Leyton Marker It's sad that you think you don't own the cops, and cant tell them what to do. If I walked in your house and told you "lay down and put your hands behind your back" you would tell me to get out of your house, but if a cop does it its ok? No, cops are people too, and have to follow the same rules as everyone else. Cops are not allowed to stop you and ask for ID, or search you, or detain you unless they have reason to believe you are breaking the law, and even if they have reason to believe you are breaking the law in your house, they need a warrant before they can just walk in. The issue here is anyone can buy a charger or crown vic or what ever vehicle they are using in the area, put some blue and red lights in the windows and pull people over on a back road, rape, rob, and/or murder them and drive away. The police shouldn't be allowed to drive unmarked vehicles, it opens up an avenue for criminals to get alone with people in areas where they would otherwise never be.

Love that you are standing up to cops when they are being unlawful and dangerous to the living which is nearly 100% of the time. But not a fan of you over sensitizing the headings. He didn't run away and wasn't fleeing but yes, is, as you say, completely disrespecting what you are doing. They don't see you or anyone standing for natural rights as a threat. Blessing to you, Gavin, as you are one great man! You are more moral and strong in honor and truth than most. They don't have the same standards of truth, honor, freedom, integrity and peace that you and I have. Happy to speak to you Gavin if you have a USA cell number. Realize you're in Mexico now due to the cruel intimidation and bad behavior of the so-called leos. Too bad they are not trained as peace officers anymore.

I’m pretty sure the law states that “This section shall not apply to vehicles of a sheriff's office, local police department, or any vehicles used by local peace officers under public authority for special undercover or confidential investigative purposes.” This unmarked car operated by WSP is part of an aggressive driving apprehension team or ‘ADAT’ which could fall under the argument of special undercover purposes. And isn’t interfering with a Traffic stop conducted by a peace officer crime In the state?
@GavinSeim

Lol, traffic never qualifies as undercover investigate work. The whol epoint of the law is to prevent regular police from going unmarked.

Gavin, I'm here in Texas! I love your videos! I was going over RCW § 46.08.065(and any other relevant statute) and I think you're taking the unmarked vehicles the wrong way. There is not civil or criminal penalty for driving an unmarked police vehicle, and though illegal to use, the only way to enforce this is the Head of a Police Department starting to mark the vehicles. What you need to understand is that if you're stopped by an officer in an unmarked vehicle, the penalty for the the police is that if you motion to suppress, it was be granted. That's the penalty, any evidence that the police get being in an unmarked vehicle is seized illegal according to RCW statutory and case law.

Gavin you still haven't learned. Until you change your attitude you will never be the so called patriot you think you are. How can you expect police to talk to you when all you do is make demands. You are never polite. I always see you talking at people and not to them. Even the police that are polite to you. All you do is preach to everyone. Anyone can read the Constitution and recite it like you do over and over again. It doesn't mean you know what you are saying. The police look at you as an annoyance. They will never respect you because you don't respect them. Believe it or not there are police and government officials who want to help this country, but you think you are the only one who can save it. Until you get over your God complex you will just continue to be an annoyance.

***** thanks for your opinion, and I agree except the method, get him into an intelligent conversation, point out the facts, when a person comes into the realization they are getting taken advantage of, then you have changed them forever. They have been programmed to this system and their master has told them what to do. That police officer is most likely supporting a family and home on what little they pay him and believing he's doing something good. Shoving a camera into his face and harassing him while he's trying to do his job is counterproductive. Instead get his name, invite him for coffee, sit down with him at the subway and enlighten him,

+A Legend your an idiot, if you got pulled over by a completely unmarked car and then when the 'officer' walks up to your window you realise its just someone impersonating a cop and they actually pulled you over to rob you or kill you or rape you. The reason Gavin does this to cops in his area is to avoid that situation. Why can't cops pull people over in a car that has in big writing on the side "POLICE" so then you know your getting stopped by the police. If i see a random car pull up behind me and i cant see its a police car why should i pull over for it for all i know its just someone who wants to rob me and is driving a car that police use. I dont think it is unreasonable for cops to have to display lettering and signage on their vehicles so they can be distinguished from criminals, but for some stupid reason you do.

did you know that a US law passed a while ago that if you are pulled over by an unmarked police car you have the right to drive to a safe location then pull over. I found out about this law when a friend of mine was pulled over by a fake cop. luckily she had her Pitt bull with her. about 6 mouths later I was pulled over by an unmarked car. I was scared to pull over. I was in the middle of BFE 26 miles from the nearest town. I had no cell phone service. so I turned on my hazard light and continued to drive till I reached town and a gas station. the officer should know that if you have your hazard lights on you are signaling to them that you know there behind you. by us law you can drive to a safe location like a gas station or supermarket. any public area to pull over you don't have pull over if there are no other people around.

So these cops go out and write tickets to people for breaking the law when they themselves are breaking the law by using these unmarked cars. More interestingly, even when cops use proper police vehicles, they *still* break the laws nearly every time they get behind the wheel by exceeding the speed limit, failure to come to a complete stop at a stop sign, failure to give turn signals, etc, etc), yet they'll pull you over and issue a citation for the very things they do every day . . . and cops wonder why people don't respect THEM?

