The People's Court

The defendant hired the plaintiff, a lawyer, to represent her in a civil case. He claims the defendant won’t pay him because they lost, so he’s suing. The defendant argues the plaintiff guaranteed he would win the case. She appealed the decision and won, so she doesn’t think she owes because she has already paid him a ton of money in fees.

I think they call that "stupidity." Unless the attorney gives you that guarantee in writing, it's not a guarantee. The only time you don't have to pay an attorney if they lose your case is when they advertise and put it in writing that if they lose, you don't pay. Even then, they still charge you for any legal documents obtained to prove your case. The agreement states that only the attorney fees are waved, all other charges are due no matter what. Those fees can be thousands and you still may never see a dime from the party you sued. Most documents have to be "certified" in order to be considered factual evidence and that is very costly, no attorney is going to forgive that cost. If they did, the cases that they won would cost the winning clients a lot more than they already do to make up for the lost revenue.

No attorneys fees unless the contract provided for it it the general rule and this contract certainly did not provide for it. So, the attorney certainly knew that there was the potential for net loss for his client but took the case none-the-less. In my experience attorneys will gladly take your money for their "service" that leaves you worse off. His self-absurdness is also typical in my experience. "I did the work, so what if it left her worse off" He is a parasite sucking the blood from our low-trust society. Even Harvey thinks - to his core - that just hire the attorney and let them do it for you. It's a remarkable species, the attorney. They look like us, they talk like us, but they will eat us and our children alive and say they are providing a "service'.

that lazy good for nothing lawyer couldnt win the case he was hired for and was already paid 7 grand for but he could get motivated to do what was necessary to win against the poor defendant . he is the reason many people believe most lawyers are scumbags .

I find it VERY INTERESTING that she supposedly has all of that evidence, won the motion regarding the appeal... and then just let it go. Makes me think that she didn't have as good of a case as she claims.

@@pammers5588 depends on your definition of the word victim . i personally do think she was a victim because he is a degreed , trained , experienced , and professional attorney at law and she is not , and its part of the responsibility of a lawyer to give ethical and good legal advice even if it may mean losing free easy money from those who are ignorant of the legal processes and all the laws on the books . he took advantage of her trust in him as an experienced lawyer and got 7 k out of her for doing very little to nothing for her , so i dont agree with the judge on this one and judges are not always right on their verdicts .

The defendant chooses her words VERY carefully. That way she can't be tied down to anything. "Single mom" until it didn't serve her purpose. I'm 100 percent sure this is what happened with the car.

She made me mad to be like I look at him as a father figure but was real adament that she dismissed him. How u gon dismiss ur father in one sentence then cry in the next. Lady stop. He did his job. Not just that, u won the motion to appeal but did nothing with it. You had all this evidence he could've used but u didn't use it either. Smh. Waste of time

You have to register a car annually. The defendant is creepy. As soon as a woman says that phrase "I'm a single mom", I cringe because they use that as a cudgel to get sympathy or whatever they can. Then the tears to top it off. Spoiler alert: She lost the car, the initial case and still had to pay the lawyer. Great example for her kids.

@@tealandsilver Of course! And it always was. Back in the day when a person heard someone was a single parent, there was an automatic sympathy because that usually meant the spouse had died. Now? Not so much. First, divorce became more commonplace. Now people don't even 'bother' with marriage. Just get pregnant and move on. Why anyone thinks that is reasonable and not a thing to be avoided is beyond me. But then I'm old and old enough to remember when values and morals weren't getting scoffed at or canceled. Or simply not remembered. America has fallen from grace.

I find it hard to sympathize with her when she allowed the gal to have the car for yrs.. I wouldn't have let it drag on past 2 months. Esp. if the car was still in my name. Her decisions to be stupid were not the lawyers fault.

A mom who is “single” as you mean it but with an ex who helps and has dual custody actually gets more breaks than a married mom. Married moms have their kids 24/7. She "won" after she fired her attorney? All she did was set aside the arbitrator's ruling. All that you have to do to set aside the arbitrator's ruling is to object to it and then you have to go have the case heard by a judge -- which she did not do.

The judge needs to mind her business why is she trying to be bias getting the plaintiffs to let go of what he is owed should be a violation of her job . If he wants to collect on what he is owed oh well she already paid 7k to him so he is owed it so just pay the balance owed stop crying about it

I can’t officiate an adoption without a lawyer giving me the papers to sign and turn into the judge. You need a legal license for that kind of civil case. Either way I concur the lawyer should be paid for his labor.

The only people who made out was this lawyer, the person who committed fraud reporting a vehicle she did not own as stolen years after the fact. Even the arbitrator got paid even though he could not put two coherent thoughts together in his arbitration order.

The defendant needs to separate personal vs business. Furthermore, she should look at the cost of legally going after someone vs the likely benefit she would receive. This includes the emotional rollercoaster of going to court. Hopefully she is able to move forward in a more positive direction
