City of Barrie is in Ontario, we got crazies up here too. I have a client with his 14th drive suspended, he thinks that since he never got a license he can't be charged driving suspended. Concerning the Justice of the Peace they are not necessarily a lawyer, they can be a lay person who is appointed to a position of a JP.

Barrie, Ontario, Canada. “Your Worship” is the formal honorific address for justices of the peace. Edit: Jamie Russo is the owner of “Pushing Inc. Tattoo Emporium” in Barrie Ontario. The business name is mentioned twice in this video. The only online presence I see so far is on instagram and Facebook. I don’t log on to Facebook so I don’t know if this case is mentioned there. I suspect that this is related to COVID restrictions in some way. Perhaps he defied a shutdown or a vaccination or masking requirement.

This was a complete waste of precious court time. Courts need to respond to SovCits questioning their jurisdiction by holding them in contempt of court, issuing a bench warrant for their arrest and depositing them in jail for a few days to contemplate the meaning of judicial powers and jurisdiction.

As Mike and many others have already said, there is no question of jurisdiction. If it was seriously in doubt, the defendant would not even bother showing up to the court. By appearing, these sovtwits don't realise that they've already accepted the court's jurisdiction. As you say, contempt should be automatic and instant. "Do not pass GO! Do not collect $200!"

Doesn't a Canadian corporation need to have a "corporate lawyer" to represent the defendant corporation in court? Or is that only in civil courts? If the defendant corporation didn't "appear", through its attorney, that should be the end of the hearing, pending ruling on a petition to the court to authorize a shareholder or officer to self-represent the corporation.

@@msaret4384 Yes, a denied motion ("dismiss for lack of jurisdiction") can be taken up on appeal (i.e., "challenge it again"), although it would be yet another colossal waste of everyone's time in cases like this. Yes, the judge/magistrate may "rule" on the motion by denying it and move on. Trying to raise it again in that court would be evidence of contempt. The point is that a failure to appear may result in a bench warrant or other undesirable things (default judgment) that might be avoided by filing the appropriate challenge PRECISELY because "you didn't think they had jurisdiction". In this case, it's not even clear the corporation has "appeared" in court, since no attorney introduced themselves here as "counsel for the defendant corporation", as would be required in a U.S. court.

Definitely a lower court (sometimes called "provincial court," specifically called "Ontario Court of Justice") so we know it's a low-level offense on par with speeding or peeing in public. "Man Before The Court" is Jamie Russo, a long-term tattoo artist (well renowned!) and the principal operator of Pushing Inc. Tattoo Emporium. Pushing Inc. Tattoo Emporium is the corporate defendant in the alleged Feb 12, 2021 violation of the _Reopening Ontario Act_ (aka ROA). It is alleged that on or about Feb 21, 2021, within the City of Barrie, Ontario, the business Pushing Inc. Tattoo Emporium did operate in a fashion violating ROA provisions for corporations. Namely, the business is accused of "Part 3 ROA- Corporation - Fail to comply with a continued section 7.0.2 order." In this context, a "section 7.0.2 order" refers to section 7 of the _Emergency Management and Civil Protection Act_ -- How deep are we getting into this??? Let's stick with nutshell... A "section 7.0.2 order" is an "emergency power or order" by the Ontario government that seeks to "promote the public good by protecting the health, safety and welfare of the people of Ontario in times of declared emergencies," while still maintaining those rights set out in our _Charter of Rights and Freedoms_ -- makes sense? I don't know what happened in Barrie -- I'm a half-country away and we have our own idiots here -- but it looks like a 702 order was issued to allow businesses to remain open so long as they apply reasonable face-covering and hand-washing policy. ... but then this Russo doofus has a friend who knows waaaaaaay more about medicine and WAAAAAY more about law than anyone watching Law Talk With Mike, so they cooked up a way to run their business without following the ministerial 7.0.2 order... ... so then the City of Barrie filed a charge under ROA Part 3... and Russo is pushing for a trial. PS- In Ontario, a "section 7.0.2 order" violation is usually withdrawn or dismissed when you say, "uhhh... Geez, sorry." I'm no even kidding. These things are NEVER prosecuted. They file, you remedy the non-compliance. You say sorry, they say sorry for the inconvenience, and it's done!

