@rhiannonrose4841 I agree the judge is taking this approach on purpose and not due to weakness. Her own frustration isn't important, getting the trial right and minimizing appeals is. Jury doesn't need to be in the room to picture the scene and imagine that whine. They absolutely notice the judge is forcing herself to speak calmly and quietly, with forced patience. She knows full well that the defense isn't helping herself. I don't think she's directly driven by hopes of hurting the defense's career but she's certainly letting her keep her shovel.

Court proceedings are supposed to be public. You don't go behind closed doors (in camera, to use the legal phrase) unless it is absolutely necessary. It isn't necessary to go in camera to protect KZbin viewers from a zealous advocate they perceive as "whiny".

I see it differently. It is frustrating to watch but not having control and giving the defense all the rope she needs can look a lot alike. Judge is fully capable of knocking her down and does so when she's let the defense run in circles long enough. Limit grounds for appeal, and she knows how the jury must see all this. They aren't present here, but you just know they're hearing that whiny voice in their heads as they wait impatiently to continue.

Ms. Smith is way over her head with this trial. She’s whining about how much there is to do and how many exhibits there are and she’s all by herself. It’s called trial and yes it’s a busy time for all. I’m so annoyed by her I’m embarrassed for her. She’s making herself look so dumb. I appreciate the prosecution attorneys and how professional and patient they are as they continually remind Ms. Smith of the dates that she has been in possession of exhibits when she tries to act like something got sprung on her. Before this trial I’ve never seen Ms. Smith before. Is she deliberately trying to look this bad because she knows she going to lose and she wants her client to be able to get a new trial because of ineffective counsel? Seems like a stretch but so does her ability to be a lawyer.

There was plenty of space for her to do that in this case certainly because legally this wasn’t exactly airtight. But how’s she going to do that when she doesn’t even have certain things in court with her. In certain things that are basic even with a guilty client she was just unprepared. Especially if I was innocent I would start looking at my case again.

The judge knows that a sharp Appeals lawyer could review this trial & argue convincingly that Jennifer Crumbley received ineffective counsel because her attorney was deficient. I'm astonished the court & the judge must take all this time to instruct Crumbley's defence attorney about basic established law wrt testimony. Nor can I believe the court & judge are behind the scenes doing the defence attorney's job for her, which the judge admits several times when she mentions she's had her legal staff searching for case law to bolster the defence's argument. When the court's time & energy are repeatedly focussed on the client's attorney rather than the client, that attorney is providing terrible representation.
