It might depend on the law in that state. I’ve heard Judge Milian say before some states determine if they don’t send an itemised list, they get nothing. Some states the landlord has to pay double wrongfully withheld. Others it might be left up to a judge to determine 🤷‍♂️

yeah, some of those laws are crazy. There are cases where the tenant has absolutely destroyed the place, The tenant still got their money back, even though the letter was a day or 2 late. A couple of times, Judhge Milian has profusely apologized to the landlords, but......etc.

JM already said the plaintiff’s state requires the letter. It doesn’t mean a payday for the plaintiff however (like the suggested zero amount), but the defendant should get dinged that’s for sure. I hate when ppl keep money that’s not rightfully theirs, or someone trashing and disrespecting someone else’s property. “I was working so I didn’t clean it”, that just means someone else has to clean up after you! Be an adult!

You’re so right! I listed to the beginning of the case a 2nd time just to be sure: the plaintiff said she was waiting for them to return her deposit but never received it, so after two months she contacted him to find out why, then he texted her and said he was keeping half of it and that she hadn’t cleaned a vent. Then Judge Milian asked if the plaintiff had received a list of the damages that they were billing her for, and she (plaintiff) said no, I’m still waiting. At that point the lady should have won and been awarded the entire deposit, and possibly double or triple the amount depending on the law in their state. So all the talk about damaged items or how dirty the place was is completely irrelevant! I do not understand how this could’ve happened. There’s no way that JM doesn’t know this! What would be her motivation for ignoring such a basic rule?

Didn’t Marilyn just tell the landlord that he screwed up by not sending the itemized list of damages? That means, at the least, that the tenant is entitled to their full deposit back, if not more, according to the law in Florida. Marilyn just decided that she is not going to base her judgement on the law in this case. She decides that the landlord gets to keep some of the deposit, because she personally feels they are entitled to it. Do your job correctly Marilyn. All judgements need to be made in accordance with the law, not your personal feelings and beliefs.

Landlords take picture of apt door and number before you walk in a have a paper with apt # in pictures of damage. Be prepared and tenants record everything before you go! Documentation is key!

Our tenant protocols here are online forms, you go through the condition report on move in an move out and add photos of every wall, fitting, appliance and floor, ceiling, door and window so there's no dispute. But hey... I'm in Australia!

It's important to do a documented move out / walk through inspection check list with the owner or their representative..Videos room by room would be essential as well...Having worked in apt management for years I had a move in / move out check list , two columns to be compared at move out. Simple fix to avoid this issue. Normal wear and tear to be expected..

On other cases if the landlord didn’t write a letter to the tenant, stating damages and how much their withholding, and have so many days to deliver the letter, the tenant receives their whole deposit back, no matter what. Protocol and principle are absolutely not the same thing. Plaintiff was correct in stating that they didn't follow protocol, meaning they didn't follow the law in terms of how things were supposed to be done. She should've gotten all of her money back plus whatever extra the law allows for in Florida.
