Sage advice Cadogan. I recall a friends $85K Jeep that broke a radiator mount first day on a track I could have driven in a Camry. Sorry, you took it off road, not covered by warranty. I showed the dealer the advertising playing on the big screens at the dealership. I asked him to show me one clip where the Jeep was on an actual road, he couldn’t find one. It was repaired under warranty.

Growing up on a farm we used to drive an Austin Cambridge sedan (!) and a Holden ute on rough tracks, through water after rain, and across paddocks. Never a problem. The idea of a modern "lifestyle" 4wd ute rusting out because you parked it near the coast is ludicrous.

@@kadmow You should see the vehicles from the rust belt in the US, where they salt the roads. South Main Auto has videos where rust is just raining down on him while trying to break some suspension part loose. Scariest part is how many of those states have no inspection requirement.

I took Dodge to NSW small claims (although we settled out of court) for a Dodge Journey. Auto gearbox shit itself (clutch plate disintegrated) at year 6. The warranty though was three years. After research with ACCC and NSW Fair trading my argument was that for the price a gearbox should last longer than 6 years. At the time settling out of small court claims was easier but in hindsight, if again, I would take it all the way just to make sure it’s recorded and a legal decision is found.

I like this way of thinking, but it's worth bearing in mind that local courts don't set precedent, so it would have little bearing on future cases. Still nice to see, but personally I wouldn't risk additional costs if an acceptable settlement was on offer.

Ah that reminds me of this crazy work colleague I had. He bought a Great Wall and in less than 3 years the paint had gone to crap. He blamed the factory next to our workplace for ruining the paint on his amazing Great Wall. I guess he didn't notice that many other employees owned cars for longer than him and the paint work was still looking fine after being exposed to this factory for up to 8 years in some cases. Including the company cars which returned to the depot every single day.

Hello John, I used to work for LDV in the U.K. back in 1994, I was a salesman of their shit box vans. Against Transits, Mercedes and Iveco I had no chance - I couldn’t even give the bloody things away. They were so out dated. I lasted only 8 months in the job before I was sacked. Best thing that could have happened as it turned out. I totally agree with your wisdom on not only LDV warranty and the way dealerships rip you off. It’s frightening. Any way, stay safe and well. I immediately think of the latest Nissan X-Trail advertisment which shows proudly how the car can be taken off road. What the add doesn't say is that (to my knowledge) the car doesn't have a full size spare tyre. Imagine having a puncture on a rugged fire trail and then finding that your car has a space saver tyre in the boot. What follows is probable damage to the car as you try and extract yourself from this situation.

The Haval dealer here in town sends his cars to a local window tinting service to have the factory window tinting applied and on one of the vehicles the paint inside the door was so thin as to be translucent and you were able to see the metal underneath it. It's just a Great Wall by a different name.

There was a recent court case in Michigan where an automobile manufacturer disclaimed responsibility for a manufacturing defect in one of its vehicles because it, the manufacturer, was not in fact a "manufacturer" but rather was an "assembler" of car parts. Needless to say the jury was impressed by the subtlety of the argument.

had to buy a new iPhone (approx. $1K). Went to a large store "hello Mr Harvey" as they were having a sale. Whilst buying the phone, salesman says, "do you want to purchase our extended warranty plan?". "What's the warranty from Apple?" I replied. Salesman, "3 years..". "Umm.. no thanks..". If I'm paying over $1K for a phone, barring misuse, I expect it to last at least 3 years.

I was a helicopter mechanic in the navy, any area within 30 miles of the coast was considered to be a “Salt Laden Environment “ and as such we had to do a compressor wash and oil inhibit after the last flight of the day. This of course meant a wash out of the inhibited oil before 1st flight. This was on Seaking helicopters with Rolls Royce Gnome gas turbine engines. It was a pain in the arse but meant we got good service out of the powerplants ⚓️⚓️⚓️⚓️

Hi John, Great advice I used over 10 years ago... It was actually a laptop computer, Lenovo to be precise, that I purchased. My friend had spilt red wine on his keyboard rendering the machine useless. When I was purchasing mine, with that scenario in the back of my mind, I couldn't believe when I saw the Lenovo depicting a cup of coffee being spilt on it and draining away underneath and the laptop uneffected. Purchase made and a few weeks later it ceased to work? I later found out after having it checked where I purchased it from it had coffee spilt on it! It was in fact one of my kids that accidently spilt it and forgot to tell me, yeah! In any case at first it was a case of negligence on my part and bad luck. After getting home, it dawned on me about the advertisement and the brochure I still had that the store printed for me and I had with my receipt. Some banter to Lenovo in Singapore and explaining that I did not use it as a colander to strain my noodles, had them ship me a new unit no questions asked when I forwarded a copy of the receipt and brochure. Be it car, laptop or powered toilet seat if you must, keep those items for prosperity as you said 🙄🤠. Good advice Thanks John

