The brothers wanted the money. They had no reason to kill their mother except to get the money. I do not believe that the Dad would have sent them to a psychologist or psychiatrist counselor to have them work out their problems if he had been abusing them. I think they probably dreamed it up in their head as of their excuse. If the abuse had happened they had reached the age where they could have done something about it and they definitely could have left home.

Scott said "what happened to them when they were kids." Point of fact -- the abuse of Erik was still going on. In fact, one of the pressures that was on the boys in that difficult week leading up to the crime was that Erik was about to start school at UCLA and couldn't wait to move away from his dad. That week, Jose told Erik he would have to live at home 4 days (3?) of each week -- meaning the abuse would continue.

“Why didn’t they talk about the abuse before?” Because they were ASHAMED. If you listen to the way they were mocked in the media and the fact the prosecution literally tried to portray Erik as gay and that he enjoyed having sex with his father and accused him of having sex with his brother too (all stuff that actually HAPPENED IN COURT), you can completely understand why they didn’t want to talk about it. In a completely confidential prison letter Lyle wrote to his brother, he said revealing the “secrets” of their family would be like killing their parents all over again. If you actually listen to the so called confession tape, there are so many moments where the brothers allude to something terrible happening in their family, but it’s clear their hesitant to divulge the information to the therapist, whom Lyle clearly didn’t trust (for good reason as he was a complete scumbag). The judge and prosecutor said in open court that men cannot be raped. This was 1989. Nobody talked about issues like this. There is so much evidence that corroborates what the brothers testified, but of course it’s easier to just run your mouth based on what the media said rather than doing even a single shred of research. Trauma and abuse can make someone do heinous things. Attitudes like this is why victims still find it hard to come forward. The fear, the shame, the idea that they won’t be believed. You probably don’t care about anything I just wrote, but I’m hoping some people can have some critical thinking and maybe not speak on issues they know nothing about.

👍🏻 Exactly! So well said. I remember all this back when it originally occurred. I believed them then, I believe them now. Just as their story has never changed, my faith in them has never wavered. The continued lack of empathy, compassion and basic humanity is nauseating. It’s just proof that in many ways little progress has been made in more than 30 years.
@shannonoreilly4695
@shannonoreilly4695 3 ай бұрын
@@JusticefortheMemendezbrothers It really is so disheartening to see people who clearly know nothing about the case go out of their way to disparage the brothers. I don’t expect everyone to know all the details about the case - it was a long time ago and a very, very complex case - but I’m just so sick of people playing judge, jury and executioner when they clearly don’t know the facts. Listen to the “confession tape”, listen to the testimony of Erik and Lyle (whose stories are consistent with each other and which have never changed), listen to the family members and friends who testified on their behalf (and not the scumbags like Oziel and Craig who clearly wanted attention), even Lyle’s friend Donovan Goodreau who testified for the prosecution couldn’t help but say nice things about Lyle (and who likely didn’t want to reveal his own abuse story in court to corroborate Lyle’s account of his revealing it to him), as well as the fact that, despite believing they’d never get out, they’ve been model prisoners without any incidences of violence and have been involved in programs for abuse victims and prison reform in the nearly 30 years they’ve been in federal prison. The money motive makes absolutely zero sense to anyone with a more than surface level knowledge of the case.

IMPERFECT SELFDEFENSE Erik discovered he wouldn't leave to college and escape from his father, he went to his brother and Lyle confronted his father about the abuses on Erik. Their mother said to him that day, do you think i don't know what is happening? That was it, the complete scenario that lead to the crime. I really believe they were threatened, they feared for their lives, and they believed that was their only escape. Remember Jose menendez rapped their children and made them repeat to themselves, "what will i do if you tell someone about this?" "you will kill me"

It’s not revenge when you’re the victim of child sexual abuse. It really does a number on your mind. It truly is survival. Like Lizzie Borden, sure there was rage at the parents. And justifiably so, but when you’re in a mindset that there is no other way out of the nightmare and you’re conditioned to believe there is not, as I believe these two were, you reach a breaking point, as I believe these two did. Sure they planned it, but they were never in the right mindset to realize there was another way out. In their minds, I believe, they believed they were trapped with no other way out of the nightmare. So their ultimate mindset was full of rage at both parent, but they just couldn’t think of another way out, and once they started, the rage manifested thus the multiple shots fired. No one can judge these brothers until you’ve walked a day in their shoes…during their childhoods and during the nightmarish moments they endured.

