There's also a Big Problem with SNITCHES on Ebay and other sites. These are people who have zero vested interest in an item, but will tell Ebay, etc, that you item is fraudulent. Ebay, etc, will then PULL your item from the site, without even contacting the Seller. Some of the Snitches, are OTHER SELLERS too, who want to knock your item off, because they don't want you selling the same item for Less than them. This kind of stuff has happened to me a few times. Ebay, etc, likes to hear ONE side of the story, and doesn't let you defend yourself. There really should be an unbiased arbitrator to handle stuff like that. It should be a LAW.

People get upset with resellers because they didn’t get the deal or find it. It’s always easy to be a critic of others, but it takes a wise person to educate themselves on the art of the deal and acquiring goods at a great price. Capitalism is why we are free in this country. Nobody is forced to buy it from you. That is the buyers decision. Those selling platforms need to support their sellers. Customer's do have rights but only if the item is misrepresented. I AGREE 1000%!!! I'm tired of the fact that we know there is a Supreme Court Law saying that we have this right, but we keep getting bent over and threatened to be removed. My wife got a nice bottle of Chanel no.5 from a legit rep as a gift who is a patient of the Doctor my wife works for. Well my wife doesn't like it, so I Listed it, Sold it, and 30 days after I got a VERO. A month or so after she got another bottle, for men, and I now am worried about listing it. Either we need to have a .pdf of a legal document stating that we have this right to sell in these VERO item listings, or eBay needs to stop caving in to these companies and fight for us.

These big companies are bullies. If they were smart, instead of going after small resellers they need to go after companies in Asia that are making counterfeits. Go straight to the source instead of bullying people. I don't buy from companies that go after resellers. People who are resellers are also buyers and they are losing buyers by doing this to resellers.

I completely agree with what you were saying. I would like to add that I think these big companies are actually shooting themselves in the foot by doing this. When I shop I tend to spend our money on brands that will last and still have a resale value whenever my family is done with that item. If I know up front a company will give me a hard time about selling it on Ebay after I am done with it I simply won't buy it in the first place. Secondly, they are limiting the potential for new customers. So many people seek out used items to "test out" the brand or see if a size is right before committing to buying it new. It seems like their greed is actually also laced with fear. Stand behind the items that you make AND your customers. Resellers selling good quality used items will usually only create more fans of your brand. The fact that people seek out a 20 year old pair of shoes and create a hype around your brand doesn't hurt your company it helps it. Of course counterfeits and knockoffs should be stopped but the reselling of authentic goods should not be limited.

Well if someone starts an industry organization to go to bat on our behalf, I will gladly sub for $100/yr. I t would only take a couple class actions against these companies to stop most of them. Before a company acts they are supposed to be 100% sure that they are right. Lego went after me for copyright for a listing that had minifigures that were built with 100% lego pieces.

It’s getting very aggravating to find yet another item that you will probably get a warning and removal from ebay because they don’t have the backbone to stand up from unfair treatment by corporation trolls looking to beat up on a little guy. It would seem that they would be just the opposite, but they don’t support us in any way. The first two weeks in September I got 2 Veros for counterfeit items. Reported by Chrysler and then Kia... One was a keychain and the other were hubcap covers. Was suspended for a total of 10 days. Worst experience in reselling so far.

Reselling has always had a weird sort of perception - even back when my grandparents did it #sanfordandsons Chanel has tried for YEARS to keep it's items off the 2nd hand market stating the ownership issue too. The way I see it is it seems as though it is getting challenged more and more for people to be self-governing and self-sufficient. It’s coming from multiple directions. ‘People’ are sticking their noses into peoples’ lives and making it harder and harder to grow their own food, make their own personal medical decisions without being harassed or even losing a job. Things are going in the wrong direction and they have been for some time but we are heading for a cliff now.

Had a item in large quantity removed from eBay for counterfeit and after emailing the company they would agree to retract that if we agreed to map pricing. Very dirty of eBay to allow this.

Disney is a huge one--especially on sites like Etsy. What gets me that they come after the individuals, but not Goodwill or other thrift stores, etc. eBay doesn't seem to back up their sellers on a lot things, sadly. They are making it hard for small sellers. I haven't had this particular issue but there was a recall on one particular Corningware percolator, and their system set up to remove all the percolators and people have either given up or had to really fight it. I have three I've been holding onto because I haven't decided if I have the chutzpah to deal with it right now.

A few years ago. I had bought some magic screen mesh screen doors, from Walmart clearance. I received an email from eBay. Saying the company said they were counterfeit. I even showed receipts for them. Didn't help. Like you said they couldn't prove there were counterfeit. I still have some of them.

