As a disabled person I just have to pre-empt anyone who accuses her of not being disabled because she readjusts and sits on her knees at several points. The misconception that a person is 'wheelchair bound' and thus cannot stand at all is hilariously out of touch, considering a majority of people who use wheelchairs are ambulatory. Wheelchairs are assistive devices, and in many cases ENABLE people to stand up and walk more than they otherwise would be able to if they had to walk to get places. I haven't read any comments like that yet, but I just wanted to mention it before it happens, because it almost inevitably will.

Statue's and codes are not law. Anything that goes against the constitution is null and void in its' inception. Marbury vs Madison is president. This guy that does this channel knows all kinds of statue's and codes but doesn't know anything about the constitution. There are recourse's under title 42 USC and 1983 deprivation of rights, privileges.. How about a grade of F for being a jack boot for the US CORPORATION you shill.

I hope she wins, the officers are pathetic, you slate her for driving off but I respect her for it, they were clearly board to pester her for this. Look at it for what it is, Police stopping a disabled user of a mobility scooter because they are to mentally weak to investigate real crimes. You can hear how condensing the police are.

Update: First her appeal was accepted, Overturning that felony conviction. For the lawsuit the city settled on her case and She got $400K for this

Great. Her fellow tax payers paid for the abject stupidity of the police officers, as well as the stupid and likely corrupt court that convicted her of driving a mobility device while disabled. Any time a government employee violates someone's rights, the tax payers are always the ones paying the damages.

Audit the audit explained the difference very well! Wheelchairs and what are considered motor assisted scooters are two totally different types of devices. Wheelchairs fall under different types of regulations as they are in actuality considered medical devices. The motor assisted scooters can be prescribed by doctors to get peoples insurance to pay for them or help pay for them but they are not placed under the same classification as a manual or power wheelchair. Your cousin would not have to wear a helmet while using his power wheelchair to get around as his power wheelchair is functioning as his legs. Motor assisted scooters are not functioning as this woman’s legs as she clearly can walk but due to her medical issues walking long-distance is probably painful and she probably would not get very far.

As a chronic pain patient born with congenital hip defects who has had MULTIPLE hip surgeries, 2 herniated discs, scoliosis, multiple sciatica episodes every month, etc, I wish I had been there to help defend this woman! Thank goodness she won her settlement. These tyrants are disgusting.

That is too harsh. Cops have a tough but necessary job what we need is clear laws that everyone understands. Cops need to not abuse their power yes and those that do need to be punished but the same is true of civilians. We need to find a midway point of agreement to secure a safe society.

That was my thinking. I’m unsure of her state’s regulations, but where I live if it’s “street legal” it has to be licensed and tagged. So if she misunderstood the designation of her vehicle, I can see the cops giving a warning and letting her know she had to register it. But the “low speed” chase is bs. They obviously could have stopped her any time they wanted.

She won her appeal and had her conviction thrown out. They ruled that she riding what was basically a motorized wheelchair not a motor vehicle, so those laws she was convicted of don't apply to her in this case. Everyone involved in her prosecution and arrest were chastised by the Court of Appeals for not knowing this. Her lawsuit against them is still pending.

UPDATE: The woman won $300,000 in a lawsuit settlement, AND had her felony conviction for 'fleeing an officer' overturned on the basis that 'fleeing an officer' had to be in a motor vehicle, and her disability scooter was not a motor vehicle subject to the same laws that an automobile or other street-legal device would be.

Budget will never go down because even if they don't reach max they will spend the rest on supplies b4 their fiscal year so they can get the same amount next year. They weren’t messing with her because she was disabled. They did not know she was disabled. She was riding a *two seated* motorized scooter on the sidewalk without a helmet so they stopped her like they would anyone. It wasn’t until they initiated the stop that she stated she was disabled. Which still didn’t justify not wearing a helmet nor immediately going fully verbally abusive prior to her even stating that (let alone in a polite manner). My guess is they would have worked with her but she dehumanized them immediately and they decided to follow the letter of the law like she did. She apparently didn’t conceive of calling an uber or a friend to pick her up before leading them on a pursuit.

"fleeing" is what an arrogant, power humgry bully sees after restricting her only means of getting home and endangering her safety. The law in this case about operating a "scooter" on the sidewalk is contradictory (pedestrian/light vehicle law versus disabled accommodation) and at any rate she was not wearing a helmet. Now personally, I don't think a helmet should be warranted for disabled people, but that is the law in this case. I can fully understand why she is pissed, but verbally abusing the officers is not a good way to express that, and especially get them to be lenient and helpful.

@@david2869 The logic here is as follows. 1: She cannot walk a long distance. 2: She uses a device to assist her in walking long distances. 3: She is not permitted to use the device because she doesn't have a helmet. THEREFORE: She cannot return home unless with assistance. Either they take her home and transport her property (the scooter) to her. As this is the only legal and safe means for her to return home. Or she complies with law, and sits on the ground with her scooter in the road.

No, they weren't clearly. The purpose of reasoning is to make someone understand something that is not immediately clear, to open the mind. I had a friend in Brookings that was a disabled vet who was arrested for DUI and refusing a field sobriety test because he was unable to stand. He couldn't stand because he broke his back in the air force. In the hears I knew him he would only drink Pepsi even while everyone around him was drinking beer. He never drank. That whole county is crooked. You could make a series on just those cops.

What is their fault is that they failed their oath of serving and protecting, trading it off for harassment and profiting. Even if she was breaking the law, it was the middle of the night, freezing cold, and no real danger. Could have offered her a ride back home and they could've had a civil conversation during the ride. Leave her with a warning for the time being if they really believed it was breaking the law.

