerous. This needs to change.

@johnhiggs325 What's sad is that, in all of the videos of auditors being frisked, I don't think I have ever seen the auditor say, "Do you believe I am armed and dangerous?" It's always, "I do not consent to a search!" Then the officer deflects by saying "I'm not searching you; I'm frisking you for weapons for my safety," and then no pushback.

I tried to look up the number of officers killed, but the numbers are muddled. “In the line of duty” includes, car accidents & many lists include off duty and self deletion. So just taking the “line of duty” it’s 100/year. As opposed to the over 1000/year taken out by police officers. But how the hell is Covid included in on duty deaths?

I know it’s a cliche to say it at this point but it really is a shame everything people had to deal with before body cam or cell phone cams and all the innocent people who got in trouble or rights violated. Like that one cop who was planting drugs on people and finally got caught by his body cam. Without that who knows if he’d ever be caught. Even now they still act like this while being filmed. Sovereign immunity is necessary for the government to function. Qualified immunity is simply an expression of the principle that we are allowed to assume that our actions are legal. The problem with the current interpretation of QI is an overly-strict definition of "precedent setting."

It's a complete overreaching of judges ..... ultimately protecting themselves. Interesting enough it doesn't apply to doctors and other non government professions. It's the exact opposite of " ignorance of the law excuses not " Being able to declare a lawsuit frivolous should be enough protection.

Grade of “C” for the second officer is ridiculous. Walking the line of calling out bad behavior by other officers and not alienating oneself and getting yourself blackballed for not being “part of the team” is a fine line. He handled about as well as you could’ve handled it. Easy to say that he should’ve done this or that… but we aren’t talking about a guy getting choked out or a knee being pressed down on someone’s chest. Any officer would have real fear of losing their job for calling out this behavior in a forceful manner while being recorded.

Fully agree. Additionally, I wouldn't grant the citizen a grade of A. From a legal stand point he didn't do anything wrong, but he depicted a rather hostile attitude from the beginning of the stop. I think keeping your calm, staying friendly and still being assertive about your rights is the way to go. I doubt it would've helped with this cop, but would certainly lead to a better encounter in other traffic stops.

Writing a ticket in retaliatory fashion implies the guy didn’t break a law, he was going to use his discretion to ignore the ticket (as is his right as a cop) and since the guy was such an idiot and made it a whole thing, he decided to write the ticket anyway. You guys have brain damage, learn what these words mean so you don’t end up with a 500 dollar ticket for obstruction while looking dumb to anyone with an education.

This is something you rarely see, a cop correcting another cop. He was low-key about it, but he deserves the credit for speaking up.

And he will be written up for it. Remember the situation where a guy flipped off the cop in the driveway, so the cop radioed in that the guy threatened him and ran off? Okay, cop #2 came in guns drawn, but he was running on false information. But once he figured out what the truth was he apologized. Cop #1 was cleared, cop #2 was fired. Why was cop #2 fired? Officially for “coming in hot” but again, he was responding to a lie. He thought there was an armed guy running around threatening cops. Personally I think he was fired for telling #1 that the finger isn’t a threat, and for apologizing to a peasant.

@madtabby66 I agree. I've seen instances where a cop was fired for correcting another cop. It violates the unwritten code of silence that says never snitch on a fellow cop and never correct them. They act like gang members. But now there are cases of cops being prosecuted for not doing the right thing and intervening in cases where a fellow cop is hurting someone. They can't win.

The officer actually created any perceived “threats” to officer safety by ordering the driver out of the vehicle and ordering him to stand in front of his vehicle. You don’t get to have it both ways by bringing a “threat” closer to you and then have to “control” the threat. For “officer safety”, it was safer to leave him in the vehicle.

The officer didn’t order him out of the vehicle. He jumped out of his truck and was walking toward the officer.

Legally incorrect. An LEO has the right to order the driver out of the vehicle for no reason at all, and then is allowed to tell the occupants where to stand, etc. to ensure the safety of the officer. That is why felony suspects often end up spread-eagled on the ground.

Starting to think every stop and encounter with an officer in this great nation should have an auditor present to witness the interaction.

The more you taint/bruise or even challenge a cop’s ego … the more he/she will likely retaliate and go out of his/her way to violate your rights. That can often lead to lawsuits for which unfortunately, are paid out by taxpayers.