My own opinion, not that it matters, and I’m not an expert, but when you’ve been torturously abused like that, it doesn’t matter if it was premeditated or not, these kids felt like their back were against the corner and they wanted the abuse to stop. This didn’t just happened when they were little this continued the whole time at least one from age 6 to 18. I don’t believe murder is condoned, but in certain circumstances, your mental health is so bad because of the torturous abuse you endure I do see this happening. 35 years. Coming here straight from the documentary (not the series) on Netflix. I feel the fact the brother (Eric?) was told by his father that he couldn't go away to uni but would go to a local place and continue to live at home was the last straw for him and his brother. I feel Lyle felt protective and sickened his brother was still being abused, and as much as they said they loved their mother, I think they also loathed her for not being there for them and protecting them as mothers should; for her knowing what was going on and letting it continue to go on. I used to think it was about the money; I was unaware of the abuse stuff until recently. My mind has been changed and I feel they should be let free. The abuse was real in my opinion, they had reached their breaking point and couldn't take it anymore.

I believe that these brothers never would have been convicted in the Netherlands (at the very least not for this long a sentence), because we have something called "Noodweerexces"... (not sure if there is something similar in the US?)... It's loosely translated as "Excessive self-defense", in cases where there is self-defense, but the way someone defends themselves goes way beyond what is required to get to immediate safety in the situation, and usually there are circumstances why this excessive response exists, such as the years of abuse they were put through. The punishment they have received is completely unjust in my opinion.

1:52 "if this guy was acting, he is as good as Anthony Hopkins" Yes, and I would even say that if he was acting/lying, then he is a BETTER actor than Anthony Hopkins. Because actors practice and rehearse, and once on the movie set they get several takes before pulling it of convincingly - sometimes dozens of takes. Here the guy had to be convincing right there and then on the first take, and in each and every situation that the subject was discussed.... It would be very difficult to be convincing if it wasn't true. I'll add that they were probably genuingly scared of their parents, even if not "immediatly in fear for their life", which is why they tried the self défense strategy. It was like "stretching some truth" to try and fit a case of self defense. If this crime were to happen now, the "battered child" defense would probably be used ; but I don't think it was a thing in the 90s.... Hence the need to come up with another defense strategy with whatever they had at hand. So my take is that the defense thing was not entirely truthful, but maybe based on bits of truths here and there, stitched together into a lie.

The dad said no, he's staying here. I'm not done with him. Erik said something like he's going with me, what are you going to do and dad said you'll find out.. watch it then decide for yourselves. Sure they were mad, they were abused from 6 for Erik and 8 for Lyle, but it was more to it, much more....

Yeah, exactly. I think these guys here and most ppl think that they're lying about being fearful because they are thinking through their own POV. But when you think it through from the brother's POV, it's not hard to feel why they were fearful and felt that they had no other options. They were abused their whole life, nobody could stand up to him, police could be bribed, they had nowhere to go, and nobody to turn to. When Lyle confronted his dad and his dad warned him, that's when they knew it was over, they had to defend themselves.

I think they were fearful for two reasons. One, was the controlling father. And two, was their nutrition and the Amygdala where the fear center is, a lack of B1 vitamin deficiency and would like to see your panel cover that. Training in tennis and eating carbs for energy. Sorry about your dog, Scott.

Scott, the abuse wasn’t over. He was still doing horrific things to them. After years and years of that level of abuse, I find it inconceivable that you could just tuck that all away somewhere and live anything like a “normal “ life. It was in the forefront of their minds every minute. I think they are innocent because at any minute it could happen again and to end it he had to die. And she was complicit because she knew and did nothing to stop it. I vote to let them out.