Now those items are no longer wanted or need and we want to sell that is our call. You set your price and buyer excepts it's a done deal. Cards against humanity. The company that makes it came after me. I had a box of the card games/starter decks I bought at a thrift store. The games were 75 cents each sealed. I had about 25 starter decks selling at $20 each. Sold about 3 before I got a VARO and then a counterfeit claim, and a 3 day suspension. Didn’t look counterfeit to me and the 3 people that bought the starter decks didn’t leave negative feedback. The company just got butthurt(ironically because they’re so edgy with their card games) and tried to take me down.

I will add, as a 22+ year independent consultant with the main company you referenced a few times in this video, while I appreciate the passion behind your reasoning, I also know the reasoning behind the company's stance and the 100% satisfaction guarantee offered to every single purchaser and consultant. The company goes out of its way to ensure ALL are taken care of. The 2nd reasoning, is very similar to your reasoning. The loss of revenue for a consultant. Additionally, I have encountered so many people who have purchased used or old products who have had negative reactions following, and then they fail to recognize perhaps the lack of quality control of the item outside of the working consultant's hands had something to do with it. Thus, perpetuating negative impressions. I am in no way upset with what you shared, only wanted to give a perspective from a working consultant on one area only. I do think resellers are the BEST at recycle, renew, reuse -- keeping out of the landfills so much. As a very young child in the later 1960s/1970s, I learned at the feet of my grandparents and of course my parents and we carried it on with our son who is a university student and helps to pay his way through sourcing and reselling right alongside us (mom and dad).

You can always shave off some ounces on boxes by cutting off some of the folding flap portions. Doesn't reduce the item protection just reduces weight/cost between the tiers sometimes.

If you get a Vero takedown, but you know your item is real and you have a right to sell it, there is a form you can file in response to Vero. It forces the Vero filer to sue you within 30 days I think, and if they don't, you are clear to put the item back on E-Bay. It's basically a pee or get off the pot response to the Vero. I've had companies try to strong arm me and I know the items are real and the Vero's were falsely filed. I filled out the form, filed it with E-Bay, and then contacted the company explaining that I can prove the item is authentic and I have a legal right to resell, and that if they sue me, I will be counter suing for damages and legal fees. I have my attorney send them this in writing on his letterhead. In both instances I have done this, the company stood down and I have relisted the items and sold them on E-Bay. It does make it a huge hassle though. Both times the company tried to explain it away as an overzealous employee making an error. Companies are hiring companies in India to scan online marketplaces and file Vero claims, and they halfway don't know what they are doing, and just hoping people will capitulate. This is what happened in both my cases. The "employee" was actually a contract worker in India that they had hired to find counterfeit items, or items that can only be sold by "authorized" distributers. But you have to be sure the item you are selling is authentic. You better know your stuff. Most resellers don't. But in most cases, people aren't as confident in a merchandises authenticity, so if confronted, they just fold. Particularly for a quantity of 1 (I had a large amount of inventory in both my cases). Most people don't even know there is a way to respond to and dispute a Vero, even if there is some peril involved.

@@commonwealthflipper If I had the means… That’s where they get you . They know you’re not going to spend $200,000 to fight them in court so that you can sell $5000 a year of their product. The only thing that will ever stop them is a class action. Which would require a lot of sellers uniting. You would need thousands of resellers paying a monthly subscription to be a part of the organization. Or, you would need a lawyer willing to work for free on the basis they take a larger percentage of the settlement. But again that usually requires a large retainer in case they lose.

A lot times it's not the company claiming the item is fake. It's eBay claiming the item is fake. That the problem. They use bots to scour the listings for violations. Instead of bouncing a suspicious listing to an agent to verify, they just pull the listing and punish the seller. Wrong on many levels. Companies don't sue you because of two reasons. A) your item probably wasn't fake. B) even if it was fake, they aren't going to sue a single seller over one item. eBay is the problem more times than it's the company, unfortunately.

I think you are missing the main discrepancy. You cannot sell these item on secondary market as New since you are not the Brand or authorized retailer. If you listed as used, you would be protected by the First Sale Doctrine. You wouldn't be able to drive a car off the lot and list it the same day as new. This is what brands are trying to enforce. Same with Mary Kay, a lot of resellers think because its sealed that it is new and that is not true. This is the definition of Grey Market sales and 99% of resellers operate in this area.

The way that companies are hitting me lately, is past the initial sale they state their warranties for their products are not transferable. If the warranty does not accompany the product, their position is then the item is no longer new. I do believe their approach has error, and informed them the sale was a business to business transaction and the warranty would "legally" still be binding to their company. The latest issue was with Dr Scholl's, where I threatened to have their product authenticated and bill them accordingly for both the authentication and the lost revenue their slanderous allegations cost me both with their product and on the platforms that they attacked me on. So far they have adhered to my request to cease and desist.

