End qualified immunity and 90% of these encounters will STOP!

I doubt it. Qualified immunity is only for civil litigation. We need the laws that are already on the books to actually be enforced on (ironically) law enforcement. If LEO's were held criminally responsible for their crimes, then you might get closer to thet 90%.

What is qualified immunity?
@AmericanNinja85
@AmericanNinja85 Жыл бұрын
@T A it protects police and certain government officials from being responsible for and having to pay for damages due to their actions rather that be property damage or physical injuries to a person's body. So pretty much it's really difficult for police to be held personally accountable for things they do even if it's illegal
@mlhm5
@mlhm5 Жыл бұрын
Qualified Immunity Can Be Revoked - If the police subjects, or causes to be subjected, any individual to the deprivation of any rights, privileges, or immunities secured by the Constitution and laws, they shall be liable to the party injured by showing; (1) the individual was engaged in constitutionally protected activity; (2) that the policeman's actions caused the plaintiff to suffer an injury that would chill a person of ordinary firmness from continuing to engage in that activity; and (3) that the policeman's adverse action was substantially motivated as a response to the plaintiff's exercise of constitutionally protected conduct.

I was thirteen, in Canadia, when three older teenagers we had never seen before walked by and started yelling and threw beer bottles at a group of us and hit my brothers' girlfriend. We called the police and when they showed up, which was quick enough, they were greeted by the group of us telling them that the three guys down the road that we were pointing to had just assaulted the group of us. Instead of going after them and try to find out what happened they got out of their cruiser and started yelling at all of us to stop yelling. My brother, who was considerably irate that his girlfriend had been hit by a thrown bottle, said that if they weren't going to go after these guys then he would, and he started to walk down the road. Three police tackled him to the ground, hand cuffed him and took him away. When he got to the station (he was sixteen) he was beaten up by eight officers. After beaten and bloody and handcuffed to a bench while he could hear them celebrating what they had done to him he said one older cop walked up and loomed over him. He looked up at the officer and the officer said "What do I care? I'm retiring in a month..." And punched him hard in the stomach. ALL of that and my brother was the one that called the cops in the first place and did NOTHING wrong. And I don't even like my brother, we haven't spoken in years, so it's not like I'd be saying anything to paint him to be anything in that situation other than someone who got randomly assaulted along with his girlfriend. We had multiple friends all just hanging out in front of a friends house when it happened. People keep saying it's just a few bad apples. I have never seen that to be true. What's funny is growing up in Canadia you hear and get indoctrinated into this belief that we are smarter, nicer and better in most ways than Americans. They look down their noses at the uncouth swine of America. They bring up things like the crime rate, the majority of Canadians are like Californians and New Yorkers (from NYC) that believe they are more educated, more elevated and all around morally superior. It's quite hilarious to hear them lose their minds when I tell other Canadians, ESPECIALLY these days, that if it weren't for America's second amendment we'd all be in "camps" and we'd better hope as hard as we can that they never succeed in taking it away or we are all screwed. You can almost hear their brains snap in half and then they try to belittle you to make what they think is a point about "gun violence" and how they are GLAD "we" don't have that here. The delusions are hilarious if not frightening. My point being that we DO have crime here, and it's ever increasing. Including what they love to label as "gun crime". But my story about my brother's incident happened IN Canadia and it was thirty-four years ago. So while my "fellow Canadians" like to think things like that don't happen here, it has be, for a VERY long time. Both crime from your fellow countrymen but also from the authorities supposedly here to defend and protect against them.

Lawsuits from incidents like this should be paid by the officers and the police union. As long as it costs taxpayers instead of the cops that should be the ones paying they will never care about citizens or their rights.

It is imperative in a situation like this that a person gets a cop to verbally commit to what crime is being committed. If no crime, no detention.

I’d say a breach of the 4th amendment more than assault in the initial encounter. After the 2nd time I’d agree with his statement of being assaulted.

I have said for years, the money for judgments and settlements from lawsuits should come directly from the police pension funds. THAT will bra lot of the misconduct to a screeching halt. The offending officers would FINALLY be put in check by their colleagues because cops are notoriously anal about their pension funds and they don't want to pay for their colleagues' misdeeds. We would see a significant reduction in the fishing expeditions, brutality and abuse.r

It’s not just the cops’ superiors that quash complaints of wrongdoing, but also the local magistrates, judges and DAs who are part of the same gang.

Mr. Israel, Man, I gotta say: You need your own show on Discovery or somewhere else for these videos. For what it's worth, having your background while inserting your educated law enforcement viewpoint is absolutely CRITICAL to relay to the masses. Look, I'm just an old man and don't leave the house much or I would start filming NOW! I guess the best I can do is to keep on watching, learning and Subscribing to the channels like yours that make an impact. Thank you Sir for your insight, your time, your videos and Perspectives. You are making a difference. You have opened My eyes for sure! Keep up the great work!

Here's an idea. Maybe cities need to deduct funding from police department budgets to recover the funds law suits and settlements take out of the tax payers' pockets when "law enforcement officers" do things to violate Constitutional rights. Maybe if the departments start feeling some pain, they will "police" themselves more effectively.

Citizens need to be able to force criminal charges. Here are just some of the crimes and every single cop on scene committed multiple of these: Assault, battery, unlawful restraint/false imprisonment, felony conspiracy against rights, and felony deprivation of rights. All of these crimes were committed while armed and at all times threatening the use of deadly force which in most states means increased prison time, as well potentially additional charges.
