Cake decorating is an art. It takes HOURS for people to decorate a cake. I mean, I can't be the only person to sit down for one How To Cake It video only to look up and realise it has been 5 hours, right? Well, that's not what today's episode is about. There's a rule of thumb I used to hear from writing. How likely is it that in a room full of 100 people, 5 of them would be able to come up with the idea. If I wanted to copyright a book about noble space wizards using laser swords and magic to defeat an evil galaxy spanning empire, in 1920 that would be "the only one in the room" and probably copyrightable. After Starwars became a household name, I have to get a LOT deeper than that sentance to start copyrighting it. The point of copyright is supposed to be to protect ideas from being stolen long enough for them to succeed. The more people doing similar works, the more unique (and less protections) that I have get. Political message on cake, is NOT a very unique idea, it's centuries old.

My dad had this happen to one of his cakes a few years ago. He made a cake sculpture of a lady with pink hair piled on top of her head that transitioned into a flamingo for a charity event. Two years later another cake artist sumited the exact same design to a competition and won. He rightly put her on blast. He made a FB post with side by side pictures and links to their respective original posts. My dad's friends in the cake art community gave her the stink eye, and when the judges found out, they made her give back the prize money.

In this same vein, I own an ice cream shop/coffee bar and had to do extensive research for each product I sell. The name for the blended iced coffee drink aka "frappe" is not trademarked or copyrighted. However, Frappuccino IS. Similarly, Quencher (tea, water or lemonade with any of the available flavor syrups) seems to be my own copyright now because I use it in a business setting even though it is modeled after the SB Refresher.

This is just political propaganda, and as the video points out, the design isn't intricate or original enough to qualify as a piece of art (you may want to consider it art, and that is your interpretation, but legally, it's not an artpiece). Given the political nature of the cake, the message, and the fact you legally don't have any rights upon it (as much rights as you would have putting a BLM pin on your jacket) you would EXPECT the original artist to be happy the message is being shared by an artist with millions of fans all over the world... but apparently money is more important to her than her political ideology- which, when you're talking about how abortion should rightfully be free and available to all individuals, becomes a big fucking yikes.

I feel bad for her, but only so much. The only difference between me (a non-baker, non-instagram user) and her is actual baking the cake, taking a picture, and putting it online. It would only take a minimum amount of practice before I could churn out posts like hers. Heck, you could reuse cakes multiple times by wiping off the frosting and re-covering to make a new pic.

It wasn’t right of Miley to not credit, but in my opinion the apology and now credit is enough. @@Hlvla As another amateur baker I agree as well. Wiping of frosting doesn't work that well however it's possible. However, her cakes are very basic, just a cake with icing and sprinkles. Credit would be fine if it was my cake but I wouldn't care anyways it's just a cake. If it was one of those cakes that I worked very hard on and covered it in fondant and sculpted it then I would probably want credit but even, in that case, I would never take that to court.