Im a high end watch dealer and I deal with this regularly. I buy and sell Rolex and other high end watches for a living. Rolex is notorious for shutting down dealers such as myself- not so much on eBay (eBay has authentication for these items) but on IG, FB, and other platforms. They are particularly aggressive towards sellers using the word “new” on any platform. Even if the watch is unworn they don’t like it and will attempt to shut your account down. Many friends and dealers have lost their entire online presence to Rolex and similar companies

Great topic. I wholeheartedly agree with you. I haven't had any issues with companies asking ebay to pull something, but ebay pulled an item because I couldn't prove it was vintage! I was fairly new to the game and had no clue what to do, so just stuck it back into the death pile. I'll relist it when it comes around again.

"The Legend of Boggy Creek" is now black listed (i.e. VERO) on ebay after someone bought the rights to the movie and are now selling blu-rays of it. It drives me up a wall that I can't sell an original DVD copy that I bought. If this DVD can have a VERO what's to stop larger companies from doing the same? Ebay blanket supports VERO claims and says I'm suppose to contact the owner and ask to sell. We know how that is going to go.

Got an email from an attorney stating I was attempting to sell a copyrighted photo of Michael Jorden in an action shot on the court. eBay removed it and advised me of same. My item was a 1988 Gatorade NBA calendar. I sent the photos to the the attorney, he wrote back saying mine was very close in looks to another one that “is circulating “. I relisted it and it sold within the week. Following week I got a message from eBay stating I could relist my item. Love your videos and that other commenter aced it when they said your “ teacher” shines through. Keep up the goodness!!

Nike has a bigger issue. They struggle with people using bots to buy up the entire inventory the day a shoe comes out, then sell them at a premium. They have not been able to get the bots under control. I do not think they have an issue with reselling used sneakers. I could be wrong.

Obviously the money is part of it for these companies not wanting the resell of their product and the most importantprobrably, but it's also the branding/customer experience/perception aspect of it. If something were to go wrong the company can't always honor their gurantee/values because they don't know where product has been.

I've had eBay take down an item they claimed was counterfeit. I contacted the company who's name was listed on the message eBay sent explaining the action. The company claimed that eBay's "A.I." often makes mistakes. (Their words) They said my listing was fine because their beef was with people selling "new" from China. Of course there was dozens still listed on eBay that should have been pulled but my used authentic item was pulled and I can't help but think it's because I'm a small seller. Of course eBay refused to reinstate the listing even after a letter from the company. This company was not on eBay's published "Vero" list either. I don't trust eBay to handle these situations fairly.

The Nike situation is only for people that use bots to grab new drops. It has nothing to do with re-selling. There limiting buyers to amount of inventory they can buy at one time cause the bots were buying up the majority of the inventory

I understand the issue that Nike trying to "fix." There are other methods to fix it in my opinion. Those bots are buying them for resellers so it does have to do with reselling. These scalpers and bot buyers are indeed resellers. The problem should be dealt with on their end not after the purchase. The principal still stands. If you own it and it's authentic you can sell it.

eBay doesn't cancel them as far as I know. They actually give the companies API access to do it themselves (and give you a strike) without eBay playing any role in the process ... which is actually a whole lot scarier.

I just had my first Vero. I do a little bit of reselling, but this item happened to be something we bought for my son's truck which he sold so we no longer needed it. They are mirrors for a Nissan pick-up but are aftermarket. They are still in the original box they came in. I tried to go back and read the notice again to try to get a better understanding of the issue, but can't figure out how to find it again on Ebay.

If I am having a garage with someone else and they bring over anti-semitic items, then I have the right to refuse to let them sell said items. The platforms we sell on get to make the same rules. You can't copyright a shoe. You can get a patent for design or utility. Mary Kay can get around the first sale doctrine by showing that an unauthorized dealer is not providing the same quality control as the company. The First Sale Doctrine is not absolute. It was written as a consumer protection law. Without it, it would be illegal for libraries to lend material.

Companies getting eBay to pull Listings. One I recall is CUTCo knives. Usually the company puts in a VERO claim, eBay pulls it and you have no recourse. I’ve had a few over the years and eBay simply says to contact the company to resolve it. It should be eBay challenging every VERO claim they are given, on our behalf, not individual Sellers.

I bought a big stack of Budweiser hats on clearance at Target. They claimed they were counterfeit and ebay took them down. I responded to ebay with photos of the tags and receipt. They said that the company has to approve a relist. Of course they never replied to me. 😡

I think I read on EBay’s seller help that if they do not respond you let Ebay know that and then you can relist the item. Something to that effect.

If items are fake I completely understand for brand issues but once purchased new from original purchasers then I am sorry used items should be sold without recourse. If they are worried used items will take away from new purchases then clearly their product is inferior and therefore why I will never buy from them.

I will see your valid stance, and raise you one. I feel that there should be a "Tax Once" doctrine. Taxation on a commodity should only apply when the commodity is new. Tax once, then one the item is "used" even if it is sealed collectible in "new" status, it should no longer be taxable. Nether as a sales tax, or as a income tax.
