Couldn’t agree more! Plaintiff deserved to win, especially when the first wrap turned out crappy & the second time it was going to be done he was having to pay double, and NEVER complained about doing so. He trusted this man to do the job correctly & he didn’t, so he deserved to win. Also, when starting/running a newer Company it’s very important to keep any and all customers satisfied. He should have settled this before court so his reputation wouldn’t be put at risk, very silly move on the defendants part. He seems as though he’s still pretty young & just learning so can’t fault him too much there, I hope he learned his lesson.

The Defendant is a shady, irresponsible, unprofessional person. He has no expertise, is doing work he doesn’t understand, and intentionally cheating his employees out of money, which is hwy the employee snitched on him. And the smug disgusting little smirk after he leaves the courtroom just shows how serious he takes business. Good on the plaintiff for getting pictures, proof and pursuing the case. He should’ve paid more attention when picked the car up, but it was late at night and he probably assumed the spoiler was missing because they were going to finish the work later, until he noticed the other damages. He’s also honest because he didn’t even charge for the razor scratch markings when he could’ve, but getting the roof fixed would automatically change that. The plaintiff deserved that judgment in his favor and glad he got it.

Plaintiff is EXTREMELY lucky. Never, never, NEVER drive away from a garage without checking for damage. It doesn't matter how tired / busy you are. In 99% of cases, if you drive off you will automatically loose any standing.

The spoiler is attached to the rear upper window I've removed and replaced them only a butcher shop would use two way tape and run the risk of it coming off on the highway and impaling some poor motorcycle rider, It's glued down using the same urethane that's used on the windshield glass. Working on that roof you can line on the front and back glass and also the sunroof

A roof that was leaned on is easy to fix take a hammer and gently tap on the eyebrows (high spots) and the low spots disappear. These are low tension dents not like when a car crashes into the panel and stretches it causing a lot of tension.

Defendant was super shady. Claimed he had cameras...but he conveniently brought no footage. If he was telling the truth...the main thing that he would focus on was bringing the video footage. The footage would have shown: 1. He wasn't on the roof to cause the dents...and 2. The car either came in without the spoiler or that when the plaintiff drove off...the spoiler was there....clearing him of any responsibility.

Both the customer and owner should ALWAYS TAKE pics of the car before and after and before driving off site. I rent off-road vehicles when we visit MOAB UT (highly recommend.) It is standard procedure for both of us to take detailed pics of every inch of the vehicle. Same holds true when renting an apartment. If you are being victimized, it will help you tremendously if you ever have to go to court- which is not all that uncommon. I completely believe the car owner. IF this damage was pre-existing, the wrap guy would have definitely called him to tell him he can't wrap over the damage...because you can't. The shop owner makes a face when asked a hard question and says "we are a good shop NOW." He looked like he wanted to admit that he screwed up. I really detest liars. You do get what you pay for...if you are lucky. Common sense, why would this guy's spoiler go missing and dent his own roof.

Judge Marilyn ALWAYS says they relax the rules in small claims court. NO THEY DO NOT!.. SHE does... she allows HEARSAY, makes up numbers in her hear for damages (rough justice) none of which they do in small claims courts. And she gossips too much with the litigants.

if you didnt remove the spoiler why would you need to search the shop for it? you would just say 'i/we didnt remove a spoiler' in fact you would say 'it had no spoiler when it came in'

Um, the defendant said the shop has cameras....sooooo, maybe look at the cameras? Or bring in a video to prove he wasn't on the roof, or that the spoiler was placed in the back seat?

I have a Beamer and left an elbow dent in the hood from barely leaning on it when drying it after washing it so I can’t imagine what grown and inexperienced men could do. It seems like it’s a Beamer thing because I’ve never had that happen before after alot of cars and hand washes. And now seeing this.