I went 30 years without a ticket. Moved to Oklahoma and I recieved 2 welcome to Bartlesville from an in marked car. I find myself now very paranoid when I see cars like this. I got a ticket for no proof of insurance, took them the card next day and ticket was dropped. My other ticket was no seatbelt, not making excuses, but I had major surgery 2 weeks before and the belt would sit right in my incision ( I had nobody else to drive for me) Paid that ticket, too weak to go to court and fight it.

Keep it up, I can't wait for the sheriff to stand up for the citizens he serves, it has been a month since you talked to him and this issue has not been properly addressed. I can see why you are becoming more and more frustrated with these government officials, I am only 14, but you have inspired me to help in some way in my own county. Love from Florida.

Gavin Seim it's not illegal for police officers to drive unmarked cars while on duty. Here is the correct and exact wording of the ACTUAL law from the Washington State Legislature: "This section shall not apply to vehicles of a sheriff's office, local police department, or any vehicles used by local peace officers under public authority for SPECIAL UNDERCOVER OR CONFIDENTIAL INVESTIGATIVE PURPOSES." Link to the actual law from the Washington State Legislature: app.leg.wa.gov/rcw/default.aspx?cite=46.08.065 Relying on repealed laws from the 1930's is irrelevant. Here is an excerpt from a Law Firm that tackles this very question. I'd like to draw your attention to this quote: 'RCW 46.08.065 certainly does require that state-owned vehicles be conspicuously marked as part of the State Motor Pool or as a publically-owned vehicle, and subsection 3 of that law provides for an exemption to the Washington State Patrol. This exemption allows the WSP to be relieved from marking any vehicles when it is being used for "general undercover or confidential investigative purposes" or for traffic control purposes.' Source: www.lustick.com/blog/18-legal-question-unmarked-patrol-cars0242.html So according to the answer given by those FULLY LICENSED attorneys who are EXPERTS in that area of law in the state of Washington, 'This exemption allows the WSP to be relieved from marking any vehicles when it is being used for "general undercover or confidential investigative purposes" or for traffic control purposes.' The officer in the video was an undercover cop using his car for traffic control purposes. He is exempt from the law, his car is 100% legal and he is doing nothing wrong.

Ash F. Correct, there lays what we have today. The legal battle still remains that according to proper english what they are saying in that line is that "This section shall not apply to vehicles of: 1- A sheriff's office for special undercover or confidential investigative purposes. 2- Local police departments for special undercover or confidential investigative purposes. 3- any vehicles used by local peace officers under public authority for special undercover or confidential investigative purposes. The "for special undercover or confidential investigative purposes." is not a separate situation, but rather a single situation in which all of the other categories must fall under to be except from this law. Again, I 100 percent understand why you would read it like you did because in fact, that is how the department saw it too and their argument in court that they ended up losing. The issue now is the fact they are still debating certain wordings such as: "(3) Subsection (2) of this section shall not apply to vehicles used by the Washington state patrol for general undercover or confidential investigative purposes. Traffic control vehicles of the Washington state patrol may be exempted from the requirements of subsection (2) of this section at the discretion of the chief of the Washington state patrol." Note the last part. "Traffic control vehicles of the Washington State patrol may be exempted". This is currently where the debate sits as they argue what is actually defined as a "Traffic Control Vehicle".

Ash F. Now before you get ahead of things, this is the argument currently being fought. That "Traffic Control Vehicles" are described as: "WAC 204-65-050 Traffic control vehicles. Vehicles that are publicly or privately owned and used in conjunction with officially sanctioned or sponsored motor vehicle traffic control or movement may display lighted, digital or electrically powered signs to assist in the efficient control of traffic movement on public roadways. Such signs shall be designed, worded and directed so as to limit misinterpretation and confusion by the motoring public." The Licensed lawyers that you speak of argue this side too saying it is in reference to your tow trucks, or construction vehicles, and basically anything driving down the road with a yellow light on it, not a police car.

Kyle Raymer Exactly. There's a difference between "traffic control" and "traffic patrol". I hope this future law student doesn't think so one-sidedly when he graduates. It wouldn't be a debate if there was a clear answer.

Funny, When I just started working at a gas station. An off duty cop comes in and buys a few cans of chewing tobacco and a pack of Mike's Hard Lemonade. I ask em for his I.D. and he laughs and shows me his police badge. I laughed and said that's not a valid I.D. and stared at him refusing to ring it up till he showed me his I.D. And just for the hell of it I scanned it. Seems to me they think they are "the law" if they show a badge as a form of I.D.

If these vehicles are not properly marked, then you do not have to stop for them. Further, the failure to stop cannot be used to charge the party with eluding. There are cases that state this unambiguously: State v. Ritts 973 P. 2d 493, 94 Wash. App. 784 - Wash: Court of Appeals, 3rd Div …, 1999 State v. Trowbridge 742 P. 2d 1254, 49 Wash. App. 360 - Wash: Court of Appeals, 1st …, 1987 State v. Argueta 27 P. 3d 242, 107 Wash. App. 532, 107 … - Wash: Court of …, 2001 State v. Refuerzo 7 P. 3d 847, 102 Wash. your argument is that it's unfair for them to not have a marked car via a sticker or number plate. if someone was going to buy all the fake lights and a recent model car to impersonate a police officer, don't you think they'd get a fake sticker or fake a number plate? it's common sense.