You may "like" this Justice of the Peace Mike but as a person in charge of a courtroom, she has no control. She just lets the defendant ramble taking the legal proceedings to a screeching halt. She has the deer in the headlights look and needs to be more assertive as to who is in charge. Hint: it aint the defendant and his "consultant." I think that even most lay people would call the defendant by his name, Mr. So and so, as you suggested Mike. As fr the "consultant" in the center square? Gone. The magistrate should do the business that the pre-trial requires and end the speech making by the defendant. Then move to the next case.

Not all lawyers have an understanding of the law. In traffic court the defendant's lawyer had a ridiculous closing argument. The Judge asked the defendant if he bought his tooth brush before sentencing him for 30 days and advised the defendant next time he comes to court do not bring a Real Estate Lawyer. I was in court that day and had a good time appearing before the Judge

According to filings found online, at the middle guy's website, dating from December 2021, they are also suing the town officials, the health department, the court, the judges, police officers, and a total of 16 people in "common law court" for over $1million for "trespass". Jamie and Christopher, the other guy, name themselves as prosecutors. There is a "fee schedule" showing, for example, $100,000 for each police officer visit to the property and $10,000 for each time they had court appearances, among other things.

I just thought of something, the courts in Ontario are not televised and on zoom hearings you are not permitted to record and have to agree not to record before they allow you into the hearing. The court records the hearings but no one can request a copy of the recording so I wonder how this video made it to youtube....this Man of the Year or whatever he is may be in more trouble than what he was charged for.

So I did some digging. This is Central East Region, Ontario, Canada. There's a JP there called Jennifer Robinson and she looks like this JP. Listening again the Clerk announces at the start "This Ontario Court of Justice is again in session." but you need the hint to understand her. Barrie (the prosecutor's district) is a town in Ontario, just North of Toronto. Also of note, the defendant is Jamie Russo, he owns & operates Pushing Inc. Tattoo Emporium in Barrie, and that business is also mentioned.

Judge Middleton is fair, Judge Bryant is fair as are a lot of other judges & they all keep decorum in their court & know when to shut people down. That's one of the duties of being a judge. Stay safe & keep on smiling 👍🏼🦘

I want to see Glenn go in the courtroom and start spouting his stuff like he did to the Officers at the station ie. "That fat pig gave me a ticket and the blonde [thing] wouldn't [something something]!" Then they watch the recording... Then the good judge just levels G, and G start spewing at the judge...man what a show that would be. "Judge, I will sweep your leg!"

putting together pieces, I think this is in Barrie, Ontario Canada. To start with, the prosecutor at 1:00 in the video says "good morning your worship." and "for the city of Barrie." At 10:07 in the video, the Christopher James character says "OPP officer." OPP stands for Ontario Provincial Police, the equivalent of our state police. Barrie is about 50 miles north of Toronto. I suspect that the defendant is a tattoo artist that was busted for tattooing during the covid shutdown because of comments about ink made by Christopher James.

I have a question for anyone else out there that is using the KZbin application on an Android phone. Whenever I click on one of Mike's videos about sovereign citizens, there is like a little box that says the word context and then has a link to the Wikipedia page about the sovereign citizens movement. I'm just wondering if anybody else is getting this?

Probably not helpful but on the YT desktop version under the playing video is a context box with a paragraph from Wiki for Sovereign Citizen page with a link...i believe that is due to tags or AI picking up on it..what you are seeing is same thing only formatted for mobile devices...

In Ontario, Justices of the Peace are referred to as Your Worship. Justices and Associate Justices are referred to as Your Honour. Contempt charges are not really a thing here. In my 7 and half years in court, I have never seen a charge for contempt.