Regardless of the car manufacturer you have to deal with, they will always look for an easy way out of your warranty claim. Car manufacturers need to learn to look after their victims as per the heavy vehicle manufacturer will. A friend of mine is a b-double driver who does Brisbane Sydney for a largish transport company driving a Scandinavian truck which is not yet 12 months old and has 95,000 ks on the clock. Motor in said vehicle went poopies down there and stopped turning and burning. Not only is the dealership replacing the engine under warranty but they are also completely covering all costs, including the on call mechanic, the heavy recovery vehicle, and the motel room for the night. Maybe the difference between car manufacturers and heavy vehicle manufacturers is that with the aforementioned vehicle it's purchase price is just shy of 400 big ones 🤔

Sadly Isuzu Midland/Australia believe this doesnt apply to them, for a brand new D-MAX despite living nowhere near the ocean and only hitting the dunes a handful of times. Perth's general conditions and no heavy 4x4, water-crossings etc constitute "extreme environmental conditions" sadly even consumer affairs isnt able to budge them on this

2 months ago, I bought a car that had a few recalls in past, and one of them is the paintwork, at the time I was not aware of the recalls anyway, I went on the Kia webpage put my vin in to check my vehicle and my vehicle has no recalls however the 2018 yellow stinger if you goggle it says was recalled, my car is or is about to hit 4 years old and the paint is delaminating, the first week I had car bonnet started delaminating 1 month later guard, Kia has authorized car to be fixed . so my problem at the moment is are they just going to patch up the damaged paint or are they going to respray the vehicle as in removing all the old paint? has anyone had issues like this any advice will be greatly appreciated

Depends on the dealer. They could either do it piece meal, so as each panel begins to show a defect they fix it. If it's delaminating, that sounds like it's coming off the body anyway, so it would need to be removed before it could be painted. I expect it depend who is paying for the repair as to the quality and scope of the repair. If it failed after that because of a poor repair, then you might be in a fight with the panel shop. You'd best find a Kia/Hyundai forum where people have been through this experience could advise you.

Here's what I'd like to know; was this decision made by the dealer who did not want to honour the warranty or by LDV Australia or the parent LDV in China? If it were the dealer they had poor if not incompetent legal advice because by any measure the defence offered would fail. If it were LDV Australia the same could be said. In the case of it being LDV China perhaps they don't have the same consumer protection in China so they could be forgiven for not not understanding how our consumer laws work. In the case of either Australian arm of the company it would have been a lot simpler to pay the guy an amount of money, get him to sign an NDA and go away. I'm not a lawyer but the dealer and the brand is now worth mud. If LDV China are trying to build a presence in Australia who ever made this decision has set that endeavour back a long way. Not only that by extension all Chinese brand cars are now tarred with the same brush. When Japanese cars first appeared on our markets they were poor quality and Made in Japan was a derogatory term. That image was only corrected by a determination to quality control and customer service. The same could and was said about Korean cars when they first appeared and the same could be said about Hyundai and Kia's determination to make better cars. If China wishes to succeed in a crowded, fully imported Australian market just being cheap and cheerful won't cut it.

Funny ldv chose Kiama to film the t60 add, shit rusts there very quickly if it's poor quality even good quality stuff will rust if it's not protected

They used to be a UK based shit box van manufacturer. Nice to see the Chinese are keeping the British Leyland quality standards up. Most British Leyland vehicles used to rust out very quickly as the were left out in the rain before they were painted.

If you need brochures and the like to prove that your car is meant to be driven on roads then your Consumer Laws are knackered. It should be relatively simple to prove "not fit for purpose".

I don't know why anyone would even consider a Chinese D90 when the Korean (Ssangyong Rexton) just a tad dearer is a lot better (objectively speaking) option. 7 years warranty and a lot better build quality. Owners love them.

HELP ME JOHN! I recently picked up my 1975 Ke30 Toyota Corolla from my uncle's house after it was sitting there in a paddock without paint on the panels with a tarp over it for near on 10 years. I want to take Toyota to court as after nearly 50 years, 10 of them with without paint, there is surface rust on the panels! Wish those tight-asses at the BIG T were more like LDV with their customer service! :-)

Was wondering if you were still around. Sort of relieved you are. I know this sounds daft, I don't get it, the Eleanor Rigby reference, other than Beetles.