But she might have been. There are people who just don't give a damn. She is also required to honk before passing pedestrians on the sidewalk, whether needed or not. We could imagine whether she does that. The fact that she wasn't wearing a helmet (which apparently was required in any case although realistically maybe not that important) made the cops suspect she has a tendency towards not caring about the law. - The initial stop was justified.

In Germany they actually have to drive on the street or the bike lane, because they are too big for the sidewalk. So that is not too far fetched. But then again our cities and towns are much better designed for people with disabilities and most others participating in traffic are social enough to drive mindfully around disabled people.

In my town, we still don't... Maintenance is a joke, potholes, fissures every few feet, every few blocks one deep enough to ruin a small car....No consideration for pedestrians often missing sidewalks, no such thing as a bike lane here. Road would destroy your handicap scooter in no time at all. Then, oh gosh. The drivers here come from two countries and 2 states...Nobody knows how to drive, it's actually terrifying because you get people driving like it's india then you got straight maniacs who can't drive. My brother was killed in this town as a motorcycle rider from someone who crossed 4 lanes blind in one go. I've seen people pull out in front of cyclists and motorcyclists. My best friend was on a bike going down a hill, probably 70kph when a SUV pulled out in front of him, sent him flying and he broke several bones. It's actually terrifying, like drivers here don't realize it's not a video game/there are other people/they can do real damage. The driver of the SUV claimed the kid shouldn't have been biking on the road, where there was no sidewalk...home from school...(literally less than 2 blocks from school) That's how many people are here, they can almost kill someone without qualms and still feel like the victim for being cited.

As a disabled person myself, I'm really afraid of being harassed by the police like this. I've had police barge into my home years ago, while they made me watch as they beat my ex husband to a pulp on the floor and threatened me when I attempted to get to my phone. I am always afraid of the police in my city since then, and I know that no matter how much I try to avoid contact with the police, there's nothing I can do about it if I'm in public or on my way to work and I somehow accidentally catch their attention.

Lawyers need to study the law for something like ten years, while officers only need one. Complete bullshit. I did find a source that said three to four years, but if police are going to *enforce* the law, while lawyers are simply going to be the ones talking about it in court, then officers should at the very least learn half of what lawyers know (five years).

The cop was sticking to his stance and so he wanted to demonstrate that it is written so, since she claimed otherwise. That is commendable. And he would likely have showed her if she hadn't claimed she cannot see it anyway AFTER he had basically found the legal text.

Something similar happened to me in Westport, WA in 1999. I was detained by a Police Officer, he took my License, made me follow him to the station, and informed me I was under arrest. After we got to the Station, he had to call a City employee down to the station, and they spent the next TWO HOUURS going over the City Ordinances to figure out WHAT to charge me with. I was finally charged with Soliciting without a License, I went to court, pled guilty, paid a $300.00 fine and a Year Probation. Even the City Prosecutor started out with: "This is a wierd one Your Honor, and we don't quite know how to handle it." TWO Lawyers we met later each said we could have probably sued the City, because the Officer arrested me without stating the charge at the time of the arrest. My wife and I felt it was better to pay the $300, and put it to bed. After the Year Probation ended, the whole thing was "Dismissed". Well, Westport Washington, if the case has been "Dismissed", how about GIVING BACK MY $300.00?!

This is an old video. Although it's always a good time to remind police this is OUR city/state/country, OUR roads, and OUR police station. It is an exercise in futility with the jackbooted peabrains who inherited the force, who wont do the right thing until they are made to, but everyday another citizen wakes up.

It was posted here 1 day ago (Feb 22, 2021), and stated in the video that her two cases, one for appeal and one for the lawsuit against the city were coming up soon (her appeal coming up Feb 25, 2021 and her suit against the city is still pending; a pretrial video conference scheduled for March 2021. If you're referring to the timestamp on the police video, that's good evidence of the slowness of our judicial system...at least when its a citizen making the complaint.

I saw this video going around months ago. 10 months ago, at least, according to cursory KZbin search. By now they've probably got even more stories like this going around. But you are right in every regard. Just saying, they probably wouldn't even remember the specific incident considering how frequent it is they do this kind of thing.

@@Figgy20000 The officers were aware that riding her mobility scooter was her only means of traveling home, in poor weather no less. They could have simply followed her home to make sure she was okay, but instead they decided to escalate it into a pursuit. The lady could have asked...but they should have offered and not been dinks about it.

@@Figgy20000 I didn't see her run from the cops at all. I saw a citizen utilizing their American with disabilities act mobility device going about her way going home. Imagine the alternative. Causing great medical harm to try to appease these police officers. As far as I'm concerned those cops if they had gotten their way would have been attempted murder. not only is she in the right, the cops were so infatuated with state law they failed to take into consideration federal law. As a potential juror, I am not only not seeing a crime but I'm seeing the crime being perpetuated by the police.

@@MotorHorse - At the very least, they could've told her that she couldn't operate the scooter without a helmet and encouraged her to call someone to pick up the scooter and herself, from the beginning. Instead, they prolonged the detention and then blindsided her, almost certainly to cause more problems for her because they didn't like her attitude.

Probably not, but they would have still pulled her over for not wearing a helmet. With a little more justification actually. I have to wonder if wearing a helmet is required on a low speed device that's NOT on the road... I'd examine that section of law again.

She should be demanding that both of those police employees be arrested for armed robbery and if the local authorities don't comply she should place them under citizen's arrest herself since she has direct first-hand knowledge of them having committed a felony in her presence.