Criminal jurisdiction is established by the lawful prosecuting authority (District Attorney, city attorney, county attorney, grand jury, police officer, as appropriate) filing the charging instrument in the court naming a particular person as the defendant and asserting a particular crime that is within the criminal jurisdiction of the court. In criminal cases there are really only three things you as the defendant can attack: 1) whether the court has jurisdiction of the charged offense, 2) whether you are the defendant identified in the charging instrument, and 3) whether venue is proper in that court. Venue is different from jurisdiction. Venue is related to where the offense happened. You cannot file a case in Dallas for a crime that occurred wholly within Houston. That’s why charging instruments (an indictment, information or complaint) usually must allege the crime occurred in a particular county or city. If you are not the individual charged you do, in most cases, have the right to prove you are not. You also have the right to question whether the court has legal jurisdiction of that type of case. Venue can usually only be attacked at trial if the prosecuting authority fails to offer evidence the crime or some significant element of it occurred in that jurisdiction. As for personal jurisdiction, if you are found within the court’s jurisdiction or have been arrested elsewhere and extradited to it, the court has jurisdiction of your person, regardless of any name games you may wish to play. I am very surprised by how many judges and prosecutors do not understand these basic concepts when sov cits demand proof of jurisdiction.

Your videos also have the effect where if I’m feeling down about myself the idiots in your videos make me feel exponentially better about myself! Everyone calls me Panda cause I’m Asian, pretty stocky and I suppose muscular and I love Panda Bears, therefore any future court appearances I ever have (I wouldn’t imagine I would have any provided life continues on the path that it has) I will demand to be heard as “ a Panda appearing before the court” 😂🐼

The Judge is nice because she's Canadian. The give aways: city of Barrie, OPP, (Ontario Provincial Police) and her being addressed as 'your worship'. With respect to the Sov Cit (one of the least desirable imports from the US) apparently despite the Canadian Constitution being completely different to the U.S. one, they both have the same invisible ink portion only visible to those special individuals with a questionable grasp on reality.

Question. Mike. I have been wondering about something. When there is a sentencing hearing. Does the Judge arrive already knowing what the sentence will be? Dothe victim impact statements make difference at all? Does the defendants statement impact it? Just a curiosity. Thx

Mike have you Thought about doing a series on Christopher Throgmorton out of Laporte, Indiana? He would be a full series because there are several videos of his. They include him acting like a giant bully to everyone and then when the police arrest him he squeals like a little piglet and cries for his girlfriend. I’m not kidding. He gets angrier and angrier him and eventually finally ends up having a trial. If you haven’t seen it yet I don’t want to spoil it but I think it might be one of the funniest most pathetic things you’ve ever seen

...and the defendant ("Theemahnbafour D'Corte" - and, yes, if I was a court recorder, that's how I would have spelled it) calls in three more witnesses to help him. Let's find out what their roles are: Witness #2: "I am here to demonstrate the PROPER way to bake chocolate chip cookies." Witness #3: "I have a picture of a flying saucer that I took when I was five years old." Witness #4: "I have a pain in my lower back. Do you think it might be a herniated disk?" These accents seem to be Canadian, by the way.

IamSkippy If you look for my newest comment to the video (not a reply), you'll see the details of the story. The defendant is the corporation named Pushing Inc. Tattoo Emporium. The "man before the court" is Jamie Russo -- a very skilled and respected tattoo artist, but he is not the defendant. As the corporation is the defendant, and this is a small-potatoes provincial offence, there is NO right to a jury trial. So no... It was just a hearing today. Russo wants a trial for him company, sure... but he'll not get a jury trial, no matter what. (Unless he wants to commit a bigger offence!)

Dude mentions an "OPP officer," which refers uniquely to the Ontario Provincial Police. It might not be superior court... and I might even have the name of the court wrong.
