The awkward situation for Niemann is that he has publicly admitted that he cheated in the past - that allows anyone to say (and defend successfully in court) "Niemann is a cheater", EVEN IF he has permanently and irrevocably stopped doing so. Carlsen chose his words carefully - he stated his *belief* that Niemann's cheating was worse than he has acknowledged. Whether such a suggestion or insinuation constitutes defamation is beyond my expertise, but I would be surprised if Carlsen's words did not stand up in court, because opinions are not facts and because Niemann's actions give rise to reasonable doubt.

Defamation/slander specifically means that you said something that you *knew to be untrue* with the intent of causing damage. It’s extremely hard to prove in court that you had knowledge contrary to what you stated publicly, which is why the cases are extremely rare. For example, a “provable/winnable” slander case would be if a journalist interviewed witnesses that said John Doe did not steal from them in any way, yet printed an article stating that John Doe was a thief with multiple victims on record (which is evidence of them having contrary knowledge) and it was also found out that the journalist was upset with John Doe because of a child custody battle etc. (which shows motive/intent to harm). I believe part of it is also that you spreading the rumor actually has the capacity to cause harm, like the person spreading it is a public celebrity with a broad reach, a journalist with a publication etc etc, not just your average person talking shit… otherwise teenage girls would be hitting each other with slander suits all day every day 😂 Hope that helps, I am not a lawyer, just a recreational student of bird law. 🪱 🎩 Esq.

This is wrong. They threw out the antitrust claims, not the defamation claims. Neimann may still be eligible for compensation from the defamation claims. But without the antitrust claims, they refused to hear the entire lawsuit in federal court, so they threw out the entire thing, and instead instructed Neimann to file his defamation lawsuit in state court.

14:15 That is actually, believe or not, going to be the biggest problem for *Hans.* As you said here, defamation is defined as making a negative representation about someone that you knew to be untrue. The other side of that means that in order to prove defamation, Hans has to be able to prove he *didn't* cheat. And remember, this is not a criminal case, it's a civil suit, so the burden of proof is on Hans. Hans has to prove that what he's suing for is true, Magnus has no burden to prove that it isn't.

Jokes aside with the beads, I personally think what Magnus did wasn't very fair since he didn't know for sure Hans cheated, he made him a laughing stock and ruined his career. It absolutely is defamation, since Hans was NOT cheating, because he is innocent until proven otherwise. Judging people based on their past is not cool and sets a bad precedent. If Hans alleges more than $75,000 in damages, and none of the defendants are from the same state as him (or they are not from the US at all, as with Magnus), then he can bring the whole thing back to federal court (despite it previously being dismissed from federal court). Since his lawyers mention filing in state court, they probably don't intend to do this, but it is an option in theory. The tricky part is that, if those requirements are met but Hans files in state court anyway, then the defendants can remove the case from state to federal court, which may be advantageous in some circumstances.

Having recently had a colonoscopy, this is the 3rd video in a row where Levy has mentioned it being unpleasant. I’m convinced he’s listening. Anyways, the procedure is easy and painless. Get checked as colon cancer is preventable with early detection!!

Defamation is impossible to prove here. If you think someone is cheating you think that. MC can claim very easily that he didn't think someone of HNs level could beat him in an endgame over the board and that the fact that HN had admitted to cheating before gave him support and it is very hard to say that MC knew this wasn't the case.

The one thing that stick outs to me in this ‘did he, didn’t he’ situation is the video where Hans was prompted by a tv host to analyse a game he (Hans) just played, and he either couldn’t give the rationale behind his moves or he couldn’t be bothered. I can’t remember what the video was called but i know Hikaru reacted to it

If one publicly states their defense as, "I only stole twice in the past.", they can no longer cry "defamation" when they are subsequently called a "thief". He is a cheater by his own testimony. Furthermore, in that testominony he did not own his guilt - he instead minimized and circumstancialized justification for his guilty actions. In short, he showed no remorse, responsibility, or self-examination of the lack of principles that allowed him to cheat. In fact, his statements and actions belie that he still operates on the same selfish values that enabled him to cheat in the first place. I tell me children, the very first time that you lie, you become forever after a liar. The very first time that you steal, you become a thief. No one else may ever know, but you will.

Lawyer here! A "windfall" basically just means getting money you don't deserve (I always imagine it as the wind just suddenly blowing a stack of twenty-dollar bills in through the window). As for the dismissal, here is a clumsy chess analogy: Hans is white, the federal court is black. Hans is pinning black's bishop (jurisdiction to hear the case) with his queen (the two federal-law counts in his complaint). Black takes the queen (dismisses those two counts), and is now free to move the bishop (decline to hear the remaining counts).

How could he sue for defamation? To win a defamation case, you must prove that the person knowingly lied. If he believed his lie, it is not a lie and it is not slander.

No, this is incorrect. Defamation is a false statement that injures a third party. You are only required to prove that the statement is false, and that the statement has caused you harm. Knowingly lying is not a component of defamation. The truth defence to a defamation claim is that the statement you have made is substantially true. It has nothing to do with the defamer's subjective belief. Nor should it. One, because there should be a deterrent to making public accusations where you have no evidence to support you claim. And two, if that were a legitimate defence, no one could ever bring a defamation suit - the defendant could just claim they "thought it was true", and no one would be able to prove otherwise.

This is where I think UK defamation laws are much better than US laws. In the UK you could not accuse a person of cheating without being able to prove it. If you make a damaging accusation without proof then that is defamation. That makes everyone a lot more careful about making career damaging allegations.
