The fact that KZbin needs the strikee’s private information, while they don’t need the striker’s info, that’s so messed up, and enables mass false strikings, while the strikee can’t defend themselves without exposing themselves. It’s so imbalanced, IMO. Edit: I’m sorry, I didn’t mean to start an argument. I know legal action is an option, but the fact that in this video, it discussed how Ironmouse has legal representation, but just didn’t get a response, from what I understand? Unfortunately, KZbin isn't to blame for that system. That is just how the law it written. It is the law that is one sided here because publishers lobbied(bribed) law makers to get a system heavily bias against individuals during the early days of the internet.

For a small channel, like 100$ to get a lawyer to write up a letter to argue why it shouldn't be taken down. For a bigger channel, it might cost more to make sure it gets through It resets the clock so the people who were behind the copyright strike NEED to respond or the strikes to away. If they respond and KZbin agrees then the next step is to take them to court in your country. If the striker are in different countries then it becomes really hard for them

KZbin is legally forced to ask for that data and send it to the one who did the copyright strike to comply with DMCA. This sucks as it can be abused like is happening here. There should be a better system to detect and punish false claims, but the DMCA protects copyright holders. The workaround that a lot of creators are doing is to create a company and register the channel to that company, so they can put their company contact address (which could be vshojo legal team in this case) hiding their personal info.

They absolutely do have a favoritism problem, which they favor the largest channels that bring them the most revenue. Big channels doxx someone or posts something that breaks the rules, light tap on the wrist. Smaller channel does that, wiped off the face of the earth with minimal to zero actual contact without the help of another party. The copyright system on KZbin has been like this for so long, and is very easily abused because those who put the false claims aren't adequately punished or pursued legally. When I tried making gameplay videos years ago on another channel, third video got struck down twice. KZbin is digging its own grave, and its only a matter of time before its only the big channels that can stay afloat.

I'm actually not sure this is comparable because while Ironmouse is one of the most popular streamers there is, she is actually not that big on KZbin. Like at all. She was only just above 1 million subscribers before termination. And she honestly did not post nearly as much as hardcore youtubers. So for youtube it isn't that much of a revenue loss like it would be for the really big youtube channels. A few things: You DO NOT have to submit your personal info to fight a copyright claim. That is not a legal requirement. You literally only need legal representation to stand in for you. You can outright take this to court if YT tries to bypass the legal system via their own internal copyright system that doesn't provide the required amenities laid out in the actual laws. YT can try to complain all they like, but their system literally does not follow the legal framework provided by the DMCA. It NEVER has, which is why YT's abusive system should have been challenged legally far more often than it has been, especially with how they try to cling to platform 230 protections.

The problem is that KZbin's own policy on this says that an authorized third party can represent you in these matters, but in practice more often than not one of KZbin's stupid bots will auto reject your counter claim for any number of stupid reasons, including the representative not being the owner of the channel, despite KZbin explicitly saying that it's acceptable to use a representative. The only way to get anywhere is to get in contact with a real human, but good fucking luck with that.

The law requires information on the parties involved. You can't just walk into a courtroom with a mask on and shout OBJECTION like a Phoenix Wright cosplayer. This is normal. The issue is that the system is heavily weighted towards to the aggressor to the point that there is no real way to fight back because literally anyone anywhere can file a strike against any channel/video they want. It's all because KZbin doesn't want to deal with the legal side of things, so they just do the bare minimum under the law. It's up to the people involved to do something, KZbin has deliberately created their system to absolve them of any obligations.

Yeah, that's the main issue with the CRstrike system since the one who sends the strike is unknown to the channel owner who was CRstriked, so, Ironmouse is basically out of luck unless she reveals her real name and address, which is both a big no no in the VTuber industry and also extremely bad for her since if her address is leaked to the internet, she could face harassment from extremist fans and people who hate her guts.

KZbin, for whatever reason, doesn't like VTubers and will take whatever steps are necessary to delete them from the platform. @@Drunken_Monke Take that with a bit of grain of salt, because i'm not a lawyer and don't know nor understand all details, but like last year or so a german streamer/youtuber i know of got banned from Twitch and Twitter, (there was some drama revolved around it) and that's where i found out germany have own lawyer kinda-companies (don't know how to phrase it) which focus just on that kind of stuff of being unfairly kicked off/banned off the social network plattform. They were able to get the twitter account back within 24 hours, and for the twitch account there was really some sort of lawsuit where the streamer went to a trial to get his account back, he actually won and got the account back. Again i don't know the exact details of the law and such, also i'm not sure if it's just Germany or whole EU, but seemingly, esp. for plattform as big as twitch and such (and maybe it's also because money-making is involved where kicking them off means to impact negatively the livelyhood of someone) they can't just kick and ban of people without a good reason. (and also from what i remember correctly, because it was kinda a big news here... and there were some people involved which were allowed to spill some details plus some video footage, it seems germany/eu lawmakers look into that stuff anyway because they want stricter rules because companies like twitch and such holds too much power... not sure if that's still something going through or whatever and again take it with a grain salt). So yeah, not sure about america and rest of the world, but the concept of "it's their building so they are allowed" too, isn't entirely right either.

The copyright strike deal is due to a policy that was improperly written initially. it is the law that they have to comply with (thanks, DMCA) they should place the burden of proof on the person submitting the claim, not on the person being accused. it's completely backwards.