I think there was motive of not being able to escape. Erik Menendez said in the documentary that another factor was his father telling him he could not go to college out of town - which he said was his plan to get away from father's abuse - and that he would live at home while attending UCLA.

In not a psychologist so I know I'm not going to identify some really important unmistakable points, but, what I can clearly see is that there IS major psychological effects of abuse in their childhood and how the complex emotions- fear, resentment, powerlessness toward their abusive parents could certainly have influenced the brothers' decision to commit parricide... Erik and Lyle seemed to have perceived their actions as a form of self-preservation - a psychological relief, driven by their traumatic upbringing. as the only option to escape ongoing trauma. Psychological entrapment and survival responses? How can we even begin to understand what that means? So, what I also strongly believe is that the implications for understanding trauma in legal contexts, particularly in cases of familial violence, is what put the Menedez brothers behind bars, and THAT makes it hard for me to think their imprisonment was fair.

Spot on. Even the "greed" motive needs to be contextualised. In a family where money, success, parental approval and love is all one thing you do not generate a healthy relationship with it. To go spending it after the murder also becomes easier to understand.
@Perthgurl_6024
@Perthgurl_6024 3 ай бұрын
Absolutely!!! I couldn't agree more @mendesjosr4438 The ‘greed’ motive does need to be examined within the context of their family dynamics. In an environment where success, money, and even love are tightly interwoven with control and approval, it's understandable how Erik and Lyle might not have developed a healthy relationship with these concepts. Spending the money after the tragedy could be seen more as a grasp to break free from a lifetime of imposed values and expectations. Thanks for responding!!! 👋

The sentence these young men received was a horrible miscarriage of justice. The brutal physical and mental abuse at the hands of their father is unimaginable. There was so much evidence exposed at the time of the trial, the judge refused to allow much of it. Their grandmother came foward to saythat her son was a monster; prostitutes came foward to say that he was a monster; the psychologist (who I believe lost his license) reported back to their father everything that was told to him, tennis instructors were fired for standing up to the father and confronting him about his abuse. From a young age they were told that if they ever told anyone their father would kill them. When Erik told Lyle what his father was still abusing him, Lyle confronted his father - and they had no reason to think he wouldn't kill them. They were told that they were going on a boat ride, they discovered that the mother knew what was happening all that time - they thought they would be killed on the water. I absolutely believe they were in a state of panic and believed they had to save their own lives. It was horrendous to hear and see the things they went through.

No it wasnt. The fact is they ended two lives in a very brutal fashion. It wasnt in self defense there was no gun fight or knife fight. These were 2 grown men. Lyle didnt even live at home anymore. A medical exam wouldve proved this but that wasnt done. If this had been a female she wouldve been subjected to a rape kit why werent they? They claimed this was happening uo until they blew their parents away... prove it.

Sending love and respect from South Africa ❤. I have been following you for a few years and I enjoy this channel very much! You guys introduced me to the Menendez brothers case and subsequently watched the Netflix series. As a result of your coverage I decided to watch the court TV trial to learn more about this story. Oh my word!, the horror of it all😢. I believe their testimony, including those of family and people who were close to them. The brutality of their upbringing...gosh, unbelievable. My personal opinion is that imperfect self defense is and was a fair and reasonable argument to put forth. They should have been found guilty of manslaughter. From the clips you have shared for this analysis, I believe that the brothers may have realized, shortly after the killing, that they have overreacted. However, I believe that on the day of the tragedy, and 3 or 5 days leading up to the killings, they feared for their lives. Perhaps, what you have observed from the brothers on stand is indeed remorse. You may have observed two boys testifying about the horrors they've experienced at the hands of the two people who they loved the most. Days prior to the murders they were convinced of the imminent danger basis of how they were indoctrinated by their Dad since they were children and the realization that there Mom will side with their Dad, no matter what. I believe that, from this clip, you merely observed two boys on the stand who genuinly feared for their lives at the time of the murders, but realized afterwards that they may have overreacted. The fear resulted from years of threats by both parents. The weapons were purchased to protect themselves. I don't believe that it's premeditated. It was for protection.
